02/01/1993February 1, 1993 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, February 1, 1993 at 8:00 P.M. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor Marvin Ehlers James L. Marovitz Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson Michael Swartz and that a quorum was present and in attendance. Also present was Village Manager Robert Franz and Village Attorney James Stucko. Trustee Seidman moved, seconded by Trustee Ehlers, that the minutes of the previous meeting be approved. Motion carried unanimously. PROCLAMATION Mayor Forrest proclaimed Sunday, February 14, 1993 to be Caring for Others Day in Deerfield. Trustee Rosenthal moved, seconded by Trustee Swartz, that the Proclamation be accepted. Motion carried unanimously. Cathy Curtis, president of the Caring for Other committee, and Art Seymour talent coordinator for the Care- a -Thon were present to discuss the telethon scheduled for February 7. POLICE DEPARTMENT Police Chief Brandt appeared before the OBJECTIVES Board to respond to any inquiries regarding the written report he had submitted. He noted there was a decrease in crime and traffic accidents during 1992• SIDE AND REAR YARD Petitioner requested a detached accessory VARIATIONS /1135 NORTH structure setback variation which would AVENUE, BLEVINS permit the continued use of a detached accessory structure (shed) within 1.25 feet of a side property line (in lieu of the required 5 foot minimum setback) and within 1 foot of the rear property line (in lieu of the 5 foot minimum setback). The Board of Zoning Appeals recommended granting the variations. Trustee Seidman moved, seconded by Trustee Marovitz, that the recommendation of the Board of Zoning Appeals to grant a side and rear yard variation at 1135 North Avenue, Blevins, be accepted and the Attorney directed to prepare the necessary ordinance. Motion carried unanimously. AMENDMENTS TO I -2 The Plan Commission held a series of PROVISIONS OF ZONING public hearings the past year on the I -2 ORDINANCE provisions of the Zoning Ordinance. The Plan Commission recommended dividing currently zoned I -2 properties into two different districts, the I -2A Village Center Limited Industrial District and the I -2B Outlying Limited Industrial District. Text amendments for the two districts and Article 8.02 -E,4,3 pertaining to data processing and telecommunications facility parking were proposed. Village Attorney James Stucko advised that a hearing for a specific map amendment which incorporates the division between I -2A and I -2B be held. He recommended adoption of the new text amendments and adoption of the map amendment which corresponds to the text be done at the same time. Preparation of the ordinance should be resubmitted to the Board at the time the hearing on the map amendment is completed. Trustee Rosenthal moved, seconded by Trustee Seidman, that the report of the Plan Commission on amendments to I -2 provisions of the Zoning Ordinance, as amended, be accepted and the Plan Commission directed to hold a public hearing on a map amendment. Motion carried unanimously. NON- CONFORMING LOTS Village Attorney James Stucko reviewed his letter to the Board regarding non - conforming lots. He advised there were two courses of action - maintain the ordinance as it exists or ask the Plan Commission to consider whether a sensible text amendment can be developed. Tom Conway, 1428 Rosewood, requested the Board to consider'his non - conforming lot a lot of record by reason of its existence since 1924. Mr. Conway was advised that the Board could not do anything under the present ordinance to solve his problem. Trustee Marovitz moved, seconded by Trustee Swanson, that the matter of non - conforming lots be referred to the Plan Commission. Motion carried. DIGESTER GAS USE James Soyka, Director of Public Works and FEASIBILITY STUDY Engineering, discussed the Digester Gas determine if gas in lieu improvements recommended this time to Use Study. The study was authorized to annual cost savings would be possible using digester of natural gas. The consultant determined that these would be marginally cost effective. Mr. Soyka accepting the report and no further work be done at utilize digester gas. Trustee Ehlers moved, seconded by Trustee Rosenthal, to accept the Digester Gas Use Feasibility report. Motion carried unanimously. MANPOWER COMMISSION The following appointments were made by by the Manpower Commission: Board of Building Appeals - Les Kodner; Safety Council - Thomas Elliott; Youth Council - Michelle Achey, Dan Shapiro and Patricia Borner as Chairman. Trustee Seidman moved, seconded by Trustee Swartz, that the appointments be approved. Motion carried unanimously. Consent Agenda 0 -93 -4 ORDINANCE Ordinance granting sideyard variation for SIDEYARD VARIATION 114 Pine Street, Davey. 114 PINE STREET, DAVEY 0 -93 -5 ORDINANCE Ordinance increasing number of Class E INCREASING NUMBER OF liquor licenses from eight to nine. CLASS E LIQUOR LICENSES 0 -93 -6 ORDINANCE Ordinance decreasing number of Class DECREASING NUMBER OF A liquor licenses from five to four. CLASS A LIQUOR LICENSES Trustee Seidman moved, seconded by Trustee Swartz, that the rules be waived to permit passage of Ordinance 0 -93 -6 on first reading. Motion carried unanimously. Trustee Seidman moved, seconded by Trustee Swartz, that the Consent Agenda be accepted and the Ordinances adopted. Motion carried by the following vote: AYES: Ehlers, Marovitz, Rosenthal, Seidman, Swanson, Swartz (6) NAYS: None (0) -2- �i 1 IDOT 1991 AUDIT Trustee Seidman moved, seconded by Trustee Marovitz, that authorization be given to accept and place on file IDOT's 1991 Audit.
