R-06-05VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS RESOLUTION NO. R -06 -05 A RESOLUTION AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT FOR PARTICIPATION IN THE LAKE COUNTY MAJOR CRIMES TASK FORCE WHEREAS, the Lake County Sheriff, the Illinois State Police, the Lake County State's Attorney and participating municipal police departments in Lake County have authorized an Intergovernmental Agreement establishing the Lake County Major Crimes Task Force, a copy of which is attached hereto and made a part hereof as Exhibit A, to provide comprehensive investigation of certain exceptionally heinous criminal offenses when requested to do so by the Chief of Police of a Member Department that has signed the Intergovernmental Agreement; and, WHEREAS, the Chief of Police of the Deerfield Police Department has recommended that the Deerfield Police Department should participate as a Member Department in the Lake County Major Crimes Task Force; and, 0 WHEREAS, the Board of Trustees of the Village of Deerfield have determined that public health, safety and welfare will be served by participating as a Member Department in the Lake County Major Crimes Task Force; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the Intergovernmental Agreement attached hereto as Exhibit A authorizing participation in the Lake County Major Crimes Task Force is hereby approved. SECTION 2: That the Chief of Police of the Deerfield Police Department be and he is hereby authorized and directed to execute and attest said Intergovernmental Agreement for and on behalf of the Village of Deerfield. SECTION 3: That this Resolution shall be in full force and effect from and after its passage and approval as provided by law. PASSED this 5th day of Jh1Y )2006. AYES: Benton, Feldman, Rosenthal, Seiden, Struthers, Wylie (6) NAYS: None (0) ABSENT: None (0) ABSTAIN:None (0) APPROVED this 5th d ATTEST: Village Clerk -2- MAJOR CRIMES TASK FORCE LAKE COUNTY, ILLINOIS INTERGOVERNMENTAL AGREEMENT It is hereby agreed by undersigned Member Departments of the Lake County Major Crimes Task Force, (hereinafter called "Member Departments ") including the Lake County Sheriff's Office, the Illinois State Police, the Lake County State's Attorney, and the participating municipal police departments of Lake County, as follows: The Lake County Major Crimes Task Force (Task Force) shall consist of the Lake County Sheriff's Office, the Illinois State Police, the Lake County State's Attorney's Office, and the other Member Departments who have signed this Intergovernmental Agreement. 2. The purpose of the Lake County Major Crimes Task Force is to provide comprehensive investigations to Member Departments of the Task Force of major murder cases, police- involved shootings, non - parental kidnappings, in- custody deaths, and other exceptionally heinous offenses when requested to do so by the chief of police of Member Departments 3. The Task Force agrees to provide comprehensive investigative services to Member Departments in accepted cases upon request of the chief of police of the police department of the local jurisdiction wherein the crime occurred. The Member Departments agree that the Chief of Police shall contact the Task Force Commander at the onset of the investigation of the above - listed offenses. The Task Force Commander shall determine if the case shall be accepted for investigation by the Task Force. 4. The Lake County Sheriff's Office and the Illinois State Police agree to provide support services to the Task Force. 5. The Member Departments agree that the investigation of crimes within the Member Department's jurisdiction that have been accepted by the Task Force Commander shall be conducted according to the procedures of the Lake County Major Crimes Task Force. 6. The Member Departments agree to pay for costs of investigations of crimes occurring within the Member Departments jurisdiction incurred by members of the Task Force when the Chief of Police of the Member Department has requested that investigation. These costs shall be subject to the following limitations: a) Operational Expenses (personnel services, vehicles, and equipment) during an activation will be borne by each Member Department relative to its personnel as Task Force team members. b) Any extraordinary expenses incurred during the course of an investigation will be borne by the originating agency which requested the Task Force activation. 7. It is the intent of the Board of Directors that each Member Department shall be represented on the Lake County Major Crimes Task Force. Each Member Department shall submit the names of at least two qualified persons to the Task Force Commander for consideration as a Task Force team member. The selection of officers who shall be investigators (the term "investigators" includes "evidence technicians ") for the Task Force shall be determined by the Task Force Commander. The Member Departments agree that they shall make those selected team members available for investigations and training as determined by the Task Force Commander. If a Member Department has circumstances which would render it incapable of contributing a. person to the Task Force, that Member Department may petition the Board of Directors for permission to tender a yearly financial contribution in lieu of that person. If such permission is granted, that yearly financial contribution shall be in addition to the annual dues prescribed by the Board of Directors. 8. It is agreed that each officer participating as a member of the Task Force shall be bound by the policies and procedures of his or her own Member Department in addition to any policies and procedures of the Task Force. 9. Each Member Department agrees to assume liability for its respective personnel assigned to the Task Force, as well as for vehicles and equipment assigned to the Task Force. 10. It is agreed between the Member Departments of the Task Force that the Task Force shall be governed by a nine - person Board of Directors. The Board of Directors shall include one person named by the Lake County Sheriff, one person named by the Lake County State's Attorney, one person named by the Director of the Illinois State Police, and six persons to be elected by the chiefs of police of the Member Departments of the Task Force. The powers, duties, and responsibilities of that Board of-Directors shall be determined by a vote of the Member Departments. The Board of Directors may determine further by -laws for governing the Task Force, which shall not be inconsistent with this agreement. 11. This agreement shall be in full force and effect between all undersigned Member Departments once signed by each department. A Member Department may withdraw from this agreement at any time by written request by the chief of police of the Member Department to the Task Force Commander.
