11/04/1996November 4, 1996 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by Mayor Forrest in the Council Chamber of the Village Hall on Monday, November 4, 1996, at 8:00 P.M. The Clerk called the roll and announced that the following were: Present: Bernard Forrest, Mayor Marvin W. Ehlers John H. Heuberger Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Michael Swartz and that a quorum was present and in attendance. Also present were Village Manager Robert Franz and Attorney James Stucko. Trustee Seidman made a motion, seconded by Trustee Swartz, to approve the minutes of the previous meeting. Trustee Ehlers suggested that the section regarding renovations to the train station be amended to add that Mr. Jacobs stated that control wires currently on multi -arm poles along the eastern boundary are to be installed underground in conduit. Trustee Swanson suggested that the final sentence of the fifth paragraph regarding a PCS monopole in Clavey Park be clarified to say that AT &T's drawings appear to be out of scale. He also made a capitalization correction on page 6. The motion to approve the minutes as amended passed unanimously. RESOLUTION R- 96 -10, DISCUSSION RE Since a large number of people had signed ILLINOIS TOLLWAY IMPROVEMENTS/ in regarding the Illinois Tollway /Edens Spur EDENS SPUR CONNECTION connection, Mayor Forrest moved discussion of that matter to the top of the agenda. . Mayor Forrest read a statement giving the history of the tollway improvements /Edens Spur connection issue and the various alternative connection points to the Edens Spur which have been identified and evaluated without consensus over the past two years. He then proposed that the Board of Trustees pass a resolution which endorses building an underground connection from Lake Cook Road to the Edens Spur immediately west of I -294. Mayor Forrest stated that although this solution would carry a significant cost, it would be the most viable alternative. Mr. Franz read the proposed resolution. Copies of Mayor Forrest's statement and the proposed resolution are attached and made part of these minutes. Trustee Seidman commented that, while he supports the resolution, he feels a better solution would be to dissolve the Tollway Authority and remove the toll booths. A secondary solution would be to follow the example of several other states which have removed tollbooths from the roadway and put them on the on /off ramps. Trustee Heuberger stated that although this is the most viable of the proposals presented, it is sure to run into resistance 1 1 7 from the Tollway Authority due to its high cost. He suggested that tolls for the Edens Spur could be increased to help offset the cost of building the underground connection. Trustee Rosenthal commented that using the spur instead of Deerfield streets is something that should be encouraged. Increasing the toll at the site would penalize those who use it and would be contradictory to the Village's objectives. She stated that the Village must be firm in pushing for the underground connection to the Spur. If that is not possible, then the no -build option must be the Village's fall back position. Jack Nelson of the Deerfield /Bannockburn/ Riverwoods Chamber of Commerce stated that the Chamber supports the tunnel concept. Bob Pease, Chairman of the TMA of Lake Cook, expressed his agency's frustration at being unable to come up with a solution that is acceptable to all, in spite of the great amount of time that has been spent in trying to do so. Mr. Pease stated that his group reluctantly supports the Heuhl Road access. The Tollway Authority has made it clear that they will not spend the-amount of money needed to build the fly over, and the tunnel would be even more costly. Therefore the only two options are the Heuhl Road access and the no- build. The TMA believes that the no -build option would cause worse traffic problems than the Heuhl Road access. They further believe that if the no -build option is chosen, the Tollway Authority will not come back at a later time and correct the problem. State Representative Lauren Beth Gash gave her support of the Village's resolution for a tunnel connection to the Edens Spur, and stated that she will continue to work with any and all parties interested in coming to a consensus on this matter. Rep. Gash commented that in her opinion the Heuhl Road site poses possible serious safety and environmental concerns. Ms. Gash reported that the Deerfield toll plaza collects more money than any other toll plaza in the system. She is sponsor of a bill which mandates that money collected in one segment of the tollway must be spent to maintain and improve that portion of the tollway. Money from the Tollway Authority should be made available for this project. Many area residents wished to express an opinion on the Edens Spur issue. All of those who spoke were in support of the proposed tunnel project. After everyone who wished to speak had been given the opportunity to do so, Trustee Swartz made a motion to adopt the resolution. Trustee Seidman seconded the motion. The motion passed unanimously. At a public hearing held on October 31, 1996 the