06/07/1993June 7, 1993 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, June 7, 1993 at 8:00 PM. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor Marvin Ehlers John. H. Heuberger Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Michael Swartz and that a quorum was present and in attendance. Also present were Village Manager Robert Franz and Attorney James Stucko. Trustee Swanson requested the minutes of the previous meeting be amended. In the two paragraphs on Engineering Consultant Osterman Avenue Development, the phrase "for a lump sum of $78,000" should be changed to read "at a cost not to exceed $78,000." The sentence "Al Paja, a member of the Deerfield American Legion Post..." should read "Al Paja, Commander of the Deerfield...". In the paragraph on Sewage Lift Pump for Treatment Plant, the Crown Point, Indiana distributor should be named. Trustee Seidman moved, seconded by Trustee Ehlers, that the minutes of the previous meeting, as amended, be approved. Motion carried unanimously. REGULATIONS ON Staff reviewed the need for regulating REFRIGERATED refrigerated vehicles used by merchants STORAGE VEHICLES for occasionally storing materials in the alley behind them. Several options were discussed. The existing Nuisance Ordinance could be amended to more clearly regulate noise from commercial vehicles; the Municipal Code could be amended to require a certain distance refrigerated commercial vehicles can be parked from a residential area; pass an ordinance prohibiting use of refrigerated vehicles for commercial storage purposes. A special permit could be issued for occasions (Family Days) where this activity is necessary. Marvin Kogan, 135 Doral Court, whose back yard is behind Amlings in Cadwell Corners, related his experience with the intrusive noise caused by the vehicles. Over the past year he had contacted the police on several occasions and was advised nothing could be done. If the disturbances persist Mr. Kogen is prepared to file a Complaint for disturbing the peace. Trustee Seidman moved, seconded by Trustee Swartz, that the Attorney prepare an Ordinance prohibiting the use of refrigerated vehicles for commercial storage except for special permits for community activities. Motion carried unanimously. Trustee Seidman requested the Staff to recommend appropriate fines for violations of this Ordinance. SUBSTANTIAL CONFORMANCE Petitioners requested a finding of sub - OLD COUNTRY BUFFET stantial conformance to construct a 501 DEERFIELD MALL square foot addition to the future Old Country Buffet restaurant for restroom use only. The Plan Commission found petitioner's request to be in substantial conformance to the previously approved. final development plan and approved petitioner's plans. Trustee Seidman moved, seconded by Trustee Swartz, that the recommendation of the Plan Commission be accepted. Motion carried unanimously. Johnson Tree Experts Inc. (low bidder) at the bid price of $25,425.00. Trustee Rosenthal moved, seconded by Trustee Swartz, that a contract for 1993 Parkway Tree Trimming be awarded to Nels J. Johnson Tree Experts Inc. at a cost not to exceed $25,425.00. TREE AND STUMP REMOVAL recommended that a contract for tree and stump removal be awarded to Chris Weiler Tree Service (low bidder) in an amount not to exceed the budgeted amount of $9,000.00. Trustee Seidman moved, seconded by Trustee Swartz, that a contract for the 1993 Street Rehabilitation Program be awarded to Curran Contracting Company at a cost not to exceed $485,137.00. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) -2- AGREEMENT WITH IDOT The Chicago Area Transportation Study DEMONSTRATION PROJECT/ (CATS) Policy Committee approved a grant REVERSE COMMUTING in the amount of $164,245 for a "reverse commute study" in connection with the new Lake Cook Road Station. The project will be managed by a Task Force that includes the Village of Deerfield, the Lake Cook Transportation Management Association and the Chambers of Commerce of Northbrook and Deerfield. The Village will act as fiscal agent. Bill Baltutis, Executive Director of TMA of Lake -Cook, discussed the proposed project. He stated there are 38,000 employees who drive to work in the Lake -Cook area. Reverse commuting is an opportunity to get some of these people off the road. At completion of this study in the Fall, there is a possibility of a follow -up grant for operational funding of a shuttle bus system, as well as improvements to pedestrian access to the station. Robert Rosen, 405 Deerfield Road, inquired if any expenses were anticipated by the Village in connection with this project. He was advised that Village expenses are reimbursed by the grant. Trustee Swartz moved, seconded by Trustee Ehlers, that the Mayor be authorized to sign an agreement between Deerfield and IDOT re Grant for Demonstration Project - Reverse Commuting at Lake Cook Road Train Station. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None ( 0 ) CONSULTANT SERVICES TMA of Lake -Cook, acting as spokesperson REVERSE COMMUTING STUDY for the Lake -Cook Deerfield Metra Station Task Force, recommended the selection of the consulting firm, Barton Aschman, to conduct study activities involving pedestrian and shuttle bus access to the planned Metra station. Trustee Seidman moved, seconded by Trustee Ehlers, that authorization be given to award a contract for consultant services re Reverse Commuting Study to Barton Aschman at a cost not to exceed $75,000.00. Motion carried by the following vote: AYES: Ehlers, Heuberger, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None ( 0 ) DISCUSSION Robert Rosen, 405 Deerfield, spoke of the irregular condition and poorly maintained sidewalk on Deerfield Road, west of Kipling. In addition, a safety hazard exists due to the proximity of the sidewalk to fast moving traffic on Deerfield Road. Mr. Rosen requested the Village to give this matter prompt consideration. Mayor Forrest advised the Staff to review this situation. Mayor Forrest commented it had come to the Board's attention that the School Board is contemplating selling one or two pieces of property. The Mayor sent a letter to the President of the School Board on Monday urging them to begin discussions with the Village Staff and Park District so they can work together on some of the problems. He noted the Village Board welcomes the School Board's input to the Plan Commission with regard to the Sara Lee and Trammell Crow properties. Trustee Rosenthal gave a brief report on the Plaza events last week. Thursday's concert (in 32 degree weather) had 20 to 25 attendees. Saturday's event had 55 to 65 participants. The response was positive and encouraging. Several food purveyors expressed interest in participating in future events. . Trustee Rosenthal suggested the Village continue publicizing Plaza activities. Trustee Swartz mentioned that Courtyard by Marriott is interested in having cable installed.
