02/18/1991February 18, 1991 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, February 18, 1991 at 8:00 P.M. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor Marvin Ehlers James L. Marovitz Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson J. Robert York and that a quorum was present and in attendance. Also present was Village Manager Robert Franz and Attorney Herb Linn. Trustee Seidman moved, seconded by Trustee Rosenthal, that the minutes of the previous meeting be approved. Motion carried unanimously. BILLS AND PAYROLL Trustee Seidman moved, seconded by Trustee Rosenthal, that the Bills and Payroll be approved. Motion carried by the following vote: AYES: Ehlers, Marovitz, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) TREASURER'S REPORT Finance Director George Valentine reported that sales tax receipts for October 1990 are almost even with September 1989. The current 12 month average for sales tax receipts is 2% over the prior 12 month period. Other Revenues continued to meet or exceed projections and expenditures responded as in the past. As of January 31, 19910 98.5% of cash was invested at an average interest rate of 7.47 %. PROCLAMATION Mayor Forrest read a Proclamation naming the month of March, 1991 to be Youth Art Month in the Village of Deerfield. Trustee Rosenthal moved, seconded by Trustee Swanson, that the Proclamation be accepted. Motion carried unanimously. DEERFIELD CEMETERY John K. Willman of the Deerfield Cemetery COMMISSION /GRAVE SITES Commission discussed the Commission's report and recommendations regarding the Deerfield Cemetery. Helke Landscaping was recommended to be retained for mowing the cemetery grounds, including weed control, fertilizing and rolling. A request to relocate a grave was denied. The Deerfield Cemetery Trustees recommended that present rules and regulations for the cemetery be amended to include rules regarding minimum plot sizes. Trustee Rosenthal moved, seconded by Trustee York, that the recommendation of the Deerfield Cemetery Commission be accepted. Motion carried unanimously. FINAL PLAT OF RESUBDI- The Plan Commission found the Final Plat VISION /1545 GREENWOOD, of Resubdivision to be in substantial EMALFARB conformance to the originally approved plat. Trustee Marovitz moved, seconded by Trustee Rosenthal, that the recommendation of the Plan Commission finding the Final Plat of Resubdivision, 1545 Greenwood, (Emalfarb) to be in substantial' conformance to the originally approved plat be accepted. Motion carried with Trustee Seidman casting a negative vote. RESUBDIVISION /SPECIAL The Plan Commission recommended approval USE PRD - 255 KENMORE of the Special Use PRD Resubdivision, (DEAL) 255 Kenmore, (Deal). John Bure, attorney representing petitioner, assured the Board that petitioner would do all that was necessary to prevent the swimming pool on the subject property from becoming a safety hazard. Trustee Seidman moved, recommendation of the Use PRD Resubdivision, carried unanimously. FINAL PLAT OF RESUBDI- VISION/ FOUNTAINS OF DEERFIELD - FLODSTROM seconded by Trustee Ehlers, that the Plan Commission re approval of the Special 255 Kenmore, (Deal) be accepted. Motion The Plan Commission found the Final Plat of Resubdivision to be in substantial con- formance to the previously approved plat. Trustee Seidman moved, seconded by Trustee York, that the recommendation of the Plan Commission finding the Final Plat of Resubdivision - Fountains of Deerfield/ Flodstrom to be in substantial conformance to the previously approved plat be accepted. Motion carried unanimously. SIDEYARD VARIATION - Ordinance re sideyard variation - Stephen STEPHEN YUCKNUT, Yucknut, 651 Byron Court. First reading. 651 BYRON COURT It was FINAL PLAT OF RESUB- Ordinance approving Final Plat of Resubdi- DIVISION- WILLLOW AND vision, southwest corner of Willow and COUNTRY LANE - SANTI/ Country Lane - Santi- DeLeonardis. First DeLEONARDIS reading. TEENAGE RISKY DRIVING Ordinance re Teenage Risky Driving PROGRAM Program. First reading. R -91 -4 RESOLUTION Trustee Marovitz moved, seconded by APPOINTMENT TO Trustee Ehlers, that a resolution appoint - SOLID WASTE AGENCY ing Trustee Edwin B. Seidman as a Director and the Village Manager as Alternate Director to the Board of Directors of the Solid Waste Agency of Lake County, Illinois, be passed. Motion carried unanimously. DISCUSSION A discussion was held regarding Bannockburn's decision to completely close traffic on certain streets which directly impacts traffic on several Deerfield streets. Questions were raised if this was legally permissible.. Village Manager Franz advised that legal opinions state that you cannot designate or allow certain people through and prohibit others from using a roadway. The Village Staff was requested to consider alternatives to resolve this situation and report to the Board at the next meeting. Trustee Seidman noted that the Village residents should be con- gratulated for achieving 96% participation in recycling for the second month in a row. _ (as amended 3/4/91) The subject of the Village joining the Friends of Chicago River was raised. It was determined that it would be a slow going project that needed no immediate action at this time.
