O-55-112 c' ORDINANCE NO. BE IT ORDAINED by the President and Board of Trustees of the Village of Deerfield, Lake County, Illinois: SECTION 1. That a new Article entitled Article V -A of the Building Code of the Building Code of the Village of Deerfield be..adopted, which Article shall read as follows: Article V -A - ARCHITECTURAL DESIGN. Whereas it is universally recognized that many neighborhoods in urban areas have deteriorated in the past by reason of poor planning and indiscriminate and unregulated building, and by the.progr.essive errection of inferior and unsuitable buildings in C'i pf; such neighborhoods, and whereas such deterioration has been invariably accompanied by a drastic reduction im property values and by a deterior- ation in conditions of health, sanitation and safety in such neighbor- hoods, and for the purpose of preventing such deterioration and preserving unto the.owners and residents of property within the Village of Deerfield of the property values now existent and for the preservation and improve- ment of the existing standards of health, sanitation and safety within the Village, the following provisions are enacted: (a) - All new buildings shall be of an architectural design suitable for a good suburban community. No permit shall be issued for any new building, or for an improvement to an existing building which is such archi- tectural design that the same is manifestly inferior or so radically different as to impair marketability or.property values of existing buildings in the same immediate vicinity. (b) - Free standing buildings and buildings fronting on more than one street shall have the same material or achitecturally harmonious materials used for all exterior walls. Buildings partially free standing shall have the same material or architecturally harmonious materials used for exposed exterior walls and exposed portions of exterior walls. Nothing herein contained shall be held to require the use of more than one material on any one wall unless more than one material is used for other exposed walls. (c) No permit shall be issued for the construction or erection or for the excavation of more than two residential buildings of similar exterior 124 1 design and style, on the same side of the street, in one 660 foot block. Two residential buildings of like exterior, design and style when so con- structed within one block may be erected only when they are not adjacent to each other or directly across the street from each other. (d) - When in the opinion of the Building Commissioner the issuance of a permit or permits would be contrary to any one or more•of the provisions of this Article, the permit or permits will be denied and the matter shall, on appeal, within two weeks from the date of the receipt by the Building Commissioner of the application for permit, be referred to the Building Board of Appeals for its consideration and recommendation as in the same manner which is provided for appeals in Article III -A, of the Buildipg Code of the Village of Deerfield. After public hearing wherein evidence shall be rec6ived from the applicant and from such other persons who may desire to appear and be heard at such hearing, and after careful considera- tion of all of the evidence, the Board of tippeals shall forward its recom- mendations to the Board of Trustees of the Village, indicating whether the construction of the proposed residential buildings will or will not detri� mentally'affect values of adjoining and neighboring properties. the Board of Trustees of the Village shall act upon such recommendations as provided in.the Building Code of the Village of Deerfield, except that no payment of fees for appeal from Article V -A shall be required. SECTION 2. That all ordinances or parts of ordinances in conflict with the provision of this ordinance be and the same are hereby repealed. SECTION 3. Nothing contained in this ordinance shall be construed as abating any action now pending under .or by virtue of any ordinance of the Village of Deerfield which may be hereby repealed; or as discontinuing, abating, modifying or altering any penalty accrued or to accrue as affecting the liability of any person, firm or corporation or as saving any right of the Village of Deerfield under any ordinance of said Village existing at the time of the passage of this ordinance. SECTION 4. This ordinance shall take effect and be in force from acid after its passage, approval and due-publication as provided by law. PASSED this 9th day of May, A.D., 1955.
