HomeMy WebLinkAboutO-01-47VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-01-47 AN ORDINANCE AUTHORIZING THE CONVEYANCE OF SURPLUS REAL ESTATE AT 725 WAUKEGAN ROAD WHEREAS, First Midwest Bank, N.A., previously deeded a parcel of property at 725 North Waukegan Road to the Village of Deerfield for road right -of -way purposes in the realignment, widening and improvement of Waukegan Road and the southerly access drive into the Deerfield Village Centre development; and, WHEREAS, the realignment, widening and improvement of Waukegan Road at said southerly access drive has been completed; and, WHEREAS, the Village of Deerfield has determined that a portion of said property described on Exhibits A and B attached hereto (the "Surplus Property ") is not needed for the public purposes of the Village of Deerfield; and, WHEREAS, said Surplus Property has not been used for any public purpose of the Village of Deerfield; and; WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that it is in the best interests of the Village of Deerfield that said Surplus Property be conveyed back to First Midwest Bank, N.A., the original owner and grantor of said property, by quit claim deed; and, WHEREAS, the Village of Deerfield has authority as a home rule municipality to convey surplus real property that is not needed for a public purpose of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are incorporated herein as though restated in their entirety. SECTION 2: That the President and Board of Trustees of the Village of Deerfield hereby authorize and approve the conveyance of the Surplus Property described on Exhibits A and B attached hereto to First Midwest Bank, N. A, SECTION 3: That the President and Village Clerk of the Village of Deerfield be and they are hereby authorized and directed to respectively execute and attest a quit claim deed conveying the Village's interest in said surplus property to First Midwest Bank, N.A., together with such other and further documents as may be necessary or appropriate to complete the conveyance of said Surplus Property. SECTION 4 : That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law'in that regard within its jurisdiction. SECTION 5: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. PASSED this 17th day of December , 2001.