Plan Commission also voted to approve the request. Trustee Seidman made a motion to accept the reports of the Plan Commission and the VCDC and to direct the Village Attorney to prepare an ordinance. Trustee Heuberger seconded the motion. The motion passed unanimously: REPORT AND RECOMMENDATION OF PLAN The owners of the properties at 214, 222, and COMMISSION RE REQUEST FOR VACATION 234 Burr Oak Avenue are requesting vacation of OF A RECORDED REAR BUILDING LINE the recorded 55' rear building line for their FOR PROPERTIES AT 214, 222, AND properties. This building line was 234 BURR OAK AVENUE established on the subject properties so that the houses to be built on the lots would be set back a reasonable distance from the existing house to the west. That home has been torn down, however, and the property was resubdivided into three lots. The homes built on those lots are further from the rear property line than the original house and meet the setback requirements. The new rear setback for 214, 222 and 234 Burr Oak would be 251, which is the required rear yard setback for a Planned Residential Development in the R -1 District. At a public hearing held on October 10, 1996, the Plan Commission voted unanimously to approve the petitioners' request. Trustee Seidman made a motion to accept the Plan Commission Report and direct the Village Attorney to prepare an ordinance. Trustee Swartz seconded the motion. The motion passed unanimously. The motion passed by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) DISCUSSION LEAF PICK UP PROGRAM Trustee Rosenthal commended the Street Department for the good work they have been doing with the leaf pick up program but added that...the Village needs -to find a way to communicate to residents that leaves need to be kept out of the street until the night before their designated pick up day. They also need to be alerted to keep storm drains on their street free of leaves so that the drains work properly during rain. Mr. Soyka responded that it might help to get the newsletter out a little earlier. He added that leaves came down early this year. 5,400 cubic yards of leaves were picked up this first week of pick up, which is about 50% of the total amount picked up in any given year. Some landscapers have also been caught bringing leaves into Deerfield. Those who were identified have been ticketed. EMERGENCY SEWER REPAIR Mr. Soyka reported that a sink hole is developing in the eastbound lanes of Deerfield Road near the rear of Ford Pharmacy. TV inspection of the 8" vitreous clay pipe shows that the joints have pulled apart causing the undermining of Deerfield Road. Although the sewer will probably be abandoned when the Ford Pharmacy property is redeveloped, it nevertheless requires immediate repair to protect Deerfield Road. Mr. Soyka has received several quotes for lining the pipe. He recommends that the low price of $10,850 submitted by Insituform Technologies be accepted. Trustee Seidman made a motion to accept the bid of Insituform Technologies for. an amount not to exceed $10,850. Trustee Rosenthal seconded the motion. The motion passed by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) PLANNED UNIT DEVELOPMENT SIGNAGE Barbara Houpt is recommending that the Board PLANS direct the Plan Commission to hold a public hearing to consider adding an amendment to Article 12 of the Zoning Ordinance which would list "signage plan" as an element 5 of the overall PUD approval process. Trustee Rosenthal so moved. Trustee Swartz seconded the motion. The motion passed unanimously. ATTEST: Village Clerk 1 1 APPROVED: 31 Mayor Mayor Forrest's Statement Tollway Improvements/Edens Spur Connection November 4, 1996 Village Board Meeting For the past fifteen years, the Village of Deerfield has sought a full interchange at Lake Cook Road and I-294. In fact, the Village secured right -of -way from developers for ramps on the east side of I -294 and conveyed that property to the Tollway at no cost. In this effort, we always promoted a connection to the Edens Spur as far west as possible on Lake Cook Road to get vehicles going to and from the Edens off of local roads and onto an expressway designed for that very purpose. Three years ago, the Illinois Tollway Authority informed the Village that it intended to split the Deerfield plaza by moving either the northbound or southbound collection booths further north on the tollway. For reasons never fully explained to us, that project was summarily abandoned and plans undertaken to acquire property for expansion of the existing plaza. We objected at the time because we believed it was purely a political decision made to accommodate other jurisdictions at Deerfield's expense. At no time were we consulted even though the Tollway knew full well that the impact of that decision would affect us dramatically. I am still of the opinion that the plaza should be split so that the burden of that operation does not fall to any one community. That aside, in 1994 we were advised that the new plaza plans would result in eliminating access to and from the Edens Spur at Deerfield Road. Since then, we have engaged in a series of Tollway meetings with