06/21/1993June 21, 1993 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, June. 21, 1993 at 8:00 PM. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor Marvin Ehlers John H. Heuberger Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Michael Swartz and that a quorum was present and in attendance. Also present were Village Manager Robert Franz and Attorney James Stucko. R -93 -5 RESOLUTION Mayor Forrest presented a Resolution DEERFIELD BULLS DAY naming June 22, 1993 as Deerfield Bulls Day in honor of the Chicago Bulls winning their third consecutive NBA World Championship. Trustee Rosenthal moved, seconded by Trustee Swartz, that the Resolution be passed. Motion carried unanimously. Trustee Seidman suggested the Village request use of the Bulls emblem on Deerfield's vehicle sticker. Trustee Rosenthal moved, seconded by Trustee Swartz, that the minutes of the previous meeting be approved. Motion carried unanimously. BILLS AND PAYROLL Trustee Seidman moved, seconded by Trustee Swartz, that the Bills and Payroll be approved. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) SECRETARIAL SERVICES The Plan Commission and Village Center OFFICE Development Commission recommended approval of petitioner's request for a Class A Special Use for a secretarial services office at 763 Deerfield Road. Trustee Seidman moved, seconded by Trustee Ehlers, that the recommendation of the Plan Commission and Village Center Development Commission approving a Class A Special Use for a secretarial services office at 763 Deerfield Road be accepted and the Attorney directed to prepare the necessary Ordinance. Motion carried unanimously. SPECIAL USE FOR The Plan Commission and Village Center 763 DEERFIELD ROAD BLDG. Development Commission recommended approval of petitioner's plans for a Special Use to permit the property at 763 Deerfield Road to be utilized for any of the uses listed in Article 5.01 -C,1. Trustee Ehlers moved, seconded by Trustee Swanson, that the recommendation of the Plan Commission and Village Center Development Commission approving a Special Use to permit property at 763 Deerfield Road to be utilized for any of the uses listed in Article 5.01 -C,1 be accepted. Motion failed. SUBSTANTIAL CONFORMANCE The Plan Commission found the Final Plat 1410,1418,1428 ROSEWOOD to be in substantial conformance to the AND 304 BIRCHWOOD previously approved Preliminary Plat - 1410, 1418, 1428 Rosewood and 304 Birchwood /Conway Resubdivision. . Trustee Seidman moved, seconded by Trustee Heuberger, that the recommendation of the Plan Commission finding substantial conformance to the previously approved Preliminary Plat - 1410, 1418, 1428 Rosewood and 304 Birchwood /Conway Resubdivision be accepted. Motion carried' unanimously. MANPOWER COMMISSION The Manpower Commission recommended appointment of Susan Lappin and Mary Hammer Reichard to fill vacancies on the Youth Council. Trustee Rosenthal moved, seconded by Trustee Swartz, that the appointments be approved. Motion carried unanimously. REGULATIONS- REFRIGERATED Ordinance re Regulations on Refrigerated STORAGE VEHICLES Storage Vehicles. First reading. Bob Eisenstein, Door County Fisheries, suggested the Board reconsider the Ordinance prohibiting the use of refrigerated storage vehicles for commercial use. Mr. Eisenstein stated his business cannot exist without the use of extra refrigeration. He had installed electrical outlets to use standby refrigerated trucks that are needed for only one week during the entire year. The storage vehicles use electric power and the noise is minimal, occurring 5 minutes per hour. In light of Mr. Eisenstein's information, Mayor Forrest requested the Staff to review the proposed Ordinance and present some recommendations at the next meeting. 0 -93 -33 ORDINANCE Ordinance Establishing Prevailing Wage PREVAILING WAGE RATES Rates. Trustee Rosenthal moved, seconded by Trustee Swanson, that the rules be waived to permit passage of the Ordinance on first reading. Motion carried unanimously. Trustee Rosenthal moved, seconded by Trustee Swanson, that the Ordinance Establishing Prevailing Wage Rates be adopted. