HomeMy WebLinkAboutR-25-57VILLAGE OF DEERFIELD RESOLUTION NO. 2025 R 25-57 A RESOLUTION WAIVING COMPETITIVE BIDDING AND APPROVING THE PURCHASE OF ONE FIVE -TON DUMP TRUCK WHEREAS, the Village of Deerfield ("Village's is a home rule municipality in accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village Public Works Department identified a need to replace Vehicle No. 804, a five -ton dump truck used as a main break truck, plow, and general utility vehicle with a new dump truck ("Dump Truck'); and WHEREAS, CIT Trucks, LLC ("CIT') submitted a proposal for the provision of the Dump Truck in the amount of $238,009.00; and WHEREAS, the Village desires to enter into an agreement with CIT for the Dump Truck and expend $238,009.00 ("Agreement'); and WHEREAS, the Village has determined that the proposal from CIT to provide the Dump Truck is the most advantageous for the Village because the Dump Truck is not finished and the Village desires to outfit the Dump Truck next year; and WHEREAS, the Mayor and Board of Trustees have determined that waiving bidding and entering into the Agreement with CIT for the Dump Truck will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: RECITALS. The Village Board hereby adopts the foregoing recitals as its findings, as if fully set forth herein. SECTION 2: WAIVER OF COMPETITIVE BIDDING. Pursuant to Section 9-16 of the Village Code and the Village's home rule authority, the Village Board waives the requirement of competitive bidding for the purchase of the Dump Truck. SECTION 3: APPROVAL OF PURCHASE. Pursuant to its home rule authority, the Village Board hereby approves a purchase of the Dump Truck from CIT for a price not to exceed $238,009.00 pursuant to the Agreement to be approved by the Village Manager. SECTION 4: AUTHORIZATION TO EXECUTE AGREEMENT. The Village Board hereby authorizes and directs the Mayor and Village Manager to execute and attest, on behalf of the Village, the Agreement upon receipt by the Village Clerk of at least one original copy of the Agreement executed by CIT; provided, however, that if the executed copy of the Agreement is not received by the Village Clerk within 30 days after the effective date of this Resolution, then this Resolution will, at the option of the Village Board, be null and void. 4898-5347-3897, v. 1 SECTION 5: EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage and approval by two-thirds of the Village Board according to law.