the Village of Northbrook, our respective Chambers of Commerce and the Lake Cook Transportation Management Agency to find an acceptable alternative access. Northbrook and Deerfield even retained an outside traffic consultant at considerable expense to help in this process. As most everyone knows by now, it has been impossible to reach a consensus on a new connection. By our count, over a dozen alternatives were identified but, because of certain Tollway design standards, the number of alternatives were reduced to three: - a flyover connection from west of I -294 - a connection at Huehl Road - a combination of these two alternatives Another alternative which has emerged over time is a "no build" option which no one feels is the ultimate solution but, because of opposition to other alternatives, must be considered. Although the TMA strongly opposes the no build plan, Deerfield must keep the option on the table. We simply do not know how traffic will actually disperse if access to the Spur is cut off at Deerfield Road. On the other hand, we do know for a fact that a Huehl Road connection will draw thousands of vehicles daily to within our corporate limits - traffic that will inevitably find its way to residential streets not designed to handle it. To suggest that Deerfield alone has an obligation to bear the burden of solving this regional traffic problem is ludicrous. We have over four miles of the tollway system either within or bordering our corporate limits. Now the plaza and its attendant problems of noise and pollution is to be expanded. Deerfield can not, should not and will not let the Tollway resolve its traffic problems at our expense. It is for these reasons that I am proposing this evening a resolution that endorses the only really viable alternative - an underground connection from Lake Cook Road to the Edens Spur immediately west of I -294. While there has been disagreement on Mayor Forrest's Statement Tollway Improvements/Edens Spur Connection November 4, 1996 Village Board Meeting Page 2 various connection points, all traffic experts agree that, from a purely traffic standpoint, a connection at that location is the most desirable. The cost of such an improvement is admittedly a critical issue, but it is also manageable given the Tollway's resources and financial assistance from the Cook County Highway Department which, through this improvement, could (and should) eliminate any future plans to widen Lake Cook Road - a project strongly opposed by all the municipalities which border it. At this point, I would like the Village Manager to read the resolution after which I will ask for Trustee comments and than accept questions or comments from the audience. F m 1 RESOLUTION NO. R-9646 A RESOLUTION REGARDING TOLLWAY IMPROVEMENTS AND ACCESS .TO THE EDENS SPUR WHEREAS, the Illinois State Toll Highway Authority has scheduled extensive roadway improvements that will result in the elimination of access to and from the Edens Spur at Deerfield Road; and WHEREAS, various alternative connection. points to the Edens Spur have been identified and evaluated over the past two years; and WHEREAS, no consensus on a preferred connection point has been reached by the various agencies, both public and private, which have studied the problem during this period; and WHEREAS, the proposed Deerfield Plaza improvements and Edens Spur connection will have a greater impact on Deerfield than on any other community; and WHEREAS, there is agreement that regional traffic conditions would improve the farther west a connection is made from Lake Cook Road to the Edens Spur; and WHEREAS, a connection east of I -294 would only draw more traffic into Deerfield giving further impetus to the widening of Lake Cook Road from four to six lanes; a project opposed by the City of Highland Park and the Villages of Buffalo Grove, Deerfield and Northbrook; and WHEREAS, the Illinois State Toll Highway Authority intends to eliminate exisiting access to the Edens Spur and, therefore, should be responsible for funding a new connection that offers the greatest benefit to the region; and WHEREAS, the only viable improvement is a connection west of I -294 that will divert through traffic from Lake Cook Road to an expressway designed to draw traffic to and from I -94. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD: SECTION That a new connection to the Edens Spur should be installed on Lake ONE: Cook Road west of I -294 through underground ramps designed in a manner that least impacts adjacent properties at that location. RESOLUTION NO. R-96-/V A RESOLUTION REGARDING TOLLWAY IMPROVEMENTS AND ACCESS TO THE EDENS SPUR SECTION That the Illinois State Toll Highway Authority should take immediate TWO: steps to acquire the right -of -way needed to construct said connection. SECTION That the project should be jointly funded by the Illinois State Toll THREE: Highway Authority and the Cook County Highway Department, the two agencies which will benefit most by said improvement. SECTION. That the Village Clerk shall provide a certified copy of this FOUR: resolution to the Illinois State Toll Highway Authority and the County Highway Department.
