10/04/1993October 4, 1993 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Village Clerk in the Council Chamber of the Village Hall on Monday, October 4, 1993 at 8:00 R.M. The Clerk called the roll and announced that the following were Present: Marvin Ehlers John H. Heuberger Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Michael Swartz Absent: Bernard Forrest, Mayor and that a quorum was present and in attendance. Also present were Village Manager Robert Franz and Attorney James Stucko. Trustee Swartz moved, seconded by Trustee Ehlers, that Trustee Rosenthal be named Mayor Pro Tem. Motion carried unanimously. (as amended 10/18/93) Trustee Ehlers requested that the minutes for the September 20, 1993 meeting be amended to add the following language to the second sentence of paragraph 2 regarding the Burglar Alarm Ordinance: "or at the central (answering) station." Trustee Seidman moved, seconded by Trustee Swartz, that the minutes of the previous meeting, as amended, be approved. Motion carried unanimously. BZA RECOMMENDATION Michael Rizzo's Insurance Co. requested SIGN MODIFICATION a sign modification to permit a business 631 DEERFIELD ROAD wall sign for a use occupying a second floor in the C -1 zoning district. The Board of Zoning Appeals recommended approval of a 4' x 6' business wall sign with the following stipulations: 1.) the size and configuration of the sign remain the same, 2.) the text of the sign be limited to a single tenant only, and 3.) that any future sign face change would require a modification. 1 Trustee Seidman moved, seconded by Trustee Swanson, that the BZA recommendation be approved. Motion carried by the following vote: AYES: - Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) BZA RECOMMENDATION Mr. & Mrs. P. Demarois requested a SIDEYARD VARIATION variation to permit.construction of an 1016 SHERIDAN AVE. addition that would increase an existing non - conformity by allowing an additional 22' of proposed wall structure to be extended along the north line of the existing house, parallel to and within 3.62' of the north property line. The Board of Zoning Appeals recommended approval of the sideyard variation with the following stipulations: 1.) all other construction must meet Zoning Ordinance and Building Code requirements, 2.) the stairway be redesigned for entry from the east or west continuous without obstruction, and 3.) the fire department approves the fire /safety aspects of the stairway in the side yard. Trustee Swartz moved, seconded by Trustee Heuberger, that the BZA. recommendation be approved. Motion carried unanimously. i BZA RECOMMENDATION Mr. & Mrs. G. Rlauke requested a variation SIDEYARD VARIATION to permit ' con ' struction of a new garage to 634 ORCHARD STREET within 2' of'he side and rear property lines, occupying approximately 48% of the required rear yard. The Board of Zoning Appeals recommended approval. Trustee Seidman moved, seconded by Trustee Ehlers, that the BZA recommendation be approved. Motion carried unanimously. STAFF REPORT Chief Pat Anderson explained a new FEDERAL GRANT FOR Federal Police Hiring Supplement Program POLICE PERSONNEL which provides funds for hiring law enforcement officers. The program targets money for police departments which demonstrate a commitment to community policing. The police department is currently one officer short of authorized strength. Trustee Seidman moved, seconded by Trustee Heuberger, that the application for $75,000 over three years be submitted to the U.S. Department of Justice. Motion carried unanimously. 0 -93 -51 ORDINANCE Trustee Seidman moved, seconded by Trustee RE: BURGLAR ALARMS Swartz, that the Ordinance amending Chapter 7 of the Municipal Code re Burglar Alarms be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) 0 -93 -52 ORDINANCE Trustee Heuberger moved, seconded by RE: RIGHT TURN ONLY Trustee Ehlers, that the Ordinance amending Chapter 22 of the Municipal Code re Right Turn Only at Alley North of Cemetery be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) 0 -93 -53 ORDINANCE AMENDING ZONING ORDINANCE RE: DEVELOPMENT CODE AYES: Ehlers, H NAYS: None (0) Trustee Seidman moved, seconded by Trustee Heuberger, that the Ordinance amending the Zoning Ordinance re Development Code be adopted. Motion carried by the following vote: euberger, Rosenthal, Seidman, Swanson, Swartz (6) 0 -93 -54 ORDINANCE Trustee Swanson moved, seconded by Trustee AMENDING MUNICIPAL Seidman, that the Ordinance amending CODE RE: Chapter 20 of the Municipal Code re DEVELOPMENT CODE_ Development Code be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) 0 -93 -55 ORDINANCE Based on a written request by the SPECIAL USE - FOOD petitioner, Trustee Seidman moved, PROCESSING, BREWSTER'S seconded by Trustee Swartz, that the rules be waived to permit passage of the Special Use Ordinance for Brewster's Coffee Company on first.reading. Motion carried unanimously. -2- Trustee Swartz moved, seconded by Trustee Seidman, that the Ordinance approving a Special Use to permit food processing in the I -2B Limited Industrial District - Brewster's Coffee Company, 430 Lake Cook Road be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) EXECUTIVE SESSION Trustee Swartz moved, seconded by Trustee Swanson, that the Village Board go into executive session to discuss litigation.
