MINUTES VILLAGE BOARD COMMITTEE OF THE WHOLE August 29, 1994 The Village Board met as a committee of the whole on Monday evening, August 29, 1994 to discuss with the Appearance Review Committee its duties and rules of procedure. In attendance were: Villa eg Board Mayor Forrest Trustee Ehlers Trustee Heuberger Trustee Rosenthal Trustee Seidman Trustee Swartz Appearance Review Commission Martin Becker, Chairman Richard Coen Lynn Keck Petty Michael Hull Villa eg Staff Robert Franz Gerald Smith Jean Spagnoli Mayor Forrest opened the meeting by reviewing the purpose of the Appearance Review Commission, and stressing the need for its members to operate within the parameters of Village ordinances. He cited examples of where he felt the group overstepped its authority in seeking concessions from certain petitioners. He emphasized the need for better application of the Appearance Code criteria as opposed to the personal preferences of the committee members. Marty Becker commented that the commission believed that it was operating as originally intended, and that no one has ever appealed an ARC decision to the Village Board. The commission members felt that they have made a difference due in large part to their persistence that merchants work with them in making changes to the exterior of their buildings. There was discussion on whether the ARC should be advisory only and transmit all petitions, with recommendations, to the Village Board. After reviewing the pros and cons of that change, it was agreed that the process should remain as is with the following adjustments: 1. At the very beginning of the application process, petitioners should be informed in writing that they have the right to take their case to the Village Board following whatever action is taken by the ARC. 2. In addition to approving or denying a petition, a third option of the commission is a "direct referral' to the Village Board. This would occur when a petition (or a particular aspect of a petition), in the opinion of the commission, needs to be reviewed by the Mayor and Board of Trustees. It was also agreed that the commission should begin a review of the Appearance Code criteria to determine if amendments are needed. This could be done in conjunction with efforts to implement a uniform signage plan /facade improvements within the Village Center. The Village has an established Facade Improvement Program, however, no one has ever applied for Village funding. i 1 Committee of the Whole Meeting August 29, 1994 Page 2 No further action will be taken at this point.
