AN ORDINANCE APPROVING AN AMENDMENT
TO THE SIGNAGE PLAN FOR 111 PFINGSTEN ROAD
AS AN AMENDMENT TO A SPECIAL USE
INDUSTRIAL PLANNED UNIT DEVELOPMENT
WHEREAS, the owner of certain property at 111 Pfingsten Road described on Exhibit A
attached hereto (the "Subject Property") has petitioned the Plan Commission of the Village of
Deerfield to approve a modification to the previously approved Signage Plan for the Subject
Property, and to authorize such modification as an amendment. to the Special Use Industrial
Planned Unit Development for the Subject Property pursuant to the provisions of Article 6.01 -C,
Paragraph 5, and Articles 12.08 and 13.11 of the Zoning Ordinance of the Village of Deerfield, as
amended; and,
WHEREAS, the Plan Commission of the Village of Deerfield has held a public hearing to
consider a modification to the previously approved Signage Plan for the Subject Property to allow
(i) a single- faced, internally illuminated wall sign to project eight inches (8 ") above the roof deck
on the north wall of the building, and (ii) a single - faced, internally illuminated wall sign to project
six inches (6 ") above the roof deck on the south wall of the building of the building, all in
accordance with the Frost, Ruttenberg & Rothblatt, P.C. South Elevation Drawing No. 00220,
and North Elevation Drawing No. 00221 by North Shore Sign, dated January 17, 2001, and the
colored rendering of the Frost, Ruttenbeg & Rothblatt, P.C. single- faced, internally illuminated
wall signs by North Shore Sign, Drawing No. 00009, revised 2/25/00, all of which are attached
hereto and made a part hereof as Exhibit B; and,
WHEREAS, said public hearing was held pursuant to public notice and conforming in all
respects, in both manner and form, with the requirements of the statutes of the State of Illinois
and the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed sign modification for the Subject Property and the evidence, exhibits and supporting
materials offered at said hearing, has submitted its written report and recommendations to the
President and Board of Trustees of the Village of Deerfield that the modification of the previously
approved Signage Plan for the Subject Property be approved as an amendment to the Special Use
Industrial Planned Unit Development of the Subject Property in the I -1 Office, Research,
Restricted Industrial District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield are of the
opinion that said modification to the previously approved Signage Plan should be approved as an
amendment to the Special Use Industrial Planned Unit Development of the Subject Property in the
I -1 Office, Research, Restricted Industrial District, authorizing and permitting the requested
Signage Plan modifications, including that part of the wall signs extending above the top of the
north and south roof deck of the building at 111 Pfingsten Road, all in accordance with the
exhibits attached hereto and made a part hereof as Exhibit B;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
[LLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby find that the requested
modification to the previously approved Signage Plan fully complies with the requirements and
standards set forth in Articles 12.08 and 13.11 of the Zoning Ordinance of the Village of
Deerfield, and is hereby authorized and approved as an amendment to the previously approved
Signage Plan for the building at 111 Pfingsten Road, and as an amendment to the Special Use
Industrial Planned Unit Development of the Subject Property, subject to the conditions hereinafter
set forth.
SECTION 2: That the approval and authorization of said amended Signage Plan as an
amendment to the Special Use Planned Unit Development of the Subject Property is hereby
granted, subject to the initial and continued compliance with the elevations and renderings for the
building at 111 Pfingsten Road, Deerfield, Illinois, attached hereto as Exhibit B, and which are
hereby approved as a modification to, the previously approved Signage Plan for the Subject
Property.
SECTION 3: That the amended Signage Plan hereby approved and authorized as an
amendment to the Special Use Industrial Planned Unit Development of the Subject Property shall
be binding upon and inure to the benefit of Petitioner's successors, grantees, transferees and
assigns, and any violation of the conditions hereinabove set forth by Petitioner or its successors,
grantees, transferees or assigns shall authorize the revocation of the amendment hereby authorized
to the Special Use Industrial Planned Unit Development of the Subject Property.
SECTION 4: That the Village Clerk is hereby authorized and directed to record this

Ordinance in the office of the Recorder. of Deeds oftounty, Illinois at Petitioner's expense.
SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 6: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.

amendment to the Special Use Planned Unit Development of the Subject Property is hereby
granted, subject to the initial and continued compliance with the elevations and renderings for the
building at 1 I 1 Pfingsten Road, Deerfield, Illinois, attached hereto as Exhibit B, and which are
hereby approved as a modification to the previously approved Signage Plan for the Subject
Property.
SECTION 3: That the amended Signage Plan hereby approved and authorized as an
amendment to the Special Use Industrial Planned Unit Development of the Subject Property shall
be binding upon and inure to the benefit of Petitioner's successors, grantees, transferees and
assigns, and any violation of the conditions hereinabove set forth by Petitioner or its successors,
grantees, transferees or assigns shall authorize the revocation of the amendment hereby authorized
to the Special Use Industrial Planned Unit Development of the Subject Property.
SECTION. 4: That the Village Clerk is hereby authorized and directed to record this
Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Petitioner's expense.
SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 6: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
