R-24-79 ANNUAL FEE RESOLUTION OF THE VILLAGE OF DEERFIELD ESTABLISHING A CONSOLIDATED SCHEDULE OF FEES, RATES AND CHARGES AS AUTHORIZED BY ORDINANCE NO. 0-12-35 WHEREAS, the corporate authorities of the Village of Deerfield have determined that it would be economically efficient and expedient to consolidate most regulatory permit, license and user fees, rates and charges in a single resolution to be known as the Annual Fee Resolution, and to periodically review and update the Annual Fee Resolution to ensure that such fees, rates and charges are adjusted as appropriate; WHEREAS, the corporate authorities of the Village of Deerfield have adopted Ordinance No. 0-12-35 which amends various sections of the Municipal Code and the Zoning Ordinance of the Village of Deerfield and provides for the consolidation and imposition of various permit, license and user fees, rates and charges in an Annual Fee Resolution to be adopted by the corporate authorities; and WHEREAS, the corporate authorities of the Village of Deerfield have considered and determined the fees, rates and charges to be made and imposed for the several license, permit, application, user and other charges which are authorized by Ordinance No. 0-12-35 to be established in the Annual Fee Resolution of the Village of Deerfield; and WHEREAS, this resolution shall be known as the Annual Fee Resolution of the Village of Deerfield, and the various fees, rates and charges set forth in Exhibit A to this resolution, as -1- now and hereafter amended, shall be made and imposed as authorized by the Municipal Code and the Zoning Ordinance of the Village of Deerfield, as amended by Ordinance No. 0-12-35; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: The above and foregoing recitals are incorporated into and made a part of this Resolution as if fully set forth herein. SECTION 2: Exhibit A attached hereto is hereby adopted as the Annual Fee Resolution of the Village of Deerfield. SECTION 3: That this Resolution, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Resolution should: (a) contain terms contrary to the provisions of current or subsequent non -preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Resolution should be inconsistent with any non -preemptive state law, this Resolution shall supersede state law in that regard within its jurisdiction.
