FOR ELECTRONIC CONTROL WEAPONS WHEREAS, the Village of Deerfield ("Village') is a home rule municipality in accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has budgeted sufficient funds in the 2024 fiscal year for the purchase of Electronic Control Weapons ("ECWs'); and WHEREAS, Axon Enterprise, Inc. ("Axon') submitted a proposal for the purchase and maintenance of the ECWs and the services necessary to maintain the operation of the ECWs in the amount of $36,899.25, with $14,234.10 for the first year (2024) and $11,332.71 in 2026 and 2027; and WHEREAS, the Village desires to enter into an agreement with Axon for the ECWs and expend $14,234.10 for year one and $11,332.71 for years 2026 and 2027 ("Agreement'); and WHEREAS, the Mayor and Board of Trustees have determined that waiving bidding and entering into the Agreement with Axon to provide ECWs will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Resolution as findings of the Village Board. SECTION TWO: WAIVER OF COMPETITIVE BIDDING. Pursuant to Section 9-16 of the Village Code and the Village's home rule authority, the Village Board waives the requirement of competitive bidding for the purchase of the ECWs. SECTION THREE: APPROVAL OF AGREEMENT. Pursuant to the Village's home rule authority, the Agreement by and between the Village and Axon is hereby approved in substantially the form attached to this Resolution as Exhibit A. SECTION FOUR: AUTHORIZATION TO EXECUTE AGREEMENT. The Mayor and the Village Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, the final Agreement upon receipt by the Village Clerk of at least one original copy of the final Agreement executed by Axon; provided, however, that if the executed copy of the final Agreement is not received by the Village Clerk within 60 days after the effective date of this Resolution, then this authority to execute and attest will, at the option of the Mayor and Board of Trustees, be null and void. SECTION FIVE: EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage and approval by two-thirds of the Village Board according to law. Sliozis — Chief of Police SUBJECT: A RESOLUTION WAIVING BIDDING AND APPROVING AN AWARD OF CONTRACT TO AXON ENTERPRISE, INC FOR ELECTRONIC CONTROL WEAPONS (24-85) On Tuesday, September 3, 2024, at the regularly scheduled meeting of the Mayor and Board of Trustees, the Police Department will be seeking Board approval of a Resolution waiving bidding and award of contract to Axon Enterprise Inc. for twenty-one (21) TASER brand Electronic Control Weapons. BACKGROUND The Deerfield Police Department has utilized TASER brand Electronic Control Weapons (ECWs) since the original purchase in 2017. ECWs are less -lethal weapons meant to help control persons who are actively resisting authority and, acting aggressively. The ECWs also afford officers the opportunity to use a less -lethal level of force to control a situation. The Department consistently reviews its available options to resolve serious situations and still believes this option is a viable tool. The Department is looking to increase the number of TASER ECW's to allow for each officer to be equipped at all times. Department staff is satisfied with the product quality and the reliability of the TASER Brand ECW by Axon Enterprise, Inc. and recommends continued use of the TASER ECWs. The Department is requesting to purchase the TASER 7 (Yellow) units from Axon Enterprise, Inc. The cost for twenty-one (21) units, twenty-one (21) holsters, and warranties will not exceed a total of $36,899.52 over a four (4) year period. The first installment will be in December 2024 in an amount not to exceed $14,234.10 which is not a budgeted amount for Fiscal Year 2024, and will be paid for with Seizure Funds. The Department will budget the remaining over the next three (3) years in the amount of $11,332.71 in Fiscal Years 2026 and 2027. This cost is pro -rated to match the current twenty-two (22) TASER ECW's purchased in 2022 ending in 2027. RECOMMENDATION It is the recommendation of the Police Department that the Mayor and Board of Trustees approve the Resolution waiving bidding and execution of the Contract between the Deerfield Police Department and Axon Enterprise, Inc., 17800 N. 85th St., Scottsdale, Arizona 85255 at a cost not to exceed $36,899.52.
