ORDINANCE NO. 2025- 0-25-17
AN ORDINANCE VACATING AN EXISTING STORM SEWER EASEMENT
AND ACCEPTING A NEW UTILITY EASEMENT AT THE SPRINGS AT
LAKE COOK CROSSING RESIDENTIAL DEVELOPMENT
WHEREAS, the Village of Deerfield is a home rule unit of local government
pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and
WHEREAS, the Village has a storm sewer easement ("Sewer Easement') on
a portion of the property located at 400 Spring Cress Road in the Village and known
as the Springs at Lake Cook Crossing Residential Development ("Property'), which
Sewer Easement is no longer useful, necessary, or beneficial to the Village; and
WHEREAS, the Property is owned by Continental 744 Fund LLC, ("Owner');
and
WHEREAS, the Owner has requested that the Village release and abrogate
the Sewer Easement and, instead, provide the Village a new utility easement located
on another portion of the Property ("Utility Easement') pursuant to a Plat of
Easement Grant & Vacation prepared by Cemcon, Ltd., comprised of two sheets with
a latest revision date of June 30, 2025 ("Plat of Easement'); and
WHEREAS, the Village has determined that: (i) it no longer needs the Sewer
Easement and the public interest will be served by the vacation of the Sewer
Easement by relieving the Village from the possible future burden and responsibility
of maintaining the Sewer Easement; and (ii) the public interest will be served by
accepting the Utility Easement from the Owner;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated
into, and made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: APPROVAL OF PLAT OF EASEMENT. The Plat is
hereby approved in the form attached to and, by this reference, made a part of this
Ordinance as Exhibit A.
SECTION THREE: EXECUTION OF PLAT OF EASEMENT. The Mayor
and the Village Clerk are hereby authorized and directed to execute and seal, on
behalf of the Village, the Plat of Easement.
SECTION FOUR: RECORDATION OF THE PLAT OF EASEMENT.
Upon execution of the Plat of Easement by the Mayor and the Village Clerk, as
provided in Section Three of this Ordinance, the Village Clerk is hereby directed to
cause the Plat of Easement to be recorded with Cook County Clerk Recording Division.

SECTION FIVE: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of
Illinois.
SECTION SIX: EFFECTIVE DATE. This Ordinance will be in full force
and effect from and after its passage and publication in the manner provided by law
