VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -15 -22 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD TO PROVIDE FOR THE CONSIDERATION OF PUBLIC ART IN VILLAGE CENTER DEVELOPMENT APPLICATIONS WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June 11, 2015 to consider whether the Zoning Ordinance of the Village of Deerfield should be amended to require that development applications for commercial developments in the C -1 Village Center zoning district should be required to consider the provision of public art in the development of the property; and, WHEREAS, the Plan Commission of the Village of Deerfield submitted its written report and findings of fact to the Board of Trustees recommending that the Zoning Ordinance of the Village of Deerfield be amended as provided herein to require that all development applications for commercial developments in the C -1 Village Center district shall give due consideration to providing public art on the property; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: -1- SECTION 1: That Article 2 ( "General Provisions ") of the Zoning Ordinance of the Village of Deerfield be and the same is hereby amended to add the following as Article 2.12 thereof: 2.12 Consideration of Public Art in Development Applications All development applications for commercial developments in the Village Center shall give due consideration to providing public art on the property. Development plans shall consider opportunities for providing public art in their developments and provide a public art plan if appropriate for the proposed development. SECTION 2: That Article 14.02 -13 ( "Definitions ") of Article 14 ( "Rules and Definitions ") of the Zoning Ordinance of the Village of Deerfield be and the same as hereby amended to add the following as a defined term: PUBLIC ART: Public art means a work of art created by a visual artist or public context designer that is sited in a public place for people to experience. This can include murals, sculptures, or infrastructure such as public fixtures or furniture and other functional elements that are designed and/or built by visual artists or public context designers. Public art is art that is located in public spaces and may include art in windows, art in public building atriums, and other indoor places that are generally open to the public. It is art that people encounter on a daily basis in the public sphere. SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. -2- PASSED this 3rd day of August 2015.
