HomeMy WebLinkAboutR-24-42VILLAGE OF DEERFIELD RESOLUTION NO. 2024- R-24-42 A RESOLUTION APPROVING AN INCREASE TO A CONTRACT WITH CIORBA GROUP, INC. OF CHICAGO, ILLINOIS FOR CONSTRUCTION ENGINEERING SERVICES WHEREAS, the Village of Deerfield ("Village') is a home rule municipality in accordance with Article VH, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, on September 8, 2021, the Village awarded a contract to Ciorba Group, Inc., of Chicago, Illinois ("Consultant') to provide construction engineering services for the Zion Woods Development Project ("Services'); and WHEREAS, due to the unexpected increase to the project duration, the Village needs to expend an additional $49,998.30 to complete the Services ("Additional Expenditure'); and WHEREAS, the Mayor and Board of Trustees have determined that entering into the Agreement with Consultant will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION 1: RECITALS. The Village Board hereby adopts the foregoing recitals as its findings, as if fully set forth herein. SECTION 2: APPROVAL OF CONTRACT INCREASE. The Contract Increase for the Project is hereby approved. SECTION 3: AUTHORIZATION TO EXECUTE DOCUMENTS. The Mayor and the Village Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, any documents necessary by and between the Village and Consultant to effectuate and authorize the Contract Increase for the Services. SECTION 4: EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage and approval according to law. Street, Village Clerk {00124077.11 Supplemental Agreement for Engineering Services Village of Deerfield Zion Woods Development Construction Observation Ciorba Project Number 20926.03 This is a SUPPLEMENTAL AGREEMENT between the Village of Deerfield, (hereinafter referred to as the "CLIENT", and CIORBA GROUP, INC. located at 8725 W. Higgins Road, Suite 600 in Chicago, Illinois, a firm of Consultants (hereinafter referred to as "CIORBA"). The CLIENT and CIORBA previously entered into an AGREEMENT hereinafter referred to as the PRIME AGREEMENT, dated September 8, 2021, for the Zion Woods Development Construction Observation Services (hereinafter referred to as the PROJECT). The CLIENT now proposes that CIORBA provides the additional engineering services described in Section Two - Scope of Work in connection with the PROJECT. The CLIENT has determined that this change is in the best interest of the CLIENT and is authorized by law. NOW THEREFORE, the CLIENT and CIORBA, in consideration of the mutual covenants hereinafter set forth, agree to as follows: SECTION ONE - GENERAL PROVISIONS All work completed under this SUPPLEMENTAL AGREEMENT and any remaining work under the PRIME AGREEMENT shall be bound by the provisions of the PRIME AGREEMENT except as amended hereinafter. SECTION TWO - SCOPE OF WORK CIORBA agrees to perform certain enumerated services in connection with the PROJECT hereinafter stated as described in EXHIBIT A —SCOPE OF SERVICES. SECTION THREE - PROJECT SCHEDULE The completion date for all engineering services as shown in the PRIME AGREEMENT is revised to December 31, 2025. SECTION FOUR - COMPENSATION The PROJECT FEE shown in the PRIME AGREEMENT) is increased as outlined in the attached EXHIBIT B by $49,998.30 to a total of $156,411.64. 10/21 /2020 Page 1 of 2 <<. By: Name: Title: Date: ATTEST: Name: Title: Revised: 3 / 13 / 2023 Page 2 of 2 Oorba 09966 Proup 1644842.v Exhibit A - Supplemental Scope of Services Village of Deerfield Zion Woods Development Construction Observation The Scope of Services for the project involves performing a combination of full- and part-time inspections during construction on behalf of the Village to verify that site construction is proceeding according to approved plans and sequencing. Ciorba's inspection team will continue to consist of a Senior Resident Engineer who is approved as a Lake County Designated Erosion Control Inspector (DECI), as well as a Construction Engineer. This supplemental scope of work is required due to the following: 1. Extended construction duration compared to original expectations. 2. DECI Inspections required during the entirety of the construction duration. 3. Various sections of additional underground utilities added to the original project requiring inspection. 4. Wetland issues requiring additional coordination and inspections. Ciorba's inspection activity will continue to be focused on grading, utilities, pavement, and stormwater management features. Subsequent inspection of the building facilities will be performed by Village personnel. <111..1, CiorbaGroup Exhibit B - Supplemental Engineering Fee and Staff Hours The supplemental construction inspection services will consist of the following: Work Task Staff Hours Senior Resident Engineer Inspections 80 Construction Engineer Inspections 240 Project Management it Administration 8 Total Staff Hours: 328 The supplemental engineering fee will be as follows: Labor: 328 Staff Hours x $49.83 per hour x 2.9 = $ 47,398.30 In -House Direct Costs: Vehicle Days $ 2,600.00 Total Engineering Fee $ 49,998.30 CiorbaGroup
