ORDINANCE NO. 2024 0-24-20
AN ORDINANCE ANNEXING CERTAIN PROPERTY OWNED BY
THE REGIONAL TRANSPORTATION AUTHORITY
WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant
to the provisions of Article VII, Section 6 of the Illinois Constitution; and
WHEREAS, the Commuter Rail Division of the Regional Transportation Authority
("Metra'), a division of an Illinois municipal corporation, is the owner of a certain tract of
property in Cook County, Illinois, consisting of approximately a 2.99 acres section of Metra's
Milwaukee District North Line right of way and tracks ("MD-N') approximately 166 feet
south of Lake Cook Road, GPS coordinates, 42.151723,-87.840992, at MD-N Mile Post 22.9,
which is a portion of the parcel identified by property index number 04-04-500-004-0000, and
which is legally described in Exhibit A and depicted in Exhibit B, which are both attached
to this Ordinance and made a part hereof ("Property"); and
WHEREAS, the Property is not within the corporate limits .of any municipality, has
no electors residing on it, is contiguous to the Village, and may be annexed to the Village as
provided under 65 ILCS 5/7-1-8; and
WHEREAS, pursuant to and in accordance with the provisions of 65 ILCS 5/7-1-8,
Metra submitted a petition for annexation of the Property into the Village; and
WHEREAS, the Village and Metra have entered into that certain "Intergovernmental
and Annexation Agreement" ("Agreement'), providing that the Property be annexed to the
Village upon the execution of the Agreement; and
WHEREAS, subject to the terms set forth in this Ordinance, the Village desires to
annex the Property, pursuant to Illinois law; and
WHEREAS, the Village Board has determined that annexation of the Property is in
the best interests of the Village and its residents;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated herein as
findings of the Village President and Board of Trustees.
SECTION TWO: ANNEXATION OF THE SUBJECT PROPERTY.
The Village, pursuant to Section 7-1-8 of the Illinois Municipal Code, 65 ILCS 5/7-1-
8, hereby annexes into its corporate limits the Property.

SECTION THREE. RECORDING.
The Village Clerk is hereby directed to cause a certified copy of this Ordinance,
together with an accurate map of the annexed territory, to be recorded with the Cook County
Clerk Recording Division.
SECTION FOUR. EFFECTIVE DATE.
This Ordinance shall be in full force and effect from and after its passage, by a vote of
two-thirds of the corporate authorities of the Village, and approval in the manner provided
by law.
