01/04/1993January 4, 1993 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, January 4, 1993 at 8:00 P.M. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor James Marovitz Harriet Rosenthal Edwin Seidman Vernon Swanson Michael Swartz Absent: Marvin Ehlers and that a quorum was present and in attendance. Also present was Village Manager Robert Franz and Village Attorney James Stucko. Trustee Rosenthal requested the minutes of the previous meeting under Discussion be amended by replacing the word "Deerbrook" with "Deerfield" in the sentence mentioning "Deerbrook Fire District." Trustee Seidman moved, seconded by Trustee Marovitz, that the minutes of the previous meeting, as amended, be approved. Motion carried unanimously. SIDEYARD VARIATION Petitioners requested a variation to 114 PINE STREET, DAVEY permit the construction of a garage addition to within 5 feet of the side property line in lieu of the required 8 feet. The Board of Zoning Appeals recommended the variation be granted. Trustee Seidman moved, seconded by Trustee Marovitz, that the recommendation of the Board of Zoning Appeals regarding the request for a sideyard variation, 114 Pine Street, Davey be accepted and the Attorney directed to prepare the necessary Ordinance. Motion carried unanimously. SPECIAL USE /PRD RESUB- Plan Commission denied petitioner's DIVISION, 312 -320 request for a text amendment to the Zoning BIRCHWOOD, BATIO Ordinance and the Subdivision Code to permit flag lots in certain situations. Petitioner's request for a Special Use /Planned Residential Development resubdivision was also denied. The Plan Commission did recommend approval of petitioner's plan for the alternate Special Use /Planned Residential Development resubdivision for two 60'x300'wide lots. Trustee Seidman moved, seconded by Trustee Swartz, that the Plan Commission recommendation for approval of two 60'x300' lots at 312 -320 Birchwood, Batio be approved. Motion carried unanimously. Gilbert Batio, petitioner, discussed the proposed resubdivision. Tom Conway, 1428 Rosewood, stated he was concerned about the potential loss of large trees at the back half of his lot next to the resubdivision through use of heavy building equipment. Mr. Batio gave his assurance that the trees would be protected. RESUBDIVISION /SPECIAL Trustee Seidman moved, seconded by Trustee USE PRD BEHIND 216 Rosenthal, that the request for resubdi- KENMORE, KRUGER vision and Special Use PRD, and Text Amendments to the Zoning Ordinance and. Subdivision Code for property behind 216 Kenmore, Kruger, be *tabled since the petitioner could not be present. Motion carried unanimously. DEERBROOK /BOSTON Petitioners requested a finding of sub - CHICKEN RESTAURANT stantial conformance to be able to establish a Boston Chicken Restaurant in the Deerbrook Mall consistent with the food court concept approved by the Village in 1986. The Plan Commission found petitioners' request to be in substantial conformance to the previously approved Final Development Plan and recommended approval. Trustee Marovitz moved, seconded by Trustee Rosenthal, that the recommendation of the Plan Commission be accepted. Motion carried unanimously. 0 -93 -1 ORDINANCE Ordinance extending Franchise Agreement COMMONWEALTH EDISON with Commonwealth Edison. FRANCHISE AGREEMENT EXTENSION Trustee Rosenthal moved, seconded by Trustee Swartz, that the Ordinance extending the Franchise Agreement with Commonwealth Edison be adopted. Motion carried by the following vote: AYES: Rosenthal, Seidman, Swanson, Swartz (4) NAYS: None (0) Trustee Marovitz did not participate in the discussion nor vote. (as amended 1/18/93) Don Kowalewski, District Superintendent of Commonwealth Edison, was present and responded to Trustee Swanson's inquiries about recent outages in Deerfield. Mr. Kowalewski discussed the tree trimming program Commonwealth Edison has developed to prevent outages caused by high winds and trees. 0 -93 -2 ORDINANCE Trustee Seidman moved, seconded by Trustee STATE REVISIONS FOR Swartz, that the Ordinance re State CERTAIN PARKING revisions for certain parking.violations VIOLATIONS be adopted. Motion carried by the following vote: AYES: Marovitz, Rosenthal, Seidman, Swanson, Swartz (5) NAYS: None (0) R -93 -1 RESOLUTION PERMITS FOR WORK W STATE RIGHT -OF -WAY Marovitz, that the State right -of -way IDOT Resolution re permits for work IT.HIN within State Right -of -Way. Trustee Seidman moved, seconded by Trustee IDOT Resolution re permits for work within be passed. Motion carried unanimously. DISCUSSION Mayor Forrest noted that Ed Debevic's Restaurant has been sold. Their liquor license expired at the end of the year. The new owners have submitted an application for a liquor license. Village Manager Franz advised that certain parts of executive session minutes of the Board of Trustees in 1992 can be made public. He listed executive sessions dated January 20, April 6, May 18, September 8 and October 19 will be made available to the public. Trustee Marovitz moved, seconded by Trustee Seidman, that the minutes of the Board of Trustees executive sessions in 1992 held January 20, April 6, May 189 September 8 and October 19 be made available to the public.
