02/13/1953112?1 February 13, 1953 An adjourned meeting of the President and Board of Trustees of the Village of Deerfield was callgd to order by the Prehident`Andrew G. Bradt at 8 P. U. Roll call- Present- Trustee Engelhard, Hinchsliff, King, Meintzer and Wilson. Absent - Trustee Nynkoop. A motion was made by Trustee Engelhard and seconded by.Trustee King, that reconsideration be given to the following motion which, ih the meeting of February 9th, was made by Trustee Hinchsliff, seconded bjt Trustee Maintzer, and which failed to carry by majority vote: "That we adopt the majority report of the Board of•Apiieals which denies the petition as'submitted by tha Bfiarwbods Home Owners • Association for rezoning, and thatith6 building permits which•are' being held be delivered to the Robert Bartlott Realty Company." Roll call was as follows. Yeds- Trustee Engelhard, Hinchsliff, King; 12eintzer and Nilson. Nays- None. Motion carried. Thereupon, Trustea Xinchsliff again moved, which was seconded'by Trustee Neintzer, that we adopt the majority report ofathe Board of Appeals which denies the petition as submitted-by the Briarwoods Home Owners Association for rezoning, and that the twenty building permits which are being held be delivered to the Robert Bartlett Realty Company, Roll call resulted as, follows. Yeas - A11. Nays- None. Motion carried. • t It was moved by Trustee Rngelhard, which was 'seconded by Trustee King, that a letter of-February 13th, with regard to the above matter, from the law firm of Schultz, Krinsley, Voorheis & Hedberg, be incorporated in the minutes. Roll -call resulted as folla'xs.- Yeas - All. Nays- None. Motion carried. It was moved by Trustee Maintzer and seconded by Trustee Wilson, that the ordinance attached to and-made a part of these minutes entitled 1953 Election Ordinance, be adopted. Roll call resulted as follows. Yeas- Trustee Engelhard, Hinchsliff, King, Meintzer and Wilson. Nays- None. The delivery of these permits has been withheld pursuant to your direction. It has been suggested that for a period of time the Bartlett Organization agree to a limitation of the number of applications for permits which it will make in the Briarwoods Subdivision. Accordingly, upon the condition that such 20 permits be delivered immediately and that the Bartlett Organization be permitted to pro- ceed with the construction of the houses therein referred to, Mr. Bartlett pro- poses as follows: (a) . Permits have heretofore issued for 3 houses on Warrington Road. It has been suggested to Mr. Bartlett that he defer building on the lots referred to in such permits because such lots might be within the right -of -way of a easterly- westerly roadway now under consideration. Substituted permits are to be. given for such 3 permits for construction of like houses north of Westgate Road or such 3 permits are to be amended to show the new building locations north of Westgate Road. (b) For a period of 60 days from.this. date the Bartlett Organization agrees to make no more than 5 applications for house building permits for general or speculative construction, each of. such houses to have a minimum square foot floor area requirement as provided in the present zoning ordinance or the pro- posed comprehensive zoning ordinance recommended by Messrs. Kincaid & Hutchinson for this area, whichever minimum requirement is the greater, and such houses are to be located north of Westgate Road. Such applications are to be processed and permits granted within 5 days after making application, pro- vided that such applications otherwise conform to the present zoning ordinance and building code as heretofore interpreted. V ordinance recommended by Messrs. Kincaid & Hutchinson for this area, which- ever minimum requirement is the greater, and such houses are to be constructed north of Margate Road. Such applications are to be processed and permits granted within 5 days after making application, provided that such applications otherwise conform to the present zoning ordinance and building code as heretofore interpreted. (d) For a period of 60 days no application will be made for permits for the construction of houses south of Margate Terrace having a minimum square foot floor area of less than 1, 550 square feet if a one story residence and 1, 750 square feet if a two story residence. (e) No restriction shall be imposed as to the number of applications for per - mits for houses which will exceed 1, 550 square feet for a one story residence and 1, 750 square feet for a two story residence and any application for permits for houses of such size shall not be included in determining the applications referred to in (b) and (c) above. By making the foregoing proposal the Bartlett Organization does not concede the propriety of withholding the 20 permits above referred to but does agree that if such permits are issued immediately it will in good faith comply with the _ restrictions imposed upon itself by this letter. Moreover by making this proposal, I the Bartlett Organization does not concede the legality or propriety of any municipal . 1 ordinance which imposes a minimum square foot floor area requirement for houses in excess of the present zoning ordinance.
