HomeMy WebLinkAboutR-24-81VILLAGE OF DEERFIELD RESOLUTION NO. R-24-RI A RESOLUTION WAIVING COMPETITIVE BIDDING AND APPROVING AN AGREEMENT WITH AXON ENTERPRISE, INC. FOR BODY- CAME,BA. AIED EQUIPMENT AND SOFTWARE. WHEREAS, the Village of Deerfield ("r111gge') is a home rule municipality in accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, pursuant to the Law Enforcement Officer -Worn Body Camera Act, 50 ILCS 706/10-1 et seq. ("Act'), the Village is required to have its police officers use body cameras by January 1, 2025; and WHEREAS, to comply with the Act, the Village desires to purchase body cameras and ancillary equipment and software for the Police Department (collectively, "Body Cameras') ;and WHEREAS, Axon Enterprise; Inc. ("Axon') submitted a proposal to provide the Village Body Cameras; and WHEREAS, the ' Village desires to enter into an agreement with Axon for the procurement of a Body Camera and six (6) "Pro License" for •a term of 50 months in the amount not to exceed $21,159.48 ("Agreement"); and WHEREAS, the Mayor and Board of Trustees have determined that waiving bidding and entering into the Agreement with Axon to provide Body Cameras will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD ,OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Resolution as findings of the Village Board. SECTION -TWO: W_AIVER_F__C0A=I1.LVE-BIDDING-REQUIREMENT. Pursuant to Section 9-16 of the Village Code and the Village's home rule authority, the Village Board waives the requirement of competitive bidding for the Body Cameras. SECTION -THREE: APP-ROVAI. DF A[t'REEMENT. The Agreement by and between the Village and Axon is hereby approved in substantially the form attached to this Resolution as Exhibit A, and in a final form and substance acceptable to the Village Manager and the Village Attorney. SECTION -FOUR: AUTHORIZATION—TO—EXECU_T_E_AGREEMENT. The Mayor and the Village 'Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, the final Agreement upon receipt by the Village Clerk of at least one original copy of the final Agreement executed by Axon; provided, however, that if the executed copy of the final Agreement is not received by the Village Clerk within 60 days after the effective date of this Resolution, then this authority to execute and attest will, at the option of the Mayor and Board of Trustees, be null and void. SECTION FIVE: EFFECTIVE DATE. This Resolution shaft be in full force and effect from and after its passage, by a vote of two-thirds of the Village Board, and approval in the manner provided' by law. On November 18, 2024, at the regularly scheduled meeting of the Mayor and Board of Trustees, the Police Department will be seeking approval of a resolution authorizing the Police Department to purchase one (1) Body Worn Camera (BWC), related software, hardware, and six (6) additional "Pro Licenses" for Evidence.com from Axon Enterprise Inc. HISTORY The Mayor and Board of Trustee's has previously approved the purchase of forty-three (43) Body Worn cameras in December 2023 from Axon Enterprise, Inc. The Department is seeking authorization to purchase one (1) additional Axon Body3 Worn Camera and the necessary equipment along with six (6) additional "Pro Licenses" for Evidence.com from Axon Enterprise, Inc. This unit will provide us to have an extra BWC on hand in the event one is damaged as well as equipping our Community Service Officer. The additional "Pro Licenses" will allow access for personnel without BWC's to Evidence.com for purposes of records, redactions, and court requests. The total cost for one (1) BWC along with all required operational equipment is $7,927.32 and the additional cost of six (6) "Pro License" is $13,232.16. This cost would be distributed over a 4 - year, 2 — month period beginning with an initial payment upon delivery of $1,627.68 followed by four (4) additional payment annually of $4,882.95 ending in 2028. RECOMMENDATION The Police Department is seeking Board approval of the resolution to waive the competitive bidding process and authorized the purchase of the AXON Body3 body -worn camera. The Police Department recommends the Board authorize the purchase of one (1) AXON Body3 body -worn cameras, needed equipment and six (6) additional "Pro Licenses" at a price not to exceed $21,159.48 from Axon Enterprise, Inc., 17800 N. 85 h St., Scottsdale, Arizona 85255. &OL a 2 John J.
