08/16/1993August 16, 1993 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, August 16, 1993 at 8:00 PM. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor Marvin Ehlers John H. Heuberger Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Absent: Michael Swartz and that a quorum was present and in attendance. Also present were Village Manager Robert Franz and Attorney James Stucko. Trustee Seidman requested the minutes of the previous meeting re Special Use Amendment Drive -Up ATM on page 2, last paragraph be amended by deleting "6 PM on weekday afternoons, 7 PM on Fridays" and replacing with "7 PM on weekdays ". Trustee Heuberger requested deleting "and exiting into the alley" from the same paragraph on page 2 and on page 1 re Annexation of Property and Annexation Agreement, "LaSalle Partners" should be replaced by "Deerfield- Saunders Joint Venture." Trustee Seidman moved, seconded by Trustee Ehlers, that the minutes of the previous meeting, as amended, be approved. Motion carried unanimously. BILLS AND PAYROLL Trustee Seidman moved, seconded by Trustee Ehlers, that the Bills and Payroll be approved. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None (0) TREASURER'S REPORT Finance Director George Valentine reviewed his report of July 31, 1993. Sales tax receipts are 40 over the previous twelve month period. Water sales are below projections and will probably continue to decline due to the wet year. Expenses are close to'budget except for water purchases. As of July 30, cash was invested at an average interest rate of 5.05 %. PROCLAMATION Mayor Forrest proclaimed the week of August 30th to be School's Open Safety Week in Deerfield. Trustee Rosenthal moved, seconded by Trustee Swanson, that the Proclamation be accepted. Motion carried unanimously. Mayor Forrest presented James Marovitz, a former Village Trustee, with a plaque honoring him for his many years of service to Deerfield. as a Village Trustee and a member of the Plan Commission. The meeting recessed for a brief reception in honor of James Marovitz. MAPLEWOOD SCHOOL -FINAL The Plan Commission found the Final Plat of PLAT OF SUBDIVISION Subdivision for Maplewood School to be in substantial conformance with the previously approved plat. Trustee Seidman moved, seconded by Trustee Heuberger, that the recommendation of the Plan Commission finding the Final Plat of Subdivision for Maplewood School to be in substantial conformance with the previously approved plat, be accepted. Motion carried unanimously. VACATING PORTION OF ALLEY - 1124 FOREST AVENUE, COLLINS Consent Agenda Ordinance vacating portion of alley - 1124 Forest Avenue, Collins, First reading. ADDITIONAL SIGN ON Ordinance amending PUD Signage Plan to permit SAUNDERS ROAD installation of additional sign on Saunders 5 PARKWAY NORTH Road - Parkway North Center, 5 Parkway North. First reading. ANNEXATION AGREEMENT Resolution amending Annexation Agreement PARKWAY NORTH Deerfield- Saunders Joint Venture, Parkway. North. PROPERTY ANNEXATION Ordinance annexing property - Deerfield PARKWAY NORTH Saunders Joint Venture, Parkway North. First reading. ZONING MAP AMENDMENT Ordinance amending the Zoning Map - Deerfield- Saunders Joint Venture, Parkway North. First reading. VACATING PORTIONS OF Ordinance vacating portions of Woodview Lane, WOODVIEW LANE Deerfield- Saunders Joint Venture, Parkway North. First reading. 0 -93 -39 ORDINANCE Ordinance amending Comprehensive Plan in COMPREHENSIVE PLAN RE reference to property at the northwest NORTHWEST CORNER LAKE corner of Lake Cook and Pfingsten Roads. COOK & PFINGSTEN ROADS Trustee Swanson commented on Barbara Houpt's memo of August 12 regarding low density housing and suggested it should be attached to PDA #10 of the amended Comprehensive Plan. Ms. Houpt stated it would be kept as part of a background file on this matter. Trustee Rosenthal moved, seconded by Trustee Ehlers, that the Ordinance amending the Comprehensive Plan in reference to property at the northwest corner of Lake Cook and Pfingsten Roads be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None ( 0 ) 0 -93 -40 ORDINANCE Trustee Rosenthal inquired of Greg Furda, SPECIAL USE -630 WAUKEGAN attorney representing First Chicago of ROAD, FIRST CHICAGO OF Deerfield, if the Bank would be removing DEERFIELD