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) RE -AWARD OF BID Hoskins Chevrolet was awarded the bid for 12,000 GVWR DUMP TRUCK a new Chevrolet 12,000 GVWR dump truck for a net cost of $17,081.73. The dealer is unable to deliver this vehicle in the specified color. James Soyka, Director of Public Works and Engineering, advised that the specified color was essential so that the truck would be recognizable as part of the Public Works fleet. It is the recommendation of the Director of Public Works and Engineering that the bid be re- awarded to Lake County Truck Sales at a cost not to exceed $17,508.00 with trade -in. Trustee Seidman moved, seconded by Trustee Swartz, that the bid of Hoskins Chevrolet for a 1993 12,000 GVWR dump truck be canceled and that the bid for .a 1994 Chevrolet 12,000 GVWR dump truck be re- awarded to Lake County Truck Sales at a cost not to exceed $17,508.00 with trade -in. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) RE -AWARD OF BID Hoskins Chevrolet was awarded the bid for 1 TON 4X4 PICK -UP TRUCK a one ton 4/4 pick -up truck for a net cost of $13,391.28. The dealer is unable to deliver this vehicle in the specified color. It is. the recom- mendation of the Director of Public Works and Engineering that the bid be re- awarded to Southside Ford at a cost not to exceed $14,249.00 with trade -in. -2- Trustee Rosenthal moved, seconded by Trustee Seidman, that the bid of Hoskins Chevrolet for a 1993 1 ton 4/4 pick -up truck be canceled and that the bid for a 1994 1 ton 4/4 pick -up truck be re- awarded to Southside Ford at a cost not to exceed $14,,249.00 with trade -in. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) AWARD OF BID- FOUR Director of Public Works and Engineering WHEEL TRUCK WITH recommended Hoskins Chevrolet, low bidder, FULLY ENCLOSED CAB be awarded the bid for one 1994 four wheel drive truck at a cost not to exceed $17,879.12 with trade -in. Trustee Rosenthal moved, seconded by Trustee Swanson, that Hoskins Chevrolet be awarded the bid for one 1994 four wheel drive truck at a cost not to exceed $17,879.12 with trade -in. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) R -93 -6 RESOLUTION Resolution changing the number of hours INCREASE MINIMUM required for IMRF participation from 600 to IMRF HOURS 1000 per year. Trustee Seidman moved, seconded by Trustee Swartz, that the Resolution increasing minimum IMRF hours from 600 to 1000 be adopted. Motion carried unanimously. ENGINEERING SERVICES Trustee Swanson moved, seconded by Trustee SALT STORAGE DOME Swartz, that this matter be tabled pending further study. Motion carried unanimously. DISCUSSION Bruce Boruszak, 650 Sapling Lane, discussed events of the past weekend when his 5 year old son was bitten by a stray cat. He called the Village and the Police Department for assistance in capturing the cat but learned they had no equipment to deal with this situation. He was advised by Lake County that the equipment costs $200. The cat was never captured. As a result, Mr. Boruszak's son will have to get rabies shots. Mayor Forrest directed staff to contact Lake County to find out where to get proper equipment and to make recommendations to the Board to provide some kind of service specific to cats. Trustee Seidman commented on a flooding situation caused by absence of landscaping and proper drainage on a lot at Woodruff and Greenwood where a new home has been built. The property next to the new home has been covered by water and subsequent mud after a heavy rainfall. The owner of the flooded property is seeking assurance that the builder provides proper drainage to prevent this from happening again. Barbara Houpt, Director of Community Development, advised that the Village has requirements for grading plans for subdivisions but not for single family lots. Trustee Swanson advised that the Storm Water Management Ordinance could be modified to cover drainage on single family lots. Mayor Forrest suggested withholding the occupancy permit from the new home owner until proper drainage is completed. A report from Jim Soyka and Clint Case on this matter will be forthcoming. Mayor Forrest mentioned that Village Staff has called attention to the Zoning Ordinance re Planned Unit Developments. There is no requirement or guarantee for completion of streets and utilities in private developments. It is in the best interests of the Village that the Plan Commission study this issue and conduct a Public Hearing on a possible amendment to the Zoning Ordinance to cover this type of development. Trustee Seidman moved, seconded by Trustee Swartz, that the Plan Commission study the Zoning Ordinance regarding Planned Unit Developments and hold a Public Hearing on this matter. Motion carried unanimously. -3- Mayor Forrest reported that he had no response from the School Board regarding his invitation to discuss the School Board's pending sale of Woodland and Cadwell Schools. The Mayor stated he would continue to contact the School Board to discuss this matter.
