O-110c Ordinance No. 110 AN ORDINANCE providing for the submission to the voters of the Village of Deerfield, Lake County, Illinois, the question of issuing $575,000 Sewer Improvement Bonds at a special election to be held in and for said Village on the sixth day of November, 1953• 14HEREAS the present sanitary sewer system of the Village of Deerfield, Lake County, Illinois, is inadequate to properly serve the Village and its inhabitants, and it is necessary and in the interests of public health and safety that improvements and extensions be made to the system consisting of the construction of additional sewer mains and a new treatment plant, all in accordance with plans and report of the engineers employed by the Village for that purpose, heretofore approved by this President and Board of Trustees and now on file in the office of the Village Clerk for public inspection; and WHEREAS it is hereby estimated and determined that it will require not less than $786,000 to make said improvements and extensions to the existing sanitary sewer system of said Village; and WHEREAS funds are not available for the purpose of making said improvements and extensions, and for that purpose it will be necessary to borrow money and in evidence thereof issue the bonds of said Village; and WHEREAS it is proposed by said Village that a part of the cost of the construction of said improvements be provided by the issuance of revenue- bonds and that the Village borrow money and in evidence thereof issue its full faith and credit bonds in the principal amount of $575,000 to pay part of the cost of the construction of said improvements and extensions; NOW, THEREFORE, Be It Ordained by the President and Board of.Trustees of the Village of Deerfield, Lake County, Illinois, as follows: Section 1. That it is hereby determined to be necessary and in the interests of public health and safety that improvements and extensions be made to the sewer system of said Village, as set forth and described in the preambles of this ordinance, and for said purpose it will be necessary that this Village borrow money and in evidence thereof issue bonds of said Village. -1- Boca 12.08 'PAcE262 BE IT ORDAINED by the President and Board of Trustees of the Village of Deerfield, that: Section 1. It is to the best interests of the Village that the alley in the Village described hereafter shall be vacated: The alley running north and south in the block bounded on the north by Somerset Avenue, on the west by Oakley Avenue, on the south by the east -west alley running between Oakley Avenue and Sheridan Avenue, and on the east by Sheridan Avenue, and the same is hereby vacated; PROVIDED, HOWEVER, that there is reserved to the Village of Deerfield and any licensee or person holding a franchise therefrom, the Fublic Service Company of Northern Illinois, and the Illinois Bell Telephone Company, their successors and assigns, the right, permission and authority to maintain their property and rights of way and easements to construct, operate, maintain and renew poles, wires, cables, mains and necessary fixtures for the transmission and distribution of electricity, for the carrying and distributing of gas and for the transmission of coruz=ications, together with the right of access to the same for the maintenance thereof, and also to trim from time -to time such trees, bushes, and saplings as may be reasonably required for the construction and efficient- operation of said poles,.Wirss,_cal�le$, mains, and necessary fixtures in the aforesaid vacated alley; and provided further that there is reserved to the Village the right to continue the use of, replace, repair and maintain any.sewer, water, or other municipal utility now located within such alley. That there be borrowed by, for and on behalf of said Village the sum of $575,000 for the purpose of paying part of the cost of improvements and extensions to the sewer system of said Village, and that to evidence said loan negotiable bonds of said Village be issued, and that said bonds be designated "Sewer Improvement Bonds," be five hundred seventy -five in number, numbered from 1 to 575, inclusive, be of the denomination of 61,000 each, and mature serially $20,000 on December 1 of each of the years 1955 to 1958, inclusive, $252000 on December 1 of each of the years 1959 to 1961, inclusive, $30,000 on December 1 of each of the years 1962 to 1965, inclusive, $35,000 on December 1 of each of the years 1966 to 1969, inclusive, �n and $40,000 on December 1 of each of the years 1970 to 1973, inclusive, and bear interest at the rate of not to exceed three and three - fourths per cent U (3 3/4 %) per annum, payable semiannually. Section L4. That for said election there be and are hereby established two election precincts, the boundaries of each and the polling place for each shall be as follows: PRECINCT NUMBER 1. Precinct Number One shall include all that part of the Village of Deerfield lying north of Deerfield Road. The voting place for such district shall be in the auditorium -room of the West Deerfield Township Hall at 602 Deerfield Road. Precinct Number Two shall include all that part of the.Village of Deerfield lying south of Deerfield Road. Village Clerk 'J rQl `9 a 9 � �� BOOK5 ,PAG €? 35 ORDINANCE GRANTING VARIANCE t BE IT ORDAINED by the President and Board of Trustees of the Village of Deerfield, thats The question of granting a variance from the terms of the Zoning Ordinance as hereinafter described was referred by this Village Hoard to a Commission consisting of the members of the Board of Zoning Appeals for consideration; the said Commission, after due public notice, held a public hearing on November.3, 1953, to consider the matter. The Commission found that the property known as 646 Deerpath Drive Lot 23, Westview°Subdivision is owned and used by Mr. John C Koss for residential purposes, than strict compliance with Section XVIII, Paragraph A.of the Zoning OrdiA of the Village, insofar as.that section requires that an accessory building may not be located nearer than five (5) feet to any interior lot line and no closer than ten (10).faet "of.any vain building, w ould cause undue hardship and would place the garage in e4 position which would require a driveway unsuitable for safe and easy access and exit. THEREFORE, 'the Board of Trustees hereby adopts the findings of the Commission above referred to and grants a variance from the terms of the Zoning Ordinance pe ting Mr. John J. Koss to construct a garage on the said premises wit in two (2) feet of the side (South) lot line and within nine (9) feet ok the house.
