VILLAGE OF DEERFIELD RESOLUTION NO. R-24-46 A RESOLUTION WAIVING THE COMPETITIVE BIDDING REQUIREMENTS AND APPROVING AN AGREEMENT WITH AXON ENTERPRISE, INC. FOR THE FLEET3A PROGRAM WHEREAS, the Village of Deerfield ("Village') is a home rule municipality in accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village desires to obtain a built-in recording system for Village Police Department squad cars to capture audio and video ("System'; and WHEREAS, the Village currently uses various recording systems from Axon Enterprise, Inc. ("Vendor'); and WHEREAS, the Village has received a proposal from Vendor to provide the System pursuant to an agreement ("Agreement'); and WHEREAS, the Village has determined that the proposal from Vendor to provide the System is the most advantageous for the Village because the Vendor's System would integrate with the other recording systems currently being used by the Village; and WHEREAS, the Mayor and Board of Trustees have determined that waiving bidding and entering into the Agreement with Vendor will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION 1: RECITALS. The Village Board hereby adopts the foregoing recitals as its findings, as if fully set forth herein. SECTION 2: WAIVER OF COMPETITIVE BIDDING. Pursuant to Section 9-16 of the Village Code and the Village's home rule authority, the Village Board waives the requirement of competitive bidding for the procurement of the System. SECTION 3: APPROVAL OF AGREEMENT. The Agreement by and between the Village and Vendor is hereby approved in substantially the form attached to this Resolution as Exhibit A, and in a final form and substance acceptable to the Village Manager and the Village Attorney. SECTION 4: AUTHORIZATION TO EXECUTE AGREEMENT. The Mayor and the Village Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, the final Agreement upon receipt by the Village Clerk of at least one original copy of the final Agreement executed by Vendor; provided, however, that if the executed copy of the final Agreement is not received by the Village Clerk within 60 days after the effective date of 4865-5758-3813, v. 1 this Resolution, then this authority to execute and attest will, at the option of the Mayor and Board of Trustees, be null and void. SECTION 5: EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage, by a vote of two-thirds of the Village Board, and approval in the manner provided by law. BACKGROUND The Deerfield Police Department currently utilizes a digital in -car video recording system in the squad cars for use by patrol units during traffic stops, emergency response, pursuit driving, and other situations where the recording of events could assist in the prosecution of offenders, officer safety, the investigation of citizen complaints, training, or other situations where it could be beneficial to have a recorded document of events. The current digital in -car video system, manufactured by WatchGuard, was originally purchased in 2021 and installed in our current fleet of police squads in 2021. The system will reach its end of life in 2025 and the Police Department recommends the replacement. This recommendation is based on end of life, poor maintenance and service response, issues concerning the operation of the equipment (reliability), and the overall operation plan for the Department to have one central location for all digital evidence. The purchase of the AXON Fleet3 Mobil Video Cameras will add to the previous purchases of the AXON Body Worn Cameras, AXON Interview, and AXON Taser7 creating one unified camera system. On November 20, 2023 the Mayor and Board of Trustees authorized the purchase of marked police vehicles to replace the Police Departments current fleet originally scheduled for Spring of 2025. The purchase of the fleet is now earlier than expected as previously presented by Deputy Chief Fry. The earlier than expected arrival of the fleet leads to the earlier need to purchase the in -car video system. By purchasing the system now (2024) rather than 2025 will eliminate extra costs associated with removing the old system and installing the new system. In short it will allow us to do a complete conversion of each squad car.
