05/02/1988)0 May 2, 1988 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Clerk in the Council Chamber of the Village Hall on Monday, May 2, 1988 at 8:OC P.M. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor James L. Marovitz Cynthia J. Marty Harriet. E. Rosenthal Edwin B. Seidman Vernon E. Swanson J. Robert York and that a quorum was present and in attendance. Also present was Village Manager Robert Franz and Village Attorney James Stucko. Trustee Seidman moved, seconded by Trustee Marty, that the minutes of the previous meeting be approved. Motion carried unanimously. PROCLAMATION Trustee Marty moved, seconded by Trustee Rosenthal, that a Proclamation designating May 21, 1988 as Clean -Up /Fix -Up Day in Deerfield be accepted. Motion carried unanimously. SPECIAL USE - DEERSPRING POOL PARK playground areas. The Park District wishes to make certain changes within the Deerspring Pool Park which include wheel stops, pedestrian paths and Trustee Seidman moved, seconded by Trustee Marovitz, that the recommendation of the Plan Commission regarding amendment of a Special Use - Deerspring Pool Park be approved and the Attorney directed to prepare the necessary ordinance. Motion carried unanimously. AMENDMENT - SPECIAL USE DEERFIELD COMMONS Mark Kahan, president of Banbury Development, owners of the Commons Shopping Center, gave a brief background report on the project. Gary Cawn, arzhitect for the developer, displayed the site plan and reviewed the proposed renovation. He advised that the parking spaces in the main lot will be reconfigured to 253 spaces. The westerly lots will be primarily for employee use. The parking lot will be seal- coated. after the bad sections are replaced.. New landscaped parking islands. proper drainage'-and new lights will be installed". Mr. Cawn described the facade design and signage with colors and materials in conformity with the Streetscape design. No changes to the present entry signs are contemplated at this time. A variation to include two Deerfield Commons signs oti the facade was requested. There was discussion of the 10 foot sidewalk on the north side of the Merrill.'Lynch office. The developers indicated there was some existing legal prohibition for granting an easement for the sidewalk. Trustee Marovitz questioned whether there was an absolute prohibition that could not be renegotiated. Mark Tarnow, a member of the Appearance Review Commission, stated it would be premature to pass approval on this project with the outstanding items that are still unresolved. Trustee Marty moved, seconded by Trustee Rosenthal, that the recom- mendations of the Plan Commission, Village Center Development Commission and the Appearance Review Commission regarding the renovation of the Deerfield Commons Shopping Center be accepted including authorization for 2 extra.signs on the facade, contribution of $15,000 to Streetscape, a 5 foot easement by Belden's, a 10 foot easement for the area north of Merrill Lynch and the Attorney directed to prepare the necessary ordinance amending the Special Use. 1 1 1 1 1 s.: fr /yo Trustee Marovitz moved, seconded by Trustee Seidman, that the above motion be amended to provide for some revision to the entry signs and drawings be furnished of proposed-revision. Motion carried unanimously. Trustee Seidman moved, seconded by Trustee Marty, that the Ordinance vacating a 1200_square feet parcel (alley) - 905 Forest, Ryan be adopted. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) BOARDWALK DEVELOPMENT Trustee Swanson moved, seconded by Trustee Marovitz, to remove from table the Boardwalk petition for development of property south of the Regency. Motion carried unanimously. e Kalman L;.eberman, attorney for petitioner, distributed copies of the revised.site and landscape plans. The plan now has 16 lots instead of 18 and meets R -3 requirements except for private street and length of cul de sac. The landscape architect reviewed the landscaping that will incorporate some of the existing trees and creation of'a park like setting in the center of the subdivision. Petitioner's engineer exhibited a sketch of the storm sewer layout that will cover the entire perimeter of the subdivision. The-developer has agreed to pay for half of the storm sewer repairs up to $125,000. Several residents came before the Board and commented on the development. Trustee Marty moved, seconded by Trustee Seidman, that the preliminary plan of the Boardwalk Development be approved, subject to the $125,000 contribution to the sanitary sewer improvement. Motion carried unanimously. The developer asked for a possible change in an ordinance to allow them to subdivide the lots. Trustee Marovitz moved, seconded by Trustee Marty, that this request be presented to the Plan Commission for a hearing. Motion carried unanimously. -2- 0 -88 -27 ORDINANCE Present collection rate of parking tickets is CIVIL SUITS FOR 90 %. Police Department requests an amendment UNPAID PARKING TICKETS to the Municipal Code that would allow civil actions to be filed in the Small Claims Court against parties with unpaid parking tickets. Trustee Marty moved, seconded by Trustee Seidman, that rules be waived to permit passage of the ordinance re civil suits for unpaid parking tickets on first reading. Trustee Marty moved, seconded by Trustee Seidman, that the Ordinance amending Chapter 22 of the Municipal Code re civil suits for unpaid parking tickets be adopted. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) 50/50 PARKWAY TREES Trustee Seidman moved, seconded by Trustee Marty, that Arthur Weiler, 1280 Wincanton, Deerfield, Illinois be awarded the contract on his posted prices for the 50/50 Parkway Trees program. The Board agreed that further information was necessary before a decision would be made. Trustee Seidman moved, seconded by Trustee Swanson, that the award of a contract for maintenance services at the police building be tabled. Motion carried unanimously. R -88 -7 RESOLUTION Trustee Seidman moved, seconded by Trustee LOSS PREVENTION POLICY Marty that the Village adopt the Resolution STATEMENT - MICA regarding the Loss Prevention Policy Statement requested by MICA. Motion carried unanimously. -3 1 1 1 AWARD OF BID - 1988 Trustee Marty moved, seconded by Trustee STREET REHABILITATION Marovitz, that a contract be awarded to Peter Baker and -Son for the 1988 Street Rehabilita- tion project in an amount.not to exceed $488,717. Motion carried by the following voter. AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) The Board directed that, because the bid was below the amount'budgeted, the contractor should be asked to extend the unit price so that addi- tional streets might be included. CLASS E LIQUOR LICENSES Trustee Marty moved, seconded by Trustee Rosenthal, that the ordinance re liquor licenses be amended to increase Class E licenses by one. Motion carried unanimously. DISCUSSION: Trustee Seidman inquired if there were statutory requirements regarding fire lane and handicap parking signs. Police Chief Brandt responded that fire lane signs are not mandatory but handicap signs are. Recent problems with fire lanes at hotels and restaurants has prompted the Police Department to seek some type of.agreement with these establishments to correct :.his problem. Police Chief Brandt was - requested to bring some-recommenda- tions regarding fire lane and handicap parking signs to the next. meeting. Trustee York referred to the 10 foot sidewalk easement discussed during the Deerfield Commons renovation matter and suggested the Village staff investigate the area north of the Frost building and make a sketch of how this sidewalk can be made. Trustee Rosenthal commented on the interconnect road between Lake Cook Plaza and Deerbrook where two parking spaces were to be eliminated to improve traffic safety in that area. To date, a no parking sign has not been posted. A hazardous situation still exists.
