01/04/2010January 4, 2010 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by Mayor Harriet Rosenthal in the Council Chambers of the Village Hall on Monday, January 4, 2010 at 7:37 p.m. The Clerk called the roll and announced that the following were: Present: Harriet Rosenthal, Mayor Robert Benton Thomas Jester Barbara Struthers Absent: Alan Farkas Mary Oppenheim William Seiden and that a quorum was present and in attendance. Also present were Village Attorney Peter Coblentz and Kent Street, Village Manager. PLEDGE OF ALLEGIANCE Commander Mel Soltwisch led those in attendance in reciting the Pledge of Allegiance. . PRESENTATION OF 25 YEAR Mayor Rosenthal presented a 25 year service award SERVICE AWARD to Commander Mel Soltwisch. Commander Soltwisch worked for the sheriff's police department for three years before coming to Deerfield in 1985. Over the years, he was promoted to detective, sergeant and then commander. Commander Soltwisch was instrumental in developing the Citizen's Police Academy in Deerfield. He has received the Clarence Pederson Award twice, the Cook County Sheriff's Medal of Honor and a department commendation, as well as 26 honorable mentions. Commander Soltwisch thanked the Board, his family, and members of the Deerfield Police Department for their support. MINUTES OF PREVIOUS MEETING Trustee Jester made a motion to approve the minutes of the December 21, 2009 Board of Trustees meeting. Trustee Struthers seconded the motion. Mayor Rosenthal noted a clarification to the Old Business section. The motion passed unanimously as amended. BILLS AND PAYROLL Trustee Jester made a motion to approve the Bills and Payroll dated January 4, 2010. Trustee Benton seconded the motion. Trustee Struthers questioned why the Village is paying IDOT more than $415,000. Mr. Street explained that it was for the Wilmot project cost sharing grant. The motion passed by the following vote: AYES: Benton, Jester, Struthers, Rosenthal (4) NAYS: None (0) Board of Trustees meeting January 4, 2010 Page 2 of 4 PUBLIC COMMENT REPORT AND RECOMMENDATION OF THE PLAN COMMISSION RE: REQUEST FOR APPROVAL OF AN AMENDMENT TO A SPECIAL USE TO ALLOW RENOVATIONS TO THE VILLAGE'S WASTEWATER RECLAMATION FACILITY AND SHEPARD PARK There was no Public Comment. REPORTS The Plan Commission held three pre - filing conferences on July 23, 2009, August 27, 2009 and September 22, 2009, a workshop meeting and a Public Hearing on December 10, 2009 to consider the Village of Deerfield's request for an amendment to a Special Use to allow renovations to the Village's Wastewater Reclamation Facility and Shepard Park. The Plan Commission voted 6 -0 in favor of sending a positive recommendation to the Village Board. Vern Witthuhn from Strand Associates, Inc. provided a summary of the proposed plans. Director of Public Works and Engineering Barbara Little added that the Village Board and staff have worked on the Wastewater Reclamation Facility project since 2004. The effort included review of alternative service providers and alternative designs, as well as meetings with area residents. Mr. Witthuhn advised that the facility was planned to take into consideration and overcome concerns about odors, noise and facility screening. He discussed the new site layout, along with structure changes and new roadways. Mr. Witthuhn reported that the facility would have accessible restrooms and additional parking that may be utilized by park patrons. Mr. Witthuhn stated that if the proposal gets approved, the next step is to submit the plans to the Illinois EPA. The project would then go out to bid, and construction would start in late summer or early fall. Trustee Jester asked about the schedule. Mr. Witthuhn explained that the process has taken longer than previously thought. Trustee Benton commended Mr. Witthuhn and staff for being sensitive to the neighbor's comments. The restrooms and parking for park patrons were desperately needed. Mayor Rosenthal thanked the Plan Commission, Strand Associates, and Village staff for looking at aesthetics as well as functionality. She noted that before undertaking the rebuilding of the plant, the Village looked at other alternatives, including rerouting, privatization, and more rehabilitation. The Board and staff unanimously decided to undertake the project of reconstruction of the Wastewater Reclamation Facility because they felt this was the best alternative. Mayor Rosenthal hopes residents will keep showing a strong interest in the project. She stated that the Board decided to pursue LEEDS certification for the administration building. She thanked Mr. Witthuhn, staff and Wastewater Reclamation Facility Supervisof Frank Cisek for their professional dedication on this project. Trustee Benton stated that nobody can read the future, but the rules will change as technology gets better. The new plant will be adaptable to the new rules and regulations as they come along. Trustee Benton seconded the motion. The motion passed by the following vote: AYES: Benton, Jester, Struthers, Rosenthal (4) NAYS: None (0) Ms. Little thanked the Deerfield Park District and School District 109 for their input in this process. She also thanked the Plan Commission and planning department personnel who made the project better. She expressed appreciation to the Board for their support of this critical project for the Village. CONSENT AGENDA There was no Consent Agenda. OLD BUSINESS There was no Old Business. NEW BUSINESS ORDINANCE ABATING A PORTION An Ordinance abating a portion of the 2009 OF THE 2009 TAX LEVY tax levy requirements for the series 2008 REQUIREMENTS FOR THE SERIES general obligation bonds. First Reading, 2008 GENERAL OBLIGATION BONDS —1R ORDINANCE AMENDING AND An Ordinance amending and revising the REVISING THE ANNUAL BUDGET OF annual budget of the Village of Deerfield for THE VILLAGE OF DEERFIELD FOR the fiscal year beginning May 1, 2009 and THE FISCAL YEAR BEGINNING MAY ending April 30, 2010. First Reading. 1 2009 AND ENDING APRIL 30, 2010 Mr. Street explained that revisions include pension obligations, rock salt purchases and the Walgreen's rebate. Trustee Jester noted that the money would come out of reserves. AWARD OF CONTRACT FOR Ms. Little explained that the annual budget for the PARKWAY TREE TRIMMING AND Public Works and Engineering Department contains REMOVAL an allocation of $89,000 for parkway tree trimming and removal. This was last bid in 2008. She is requesting that the competitive bidding process be waived and that the Board authorize the renewal of the contract with Sawvell Tree Trimming, Inc., who has agreed to keep the unit pricing the same as the previous contract. 1 1 Board of Trustees meeting January 4, 2010 Page 4 of 4 Trustee Struthers made a motion to waive the competitive bidding process and award the contract for parkway tree trimming and removals to Sawvell Tree Trimming, Inc. in an amount not to exceed $89,000. The motion passed by the following vote: AYES: Benton, Jester, Struthers, Rosenthal (4) NAYS: None (0) UPDATE ON COM ED DISCUSSION Village Attorney Peter Coblentz provided an update on the Village's lawsuit against Commonwealth Edison. He explained that the Village filed a petition for a re- hearing requesting the Appellate Court to modify their December 15, 2009 finding. The Appellate Court originally held that the plaintiffs could recover some costs, but not costs related to temporary housing, battery - powered sump pumps or back -up generators. He stated that those economic losses are properly recoverable under the Mormon Document. Mr. Coblentz will report back when further information is received. 2010 CALENDARS Trustee Struthers advised that 2010 Mosquito Abatement District calendars featuring artwork by local students is now available. She invited residents to take one home. NEXT MEETING Mr. Street reminded residents that the next Board of Trustees meeting will be held on Tuesday, January 19`h due to the observance of the January 18`h Martin Luther King, Jr. holiday.
