HomeMy WebLinkAboutO-20-19VILLAGE OF DEERFIELD ORDINANCE NO. 2020- 0-20-19 AN ORDINANCE AMENDING "THE DEERFIELD ZONING ORDINANCE OF 1978," AS AMENDED, TO PERMIT AS A SPECIAL USE MASSAGE SERVICES WITH AESTHETICIAN SERVICES IN THE I-2 LIMITED INDUSTRIAL ZONING WHEREAS, the Village is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs; and WHEREAS, Bizar Entertainment, Inc., an Illinois Corporation d/b/a BW Spa ("Applicant"), is the lessee of that certain parcel of real property commonly known as 151 Pfingsten Road, Suite S, Deerfield, Illinois ("Property'; and WHEREAS, the Applicant currently uses the Property for physical fitness classes, and desires to also offer massage and aesthetician services; and WHEREAS, the Property is located entirely within the I-2 Limited Industrial District of the Village ("I--2 District'; and WHEREAS, massage services with aesthetician services are not allowed in the I-2 District as either permitted or special uses; and WHEREAS, the Applicant submitted an application to the Village seeking approval of an amendment to the "Deerfield Zoning Ordinance 1978," as amended ("Zoning Ordin.ance'� to make massage services with aesthetician services an allowed use in the I-2 District upon the issuance of a special use permit ('Proposed Amendment'; and WHEREAS, a public hearing of the Plan Commission of the Village of Deerfield to consider the Proposed Amendment was duly advertised in the Deerfield Review on July 2, 2020 and held on July 23, 2020; and WHEREAS, on July 23, 2020, the Plan Commission considered the Proposed Amendment at its meeting and adopted findings, recommending approval of the Proposed Amendment; and WHEREAS, the Village Board has considered the standards for amendments set forth in Section 13.10 of the Zoning Ordinance; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village to adopt of the Proposed Amendment, as set forth in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: {00116669.3} SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as the findings of the Village Board. SECTION TWO: MASSAGE SERVICES WITH AESTHETICIAN SERVICES. Section 6.02-C, titled "Special Uses," of Article 6, titled "Industrial Districts," of the Zoning Ordinance is hereby amended to read as follows: "6.02-C Special Uses The following uses are permitted in the I-2 Limited Industrial District when authorized in accordance with the procedures for Special Uses as set forth in Article 13, Administration and Enforcement: 22. Massage Services with Aesthetician Services Massage services with aesthetician services when such uses are located on a property adjacent to Interstate 94 (also known as the Edens Spur)." SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
