A ROOF TRUSS REPLACEMENT CONTRACT
WITH ANDREW & BULLEY CONSTRUCTION COMPANY

ORDINANCE NO. 0-01-32
AN ORDINANCE APPROVING AND RATIFYING
A ROOF TRUSS REPLACEMENT CONTRACT
WITH ANDREW & BULLEY CONSTRUCTION COMPANY
WHEREAS, the Village of Deerfield has previously awarded a contract for remodeling of
the Deerfield Police Department facility at 850 North Waukegan Road, Deerfield, Illinois, to Boller
Construction Company, the lowest responsible bidder for the project; and,
WHEREAS, unforeseen conditions were uncovered following the commencement of such
construction work requiring the removal and replacement of existing roof trusses; and,
WHEREAS, the proper and expeditious removal and replacement of the existing roof trusses
is necessary for the safety of persons working in and about the Deerfield Police Department facility,
for the protection of the construction work in progress, and to maintain the work schedule for the
completion of the remodeling of the Deerfield Police Department facility to the greatest extent
possible; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield, at their meeting
on September 4, 2001, authorized the Village Manager of the Village of Deerfield to enter into an
emergency contract for the removal and replacement of roof trusses at the Deerfield Police
Department facility; and,
WHEREAS, the Village Manager of the Village of Deerfield and The Hezner Corporation,
the Village architect for the Police facility remodeling project, solicited competitive proposals for
the roof truss replacement work; and,
WHEREAS, the Village Manager of the Village of Deerfield, with the recommendation of
the Village architect, determined that Bulley & Andrews Construction Company best demonstrated
the necessary experience, qualifications and ability to perform the emergency roof truss replacement
project in the time and manner required by the Village, and that it would be in the best interests of
the Village of Deerfield to award of the emergency roof truss replacement project to Bulley &
Andrews Construction Company at a price not to exceed $456,538; and,
WHEREAS, the Village Manager of the Village of Deerfield, pursuant to authority granted
by the President and Board of Trustees of the Village of Deerfield, awarded the emergency roof truss
replacement project to Bulley & Andrews Construction Company at a price not to exceed $456,538;
and,
WHEREAS, the Village of Deerfield, as a home rule municipality, has the authority to waive
competitive bidding to award this emergency contract to the contractor determined to be most
responsible and in the best interests of the Village of Deerfield; and,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are
incorporated and made a part of this Ordinance as if fully set forth herein.
SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby
ratify and approve the award of the emergency roof truss replacement project to Bulley & Andrews
Construction Company a price not to exceed $456,538.

SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 4: That this Ordinance shall take effect immediately from and after its passage
and approval due to the urgency of commencing work on the emergency roof truss replacement
project and shall subsequently be published in pamphlet form as provided by law.