the bushes along the alley. Mr. Furda replied the Bank is considering removing the bushes and replacing it with a wrought iron fence. Trustee Rosenthal suggested the Bank leave the landscaping where it is at this time. Trustee Heuberger expressed concern about patrons using the alley to get to Osterman Avenue. Mr. Furda noted the Bank would be conducting a study of the reconfigured traffic flow for six months and would report their findings to the Board. Trustee Seidman moved, seconded by Trustee Rosenthal, that the rules be waived to permit passage of the Ordinance Amending Special Use - 630 Waukegan Road, First Chicago of Deerfield on first reading. Motion carried unanimously. Trustee Seidman moved, seconded by Trustee Heuberger, that the Ordinance Amending Special Use - 630 Waukegan Road, First Chicago of Deerfield be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None (0) 0 -93 -41 ORDINANCE Trustee Seidman moved, seconded by Trustee LEFT TURNS AT Ehlers, that the rules be waived to permit 630 WAUKEGAN ROAD passage of the Ordinance on first reading. Motion carried unanimously. Trustee Seidman moved, seconded by Trustee Ehlers, that the Ordinance amending Municipal Code re left turns at 630 Waukegan Road, First Chicago-of Deerfield be adopted. Motion carried by the following vote: -2- AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None (0) The Board also directed the Attorney to prepare an Ordinance to prohibit left turns from the alley onto Waukegan Road DRIVE -UP ATM'S IN Ordinance amending Zoning Ordinance to C -1 VILLAGE CENTER permit drive -up ATM's in the C -1 Village DISTRICT Center. First reading. RESIDENTIAL DEVELOPMENT Ordinance amending Municipal Code re IMPACT FEES Residential Development Impact Fees. First reading. Jack Hicks, Administrative Librarian, read a statement citing statistics on the present use of the library by the Village residents and projecting the amount of library use by residents of future developments. Mayor Forrest commented that the Village is discussing various levels of impact fees and is awaiting analysis of data received from the Park District, Fire District and School District prior to the second reading of the Ordinance on September 7. VACATION OF PORTION Trustee Rosenthal moved, seconded by OF ALLEY - 914 -918 Trustee Seidman, that his matter be WOODWARD AVENUE removed the table. Motion carried unanimously. Joe Walter, 918 Woodward Avenue, stated his reason for requesting vacation of the alley was his desire to build a garage further back on his property. He was aware that only 8 feet of the 16 foot alley would be available for purchase at a cost of $1 per square foot. Trustee Rosenthal moved, seconded by Trustee Ehlers, that the Attorney prepare an Ordinance vacating a portion of an alley at 914 -918 Woodward Avenue. Motion carried unanimously. TAPE LOGGING EQUIPMENT Police Chief Anderson appeared before FOR 911 AND RADIO the Board requesting authorization to purchase tape logging equipment from the Dictaphone Corporation for 911 telephone calls and radio transmission essential to the operation of police and fire dispatch at a cost of $24,467. The Board questioned the absence of bidding for this equipment and was advised that Dictaphone Corporation has the only technology for this type of equipment and is the sole purveyor for it. Trustee Rosenthal moved, seconded by Trustee Heuberger, that authorization be given to purchase Tape Logging Equipment for 911 and Radio from the Dictaphone Corporation at a cost not to exceed $24,467.00. Motion carried by the following vote. AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson (5) NAYS: None (0) LIQUOR LICENSE Mayor Forrest noted that Gold Eagle Liquors wishes to open a wine and liquor store in the former Cori Foods location on Deerfield Road and has applied for a package liquor license. Ron Cigelnik, owner.of Gold Eagle Liquors, was present and discussed the type of operation he is planning. -3- Trustee Rosenthal moved, seconded by Trustee Heuberger, that a package liquor license be authorized and the Attorney directed to prepare the necessary Ordinance. Motion carried unanimously. ADJOURNMENT There being no further business, upon motion of Trustee Rosenthal, seconded by Trustee Heuberger, the meeting adjourned at 9:35 PM.
