The regular meeting of the Board of Trustees of the Village of Deerfield was called to
order by Mayor Harris in the council chamber of the village hall on Monday, December 5, 2005
at 7:34 P.M. The Clerk called the roll and announced that the following were:

and that a quorum was present and in attendance. Also present were Village Attorney Peter
Coblentz and Bob Franz, Village Manager.
PLEDGE OF ALLEGIANCE Mayor Harris asked Dr. Gerri Spinella to lead those
in attendance in reciting the Pledge of Allegiance.
APPROVAL OF MINUTES Trustee Benton made a motion to approve the
minutes of the November 21, 2005 Board of
Trustees meeting. Trustee Rosenthal seconded the motion. The motion passed unanimously.
BILLS AND PAYROLL Trustee Wylie made a motion to approve the Bills
and Payroll dated December 5, 2005. Trustee
Rosenthal seconded the motion. The motion passed by the following vote:
AYES: Benton, Feldman, Rosenthal, Seiden, Struthers, Wylie (6)
NAYS: None (0)
BOARD AND COMMISSION Trustee Rosenthal made a motion to approve
REAPPOINTMENTS reappointments to the Boards and Commissions.
Trustee Benton seconded the motion. The motion
passed unanimously. The reappointments are as follows:

REPORTS
PRESENTATION BY HUMAN Dr. Gerri Spinella shared some of the items from
RELATIONS COMMISSION RE: the Random Acts.of Kindness Program. She
RANDOM ACTS OF KINDNESS explained that in the month of October several
PROGRAM families and classes at Caruso Middle School
volunteered to keep a.kindness journal for 30 days.
In October, more than.700 Random Acts of Kindness were shared. Dr. Spinella noted that the
commission may want to reach out with this program to other organizations and allow them to
record and share their acts of kindness to receive village recognition. The Community Relations
Commission believes it is important to pass this on so it becomes part of the culture in Deerfield.
They recommend hiring a coordinator to handle the nominations and celebrations as well as
correspondence and organization of the program. They believe the program should be a year-
long initiative. Mayor Harris asked for more information on the recommended coordinator.
Chairman Witkovski said the commission would look into it further and present it to the board at
a later date.

scope of the proposed addition. He was concerned the TIF money would not be enough. Mr.
Kayne asked the Board to consider reducing the scope of the project.

ORDINANCE AMENDING THE An ordinance amending the municipal code to

SMOKING IN PUBLIC PLACES AND
WORK PLACES — 1 R Three residents spoke about the proposed
ordinance. One resident believes people should
have the right to: choose, and the ordinance should not be passed. The owner .of Trax Restaurant
stated that he believes it is unreasonable to prohibit smoking in his bar area. One resident spoke
about the 25 foot entryway provision included in the ordinance.
Trustee Seiden recommended some changes to the
ordinance, considering there is a tobacco products store in Lake Cook Plaza with a smoking area
inside. He believes an exemption should be added for stores where tobacco products are the
principal .business.
In response to a question, Mr. Coblentz explained
that the definition of outdoor events and venues could be modified to include community fairs,
parades, or markets that are for the general public.
Trustee Rosenthal questioned how the ordinance
would be enforced. She expressed concern if a pedestrian left a store and continued walking on
the sidewalk, passing doorways and ventilation systems. She is concerned about the fine amount
and suggested having a sliding scale where the first offense would have a $25 fine, the second
offense would have a $50 fine and subsequent offenses would have a $100 fine. Chief Sliozis
explained that the police department would like to put the offense on a parking ticket. He
believes enforcement would initially be complaint driven.
Trustee Rosenthal made a motion to change the
distance from a public entrance from 25' to 10'. Trustee Benton seconded the motion. The
motion failed by the following vote:

Trustee Benton made a motion to include
community fairs, parades, events or markets that are for the general public to be included in the
definition of outdoor events and venues. Trustee Wylie seconded the motion. The motion
passed by the following vote:

Trustee Rosenthal made a motion to have a sliding fine scale
where the first offense would have a $25 fine, the second offense would have a $50 fine and
subsequent offenses would have a $100 fine. Trustee Struthers seconded the motion. The
motion passed by the following vote:

NEW BUSINESS
TRUTH IN TAXATION PUBLIC The Director of Finance explained that a public

$42,750 of new money for the General Fund, and $375,000 to capture the new EAV from the
recently expired TIF 1. The overall levy increase is 18.8 %, but the rate is expected to decline by
4 %, and the average taxpayer should see no change in their tax to the village.
This will stand as a First Reading.
RESOLUTION R -05 -15 ADOPTING AN Staff is proposing amending the retirement health
AMENDED VANTAGECARE saving plan to allow village employees to deposit a
RETIREMENT HEALTH SAVINGS portion of their salary into a tax advantaged plan
PLAN that would allow them to pay post- retirement health
costs without incurring any tax liability for the
amounts involved. The contribution would be voluntarily and would be irrevocable, per IRS
rules. There would be no cost to the village.
Trustee Rosenthal made a motion to adopt the
resolution for an amended Vantagecare Retirement Health Savings Plan. Trustee Struthers
seconded the motion. The motion passed by the following vote:
AYES: Benton, Feldman, Rosenthal, Seiden, Struthers, Wylie (6)

DISCUSSION
THANKS TO PUBLIC WORKS Trustee Rosenthal thanked the public works
department for their assistance with the leaf pick up,
water main breaks and the beautiful holiday lights.
