12/20/1993December 20, 1993 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, December 20, 1993 at 8:00 PM. The Clerk called the r.oll.and announced that.the following were Present: Bernard Forrest, Mayor Marvin Ehlers John H. Heuberger Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Absent: Michael Swartz and that a quorum was present and in attendance. Also present was Village Manager Robert Franz and Attorney Sheila Beary. Trustee Seidman moved, seconded by Trustee Ehlers, that the minutes of the previous meeting be approved. Motion carried unanimously. BILLS AND PAYROLL Trustee Seidman moved, seconded by Trustee Heuberger, that the Bills and Payroll be approved. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None (0) TREASURER'S REPORT Finance Director George Valentine reported sales tax receipts are 4% over the previous 12 month period. Major revenue items are at or close to projection. Expenditures are close to budget with the exception of the Water Department due to a decline in water sales. As of November 30, 101.1% of cash was invested at an average interest rate of 4.40 %. SPECIAL USE AMENDMENT Petitioner is proposing a remodeling and FOR ATM /PRELIMINARY renovation project that will include PLAT OF CONSOLIDATION moving the existing 24 -hour ATM from the FIRSTAR BANK lobby to a drive -up lane. The Plan Commission recommended approval of Firstar Bank's request for an amendment to a previously approved Special Use for the proposed changes to the facility and a Special Use for a 24 -hour ATM in the fifth drive -up lane; denied petitioner's request to extend the parking lot lighting beyond 9:00 PM; recommended canopy lights at the ATM be required to be on from dusk to dawn; approved petitioner's plans to connect the parking lot sidewalk to the sidewalk on Todd Court; approved the preliminary plat of consolidation. Trustee Rosenthal moved, seconded by Trustee Seidman, to remove this matter from table. Motion carried unanimously. Kurt Hezner, representing Firstar Bank, discussed the proposed changes and exhibited a drawing of the project. Patrick Gattori, 840 Todd Court, appeared before the Board and stated his support of the Plan Commission's recommendation to deny parking lot lighting beyond 9:00 PM. Trustee Rosenthal moved, seconded by Trustee Heuberger, that the recommendations of the Plan Commission be approved and the Attorney directed to prepare the necessary Ordinances. Motion carried unanimously. The Village Center Development Commission considered petitioner's request and recommended approval of their plans with the parking lot lighting as recommended by the Plan Commission. Trustee Rosenthal moved, seconded by Trustee Heuberger, that the recommendation of the Village Center Development Commission be accepted. Motion carried unanimously. PARKING VARIATION The Board of Zoning Appeals recommended FIRSTAR BANK granting Firstar Bank's requested parking 745 DEERFIELD ROAD variation to permit the reduction of the specified number of parking spaces from 90 to 88 as stated in Ordinance 0- 87 -02, to accommodate parking space configuration required by the Americans with Disabilities Act and redesigned parking lot geometry. Trustee Rosenthal moved, seconded by Trustee Swanson, to accept the recommendation of the Board of Zoning Appeals and direct the Attorney to prepare the necessary Ordinance. Motion carried unanimously. AMENDMENTS TO DUI Police Chief Patrick Anderson advised PROVISIONS OF that the proposed amendments will bring MUNICIPAL CODE the DUI provisions in compliance with the State traffic statutes. This will stand as a first reading. Police Chief Anderson presented Officer Michael Scarry with a departmental do,nmendation', for his outstanding`oerformance in' ticketing DUI offenders. Motion vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None (0) 0 -93 -64 ORDINANCE Ordinance re 1993 Real Estate Tax Levy. 1993 REAL ESTATE TAX LEVY Mayor Forrest read the attached statement in which he noted that for the third consecutive year, the Village Tax Levy will be less than the preceding year. The 1993 Levy is 2.3% less than the amount levied in 1992. Trustee Seidman moved, seconded by Trustee Ehlers, that the Ordinance re 1993 Real Estate Tax Levy be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None ( 0 ) 0 -93 -65 ORDINANCE Ordinance re 1993 Debt Service Levy Tax DEBT SERVICE LEVY Abatement, 1991 Bond Issue - $351,300. TAX ABATEMENTS 0 -93 -66 ORDINANCE DEBT SERVICE LEVY TAX ABATEMENTS 0 -93 -67 ORDINANCE DEBT SERVICE LEVY TAX ABATEMENTS Ordinance re 1993 Debt Service Levy Tax Abatement, 1986 General Obligation Bond, $442,200. Ordinance re 1993 Debt Service Levy Tax Abatement, 1987 Bond Series, $843,000. -2- Trustee Seidman moved, seconded by Trustee Heuberger, that the Ordinances re 1993 Debt Service Levy Tax Abatements be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None ( 0 ) R -93 -11 RESOLUTION Mayor Forrest read the attached state - SURPLUS FUNDS /LAKE ment regarding a Resolution authorizing COOK ROAD TAX INCREMENT reallocation of almost $5.9 million in FINANCING DISTRICT surplus funds from the Lake Cook Road TIF District. The appropriate Lake County taxing districts will receive $2,328,320 of the $5.9 million. Trustee Ehlers moved, seconded by Trustee Heuberger, that the Resolution authorizing reallocation of surplus funds from the Lake Cook Road TIF District be passed. Motion carried unanimously. PRELIMINARY PLAT Petitioner is requesting extension of EXTENSION - PRD a preliminary plat for a Planned _1209 GORDON TERRACE Residential Development, 1209 Gordon Terrace. Trustee Rosenthal moved, seconded by Trustee Heuberger, that the preliminary plat for a Planned Residential Development, 1209 Gordon Terrace, be extended for one year. Motion carried unanimously. CONSTRUCTION MANAGER As a condition of the David Dwellings DAVID DWELLINGS Subdivision approval, the developer SUBDIVISION posted a letter of credit in 1991 for public improvements. To date, no work has been done. The development of a neighboring property at 1209 Gordon Terrace triggers the installation of the public improvements. The Village Attorney has advised that a construction manager can be hired by the Village to complete the required improvements with the funds obtained from the letter of credit if the developer does not act before the letter of credit expires February 2, 1994. Robert Conter, the developer, proposed hiring a construction manager and extending the letter of credit for 30 days. The Board rejected this proposal and directed Conter to appear at the January 17, 1994 Board meeting to give a progress report on the project. (as amended 1/3/94) DISCUSSION Village Manager Franz announced the retirement of Dolores Sneed as secretary for the Village Board meetings and that Jennifer Davis, a Village employee, would be her replacement.
