AN ORDINANCE AMENDING CHAPTER 5 OF
"THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975,"
AS AMENDED, REGARDING THE IMPOUNDING AND
REDEMPTION OF ANIMALS FROM THE POUND
WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant
to the provisions of Article VII, Section 6 of the Illinois Constitution; and
WHEREAS, Chapter 5 of "The Municipal Code of the Village of Deerfield, Illinois,
1975," as amended ("Village Code', provides regulations for Village regarding the
impoundment and redemption of dogs; and
WHEREAS, Village staff have identified the need to add regulations for the
impoundment of all animals and update the fees for violations related to the redemption of
animals from the pound; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interests of the Village and its residents to amend Chapter 5 of the Village Code pursuant to
this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: IMPOUNDING OF ANIMALS. Pursuant to the Village's
home rule authority, Section 5-9, titled "Reserved," of Article 1, titled "In General," of Chapter
5, titled "Animals," of the Village Code is hereby amended to add a new Section 5-9 and
Section 5-9A to read as follows:
"Sec. 5-9. Impounding animals.
La The Village may, from time to time, and upon such terms
and conditions as it deems proper, contract with anv
qualified persons, firm or corporation, to impound
animals picked up by the Village.
Not later than twenty four (24) hours after the
impounding of any animal, the owner shall be notified by
mail sent to his address listed on the animal register
book, or if the owner of the animal is unknown, notice
hall be posted at the Village pound and at the Village
Hall describing the animal and the time and place of

Sec. 5-9A. Redemption from pound:
The owner of any licensed animal so_ impounded, or the
person claiming to be the owner of any unlicensed
animal, may redeem such animal in accordance with the
provisions of this Article upon payment of the license fee.
if unpaid, and an impounding charge in the amount set
forth in the annual fee resolution adopted by the
corporate authorities plus the cost of keeping such
animal for each day or fraction thereof that such animal
is impounded. -�
fW All fees and charffes shall_ be paid to the Village,
Treasurer, and upon presentation of a proper receipt
from the Village Treasurer, the person in charge of the
Village pound shall release such animal in accordance
with the provisions of this Article.
c Any animal which has been apprehended by the animal
warden- any police officer or any person or corporation
charged with the enforcement of this Article shall be
deemed to have been impounded if, in the opinion of such
warden. police officer or person or corporation charmed
with the enforcement of this Article- confinement in
temporary place of safe keeping is necessary.'
SECTION THREE: IMPOUNDING OF DOGS. Pursuant to the Village's home
rule authority, Sections 5-28, titled "Impounding Dogs," and Section 5-29, titled "Redemption
from Pound," of Article 2, titled "Dogs," of Chapter 5, titled "Animals," of the Village Code are
hereby stricken:

SECTION FOUR: FEES. The Annual Fee Resolution is hereby amended to add a
fee for the redemption of an animal from the pound in correct alphabetical order as follows:

SECTION FIVE: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION SIX: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and publication in the manner provided by law.
