HomeMy WebLinkAboutO-75-27ORDINANCE NO. 0 -75= 27 AN ORDINANCE AUTHORIZING A SPECIAL USE DEERFIELD LAWN & GARDEN SPOT MULTI= BUSINESS USE Published in pamphlet form this 2nd day of T,; , 1975, by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -75- 27 AN ORDINANCE AUTHORIZING A SPECIAL USE DEERFIELD LAWN & GARDEN SPOT MULTI = BUSINESS USE WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application.of DEERFIELD LAWN & GARDEN SPOT and the KNAAK BUILDING TRUST to authorize.the use and occupancy of certain real estate commonly known as 641 Deerfield Road, Deerfield, Illinois, and here- inafter described, for multiple principal uses of a retail business nature including a garden supply sales and a vacuum cleaner sales and repair shop as a.special use under and pursuant to the provisions of Sections XIII,D,3,k; XIII,D,4; XIII,B,7: XIII,D,S; and XXIII of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after con- sidering the evidence adduced, made written findings of fact including express affirmative findings of compliance with the provisions of Sections XIII,D,5 and XXIII,B,3 of the Village Zoning Ordinance and recommended that said special use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan ONE: Commission are concurred in and adopted as the findings of the President and Board of Trustees and the special use of the real estate legally described as follows: Lot 4, but not including Lot 10 in Owner's First Addition to Deerfield, being a subdivision of part of the North Half of Section 33, Township.43 North, Range 12, East of the 3rd P. M., according to the plat thereof recorded September 25, 1915, as Document 161061 in Book "J" of Plats, page 46, in Lake County, Illinois; Lot 5 in Owner's First Addition to Deerfield, being a subdivision of the North half of Section.33,'Township.43 North, Range 12, East of the 3rd P. M., according to the plat thereof, recorded September 25, 1915, as Document 161061 in Book "J" of Plats, page 46, in Lake County, Illinois. as and for purposes of multiple principal uses of a retail business nature including garden supply sales and'a vacuum cleaner sales and repair shop be and the same is hereby authorized and approved: I I SECTION That the approval and authorization of said special use TWO: hereby given is subject to the requirement that all use, construction and development shall be in accordance with all plans and representations submitted and made by Applicants to the Plan Commission and President and Board of Trustees and is subject to compliance by Applicants with all other applicable provisions of the Zoning Ordinance and all other applicable ordinances of the Village of Deerfield. SECTION That the approval and authorization of said special use THREE: hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicants. SECTION That the Village Clerk is hereby directed to publish FOUR: this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication as provided by law.
