ORDINANCE SETTING FORTH ESCROW PROVISIONS,
ENGINEERING FEES, EXTENSION REQUIRMgENTS
AND REGULATIONS IN CONNECTION WITH THE 'IN-
STALLATION OF PUBLIC OR PRIVATE UTILITIES
BE IT ORDAINED by the President and Board of Trustees
of the Village of Deerfield, Lake County, Illinois;
WHEREAS, under Section 123 of the Mun�dipal Code of Deer -
field.passed January 21, 1946, street and sidewalk pavements shall
be made in conformity with specifications laid down from time to
time by the Board of Trustees, and under applicable statutory and
ordinance provisions the Village has jurisdiction over the in-
stallation of all public and private utilities.,
SECTION 1; That whenever pursuant to said applicable
statutory and ordinance provisions an application is made for a

permit to construct a street,. a sidewalk, a sewer, a water main,
an alley, or any other public and private utility, the issuance
of any permit for any such public or private utility shall be sub-
ject to the following conditions, rules and regulations whether
or not the same are set forth in length in said permit;
(a) All plans and specifications for the construction
of any proposed public improvement in the Village
of Deerfield, or in territory lying outside of the
Village of-Deerfield where the village has juris-
diction or where it is proposed to connect any
such public improvement with any public improvement
or facilities of said Village which have been pre-
pared by any person other than the Village Engineer,
shall be submitted to said Village Engineer for
review and approval and no work-shall be done in
connection with such public improvement until the
plans and specifications therefor have been ap-
proved by the President and Board of Trustees
of said Village, after the same have been recom-
mended and approved by said Village Engineer.
Any person, firm or corporation submitting the
said plans and specifications for a public improve-
ment shall pay a fee of one per cent (1%) of the
total cost of said improvement. Such fee shall be
paid to the Village Clerk at the time of the sub-
mission of said plans and specifications and be-
fore the same are approved;
(b) All public improvements shall be made under the
supervision.of and subject to the direction of
the Village Engineer and shall be subject to a
final inspection by said Engineer at the time of-
their completion. Any person, firm or corpora-
tion desiring to make such improvements shall
apply for a permit therefor to the Village
Clerk and at the time of applying for such per-
mit shall pay a permit fee of three per cent
(3 %) of the total cost of such improvement, which
fee will be returned in the event such permit
is not granted;
(c) Deposit in escrow in a bank designated by the
President of the Board of Trustees a sum of
money equal to the costs.of constructing the
improvement covered by said permit, such a-
mount to be determined by the Village Engineer.
Such escrow shall provide that in the event
applicant fails to complete said-improvement
in accordance with the requirements of all
pertinent sections of the statutes of Illinois
and the village ordinances within a time fixed
in said escrow the village shall be permitted
to use all or such portion of said escrow money
as may be required to enable the village to
complete the construction of the improvement
involved;
(d) No street, public or private, shall hereafter be
constructed within the village until a permit
therefor shall be obtained and an adequate bond
posted to insure that such street when con-
structed will comply with the following minimum
requirements;
(1) The pavement of such street must be of a
material which equals or exceeds in' quality
water -bound macadam. For the purpose of
this Ordinance pit gravel is to be considered
inferior to such macadam and may not be used
in street construction within the.Village;
(2) A water -bound macadam base not less than
seven (711) inches in thickness surfaced
with not less than one ('1 ") inch of "built -
in- place' dust -proof asphalt surfacing. The
requirements,relating to said base and said
surfacing,shall comply with or exceed the re-
quirements of the State Highway Department
for sub -class A -1 for such construction;
(3) -'The material on construction requirements
with respect to streets hereafter constructed,
whether macadam or a superior construction is
used, shall meet all specifications of the
Illinois Division of Highways for the partic-
ular type of pavement used;

(4) Proper drainage shall in all cases be pro-
vided at the time such street is construct-
ed;

(5) No pavement shall be hereafter constructed
that will afford less than a driving width
of twenty ( 20 1 ) feet, except in front of
blocks which contain lots having a frontage
of one hundred (100,! )feet or more in which
case such pavement shall have a minimum
driving width of eighteen (181) feet.
SECTION 2; That whenever any such public or private
utilities are installed or extended to serve any lot or lots or
subdivision or subdivision, then in such event the person, firm or
corporation making such installation or extension shall extend such
utility or utilities along the frontage to the most distant limit
or lot or lots or subdivision or subdivisions involved. No permit
or permits for any house service connections to such utilities shall
be granted unless and until such utilities are extended the full
frontage of the lot or "lots or subdivision or subdivisions involved.
SECTION 3; That all ordinances or parts of ordinances
in conflict with this ordinance, be, and the same are hereby re-
pealed.
$EGTION 4; This ordinance shall be in full force and
effect from and after its passage and approval according to law.
