06/01/1987June 1, 1987 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Clerk in the Council Chamber of the Village Hall on Monday, June 1, 1987 at 8:00 P.M. The.Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor James L. Marovitz Cynthia J. Marty Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson J. Robert York and that a quorum was present and in attendance. Also present were Village Manager Robert Franz and Village Attorney James Stucko. Trustee Marovitz commented that the minutes of the previous meeting regarding his suggestion on removal of ash trays from the meeting room during Board meetings was in effect a motion to prohibit smoking in that room. A recollection of that discussion, however, indicated no motion was made. Trustee Seidman moved, seconded by Trustee Marty, that the minutes of the previous meeting be approved. Motion carried unanimously. CERTIFICATE OF Mr. David Hanus, petitioner, appeared before the PUBLIC CONVENIENCE - Board and discussed the services to be provided by 303 CAB ASSOCIATION the 303 Cab Association. Trustee Rosenthal moved, seconded by Trustee York, that a Certificate of Public Convenience and Necessity be issued to 303 Cab Association, Inc. Motion carried unanimously. SPECIAL USE - HEALTH Trustee Seidman moved, seconded by Trustee CLUB - ARBORLAKES/ Swanson, that Recommendation of the Plan Commis - NUTRASWEET sion regarding the request for a Special Use for a health club facility and an amendment to a Planned Unit Development - Nutrasweet /Arborlakes be accepted and the attorney directed to prepare the necessary ordinance. Motion carried unanimously. CONSENT AGENDA 0 -87 -24 ORDINANCE Trustee Marty moved, seconded by Trustee Seidman, PRD /RESUBDIVISION that the rules be waived for a first reading of NOBLE- 107 KENMORE the ordinance granting Special Use, PRD /Resubdivi- sion - Noble, 107 Kenmore. Motion carried unanimously. Trustee Marty moved, seconded by Trustee Rosenthal, that the ordinance granting Special Use, PRD /Resubdivision - Noble, 107 Kenmore be adopted. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) SPECIAL USE - AMOCO Trustee Rosenthal moved, seconded by Trustee LAKE - COOK /WAUKEGAN Marovitz, that the Board reconsider the Amoco petition regarding the canopy and setback requirements. Motion failed by the following vote: AYES: Marovitz, Marty, Rosenthal (3) NAYS: Forrest, Seidman, Swanson, York (4) Trustee Swanson commented that there should be no amendment to the Zoning Ordinance�.to include automobile mini -marts as a,Special Use in the C -2 district. Trustee Seidman moved, seconded by Trustee York, that the rules be waived for a first reading of an ordinance amending Zoning Ordinance to include automobile mini -marts as a Special Use in the C -2 District. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) Trustee Seidman moved, seconded by Trustee Marty, that an ordinance amending Zoning Ordinance to include automobile mini -marts as a Special Use in the C -2 District be adopted. Motion failed by the following vote vote: AYES: None (0) NAYS: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) CABLE TELEVISION - Until further notice from Post - Newsweek, this FRANCHISE AGREEMENT matter is tabled indefinitely. AMENDMENT 0 -87 -25 ORDINANCE Trustee Seidman moved, seconded by .Trustee RESCINDING ORDINANCE Marovitz, that an ordinance rescinding an: e'arlier' DISCONNECT NORTH ordinance disconnecting property -at `North Avenue. AVENUE PROPERTY and the Milwaukee Road tracks be adopted. . Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) AWARD OF BID - Trustee Marty moved, seconded by Trustee TREE & STUMP REMOVAL Rosenthal, that a contract be awarded to Superior Landscaping, Inc. for tree and stump removal in the Village of Deerfield in an amount not to exceed $6,103.00. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) Trustee York inquired what happens to diseased trees that are cut down and sold as fire wood in the Village. He questioned whether there is a potential danger of spreading the disease when burning this wood. Trustee Marty was requested to seek information on this subject and report her findings to the Board. AWARD OF BID - Trustee-Marty moved, seconded by Trustee Seidman, TRUCK CHASSIS & CAB that a new 1988 conventional truck chassis and cab with 4 wheel drive, plow and dual battery system be purchased from Southside Ford Truck Sales, Inc. in an amount not to exceed $10,931.00. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, Yo- NAYS: None (0) AWARD OF BID - 1987 Trustee Seidman moved, seconded h- e STREET REHABILITA- Marovitz, that'a contract for the Street TION PROGRAM Rehabilitation Program be awarded Co Peter Baker and Son Co. in an amount not to exceed $524,452.00. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) DISCUSSION ITEMS: Trustee Marovitz moved, seconded by Trustee Marty, that smoking be prohibited in the meeting room during Village Board meetings. Motion carried unanimously. The Board suggested other groups using the meeting room be advised,of this action in the hope that they follow their lead. Discussion of a written request from Barbara Houpt for the Board-to direct the Plan Commission to hold a public hearing on text amendments to the Zoning Ordinance was held. The amendment would develop standard's and criteria for seasonal uses and clarify a previous amendment concerning proximity of accessory structures to property lines. Trustee Marty moved, seconded by Trustee Rosenthal, that the Plan Commission hold a public hearing on text amendments to the Zoning Ordinance. Motion carried unanimously. Village Manager Franz reported that the Board was notified in writing a week ago that the Police Department imposed emergency traffic restrictions at Kipling and �\ Longfellow due to increased traffic created by motorists avoiding the Deerfield and Waukegan intersection. An additional no turn sign has been erected. Traffic will be monitored until the pattern is improved and the sign can be removed. The Village Attorney was directed to prepare the necessary ordinance to prohibit right turns for eastbound traffic on Tennaqua at Castlewood. This action was approved by the Board seceral months ago, to become effective when the 1717 Building was ready for occupancy. There was an inquiry as to whether a response was received from IDOT concerning the Edens exit ramp on Lake -Cook Road. To date, none has.been received. Discussion was held concerning a letter from Alan Garfield, representing a client who seeks a liquor license to permit wine to be included in a gift basket delivery service. The Village Attorney was requested to research this matter to determine whether this is permissible.
