06/15/1992June 15, 1992 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Clerk in the Council Chamber of the Village Hall on Monday, June 15, 1992 at 8:00 P.M. The Clerk called the roll and announced that the following were Present: Marvin Ehlers Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson and that a quorum was present and in attendance. Also present was Asst. Village Manager Kent Street and Village Attorney James Stucko. Trustee Swanson moved, seconded by Trustee Ehlers, that Trustee Rosenthal be named Mayor Pro Tem. Motion carried unanimously. Asst. Village Manager Kent Street noted that the minutes of the previous meeting regarding the Wilmot Road oak trees erroneously listed the change order request to be in the general contract with Peter Baker & Son. It should have been Eric Bolander. A typo was noted by Trustee Rosenthal in the previous minutes regarding Zengeler Cleaners. The word "overhand" should have been "overhang." Trustee Seidman moved, seconded by Trustee Ehlers, that the minutes of the previous meeting, as amended, be approved. Motion carried unanimously. BILLS AND PAYROLL Trustee' Ehlers, approved. Motion carried by the Seidman moved, seconded by Trustee that the Bills and Payroll be following vote: AYES: Ehlers, Rosenthal, Seidman, Swanson (4) NAYS: None (0) SPECIAL USE - FASHION Petitioners requested a Class B Special FLOORS & ACCENT KITCHEN Use so as to permit a Multiple Use AND BATH Development at 817 Deerfield Road (Fashion Floors and Accent Kitchens and Bath, Inc.). The Plan Commission and the Village Center Development Commission recommended approval of petitioners' request. Charles Trefz, representing Accent Kitchens and Bath, remarked petitioners were unaware that multiple use of the building required Village approval. They are now requesting that approval. Trustee Seidman moved, seconded by Trustee Ehlers, that the recommendations of the Plan Commission and Village Center Development Commission for a Class B Special Use at 817 Deerfield Road be accepted and the Attorney directed to prepare the necessary ordinance. Motion carried unanimously. AMENDMENT TO SPECIAL USE /CARSON'S RIBS, 200 WAUK'EGAN ROAD Petitioner requested permission to add a freezer - cooler area west of the building and add an unheated storage shed. The Plan Commission recommended approval of petitioner's plan. Trustee Ehlers moved, seconded by Trustee Seidman, that the recommendation of the Plan Commission regarding amendment to Special Use, Carson's Ribs, be accepted and the Attorney directed to prepare the necessary ordinance. Motion carried unanimously. SUBSTANTIAL CONFORMANCE The Plan Commission found petitioner's FULL SLAB RIBS, 380 request to install a satellite dish on the LAKE COOK ROAD roof of their building at 380 Lake Cook i J Road to be in substantial conformance.-to the previously approved Final Development Plan. Angelo Cardaras, petitioner, was present at the meeting to respond to inquiries from the Board. Trustee Ehlers moved, seconded by Trustee Seidman, that the recommendation of the Plan Commission finding petitioner's request to be in substantial conformance to the previously approved Final Development Plan be accepted. Motion carried unanimously. Consent Agenda 0 -92 -28 ORDINANCE Trustee Seidman moved, seconded by Trustee PREVAILING WAGE RATES Ehlers, that the rules be waived to permit passage of the Ordinance on first reading. Motion carried unanimously. Trustee Seidman moved, seconded by Trustee Ehlers, that the Ordinance establishing prevailing wage rates be adopted. First reading. SPECIAL USE /DRIVE -UP Ordinance authorizing a Special Use tc SERVICE WINDOW permit drive -up service window at ZENGELER CLEANERS Zengeler Cleaners, 1452 Waukegan Road. First reading. Trustee Rosenthal requested that the words "Do Not Honk" appearing in Section Two of the Ordinance be deleted and replaced with "Do Not Sound Horn." 0 -92 -29 ORDINANCE Trustee Seidman moved, seconded by Trustee SIDEYARD VARIATION Swanson, that the rules be waived to STENCEL /1019 GREENWOOD permit passage of the Ordinance on first reading. Motion carried unanimously. Trustee Seidman moved, seconded by.Trustee Swanson, that the Ordinance granting a sideyard variation - Stencel, 1019 Greenwood, be adopted. Motion carried by the following vote: AYES: Ehlers, Rosenthal, Seidman, Swanson (4) NAYS: None (0) ACQUISITION OF PROPERTY THROUGH CONDEMNATION - COUNTRY LANE AWARD OF BID PARKWAY TREE TRIMMING Tree Experts. Ordinance authorizing the acquisition of property through condemnation or otherwise for the widening of Country Lane. First reading. Superintendent of Public Works recommended that the bid for 1992 tree trimming be awarded to the low bidder, Nels Johnson Trustee Seidman moved, seconded by Trustee Swanson, that a contract be awarded to Nels Johnson Tree Experts for parkway tree trimming in an amount not to exceed $19,420.00. Motion carried by the following vote: AYES: Ehlers, Rosenthal, Seidman, Swanson (4) NAYS: None (0) -2- AWARD OF BID Superintendent of Public Works recommended TREE & STUMP REMOVAL that the bid for tree and stump removal be awarded to the low bidder, Superior Tree Service. (as amended 7/6/92) REPLACEMENT SQUAD CAR A severely damaged squad car will have to be replaced. A replacement cost of $14,800 has been quoted. An insurance settlement of $12,500 is anticipated. Trustee Seidman moved, seconded by Trustee Ehlers, that author- ization be given to purchase a squad car in an amount not to exceed $14,800.00. Motion carried by the following vote: AYES: Ehlers, Rosenthal, Seidman, Swanson (4) NAYS: None (0) DISCUSSION Trustee Seidman commented on temporary facilities and parking being considered for the proposed Lake Cook Road train station. Asst. Village Manager Kent Street noted that the proposed plan has not been reviewed by the Village. Village Engineer James Soyka discussed the status of the projects on Wilmot Road and Access Avenue and reported they were all proceeding on schedule. Trustee Rosenthal mentioned an article that appeared in last week's Deerfield Review regarding efforts by major corporations to seek reductions in their property assessments. The attached statement by Trustee Rosenthal expressed Deerfield's interest and involvement in such matters. ADJOURNMENT There being no further business, upon motion of Trustee Ehlers, seconded by Trustee Seidman, the meeting adjourned-at 8:35 P.M. ATTEST: illage Clerk APPROVED j Mayor -3- Statement on Property Reassessments June 15, 1992 Village Board Meeting Last week's Deerfield Review included an article regarding efforts by major corporations to seek reductions in their property assessments. While this is their right under the law, the Village, as one of several local governments impacted, wishes to emphasize its interest and involvement in such matters. Working with other taxing agencies, we do all within our power to assure that reductions in assessments are warranted and, in fact, justified. Together, we have retained appraisers in order to provide tax appeal boards with objective data for deciding these appeals. The Village will continue to monitor these procedures very closely. Property owners, and particularly single - family residential taxpayers,, will be represented in assuring fair and equitable assessments, particularly on income producing properties. 1
