November 17, 1986 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Clerk, in the Council Chamber of the Village Hall on Monday, November 17, 1986 at 8:00 P.M. Upon motion of Trustee Marovitz, seconded by Trustee Swanson, and unanimously approved by the Board, Trustee Marty was named Mayor Pro Tem. The Clerk called the roll and announced that the following were `Present: Cynthia J. Marty, Mayor Pro Tem James L. Marovitz Harriet E. Rosenthal Edwin B. Seidman Vernon E. Swanson J. Robert York Absent: Bernard Forrest, Mayor and that a quorum was present and in attendance. Also ;,resent were Village Manager Robert Franz and Village Attorney Jame: Stucko. Trustee Seidman moved, seconded by Trusteee Rosenthal, _ ':t the minutes of the previous meeting be approved. Motion carried una;.- mously. BILLS AND PAYROLL - Trustee Rosenthal inauired about the changes under the new Tax Reform Act relating to interest on bond issues. Trustee Marovitz indicated the changes referred to bonds issued after September 1, 1986. Village Manager Franz stated that staff would research this matter. Trustee Seidman moved, seconded by Trustee Marovitz, that the Bills and Payroll be accepted. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) TREASURER'S REPORT scrutiny, it was noted report. The need for a 13 month calendar to be shown in the Treasurer's Report was discussed.. Upon closer that this information was available in the Trustee Marovitz moved, seconded by Trusteee Seidman, that the Treasurer's Report be accepted. Motion carried unanimously. STUDENT GOVERNMENT DAY OFFICIALS Mayor Pro Tem Marty introduced the students who were elected Village officials for the day. They were congratulated by the Board. LAKE COOK PLAZA - Mr. Lawrence Kahn, representing petitioner, PUD /BAY STREET displayed a standard prototype of the restaurant RESTAURANT and site plan. He provided some background information on the proposed project. It will be greater in size than the existing Cisco's restaurant which will be demolished and replaced by the Bay Street restaurant. Trustee Marovitz noted that the recommendation of the Plan Commission included straightening out the entrance to Lake Cook Plaza. Mr. Bruce Bachman, representing the partners who operate the shopping center, stated he was not aware that this was part of the Plan Commission recommendation. He noted he would take this matter under advisement and discuss it at a later date. Trustee Seidman moved, seconded by Trustee Marovitz, that the Recommendation of the Plan Commission regarding a request for an amendment to PUD /Special Use restaurant - Lake Cook Plaza (Bay Street), including the driveway entrance improvements, be approved and the Attorney directed to prepare an ordinance. Motion carried. unanimously. Trustee Rosenthal mentioned to Mr. Bachman that a discussion on an interconnect road between Lake Cook Plaza and Deerbrook Mall would be.scheduled for the Board.meeting in,December when the ordinance for the Bay Street restaurant is on the agenda. SPECIAL USE -PRD Trustee Rosenthal moved, seconded by Trustee RESUBDIVISION Marovitz, that the Recommendation of the Plan 232 BIRCHWOOD Commission regarding Special Use PRD (Resub- division) Tondi, 232 Birchwood Avenue, be approved including street dedication and the Attorney directed to prepare an ordinance. Motion carried unanimously. SPECIAL USE -PRD ..Trustee.Seidman moved, seconded by Trustee RESUBDIVISION Marovitz, that the Recommendation of the Plan 227 KENMORE Commission regarding Special Use PRD (Resubdivi- sion) Visoky, 227 Kenmore, be approved including street dedication and the Attorney directed to prepare an ordinance. Motion carried unanimously. CONSENT AGENDA Trustee Marovitz requested that the Ordinance regarding Belden Deli's special use be removed from the Consent Agenda. Motion carried unanimously. ORDINANCE 0 -86 -60 Second reading of the ordinance. RATE INCREASE FOR TAXICABS ORDINANCE 0 -86 -61 Second reading of the ordinance. DRIVEWAY VARIATION TOLLWAY NORTH Trustee Seidman moved, seconded by Trustee Swanson, to accept the Consent Agenda including adoption of the ordinances. Motion carried by the following vote: AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) SPECIAL USE - BELDEN'S DELI Belden's Deli. Motion Trustee Marovitz moved, seconded by Trustee Rosenthal, that the rules be waived for a second reading of the ordinance amending special use re failed by the following vote: AYES: Marovitz, Marty, York (3) NAYS: Rosenthal, Seidman, Swanson (3) Failure was due to the fact that petitioner was advised at the previous meeting to' request by letter a waiver of the rules for a second reading. Petitioner had made an oral request. This is a first reading of the ordinance. PEDESTRIAN WALKWAY- Village Manager Franz read.a letter from LAUREL HILL /WOODLAND Chesterfield.Development stating its position on SCHOOL the pedestrian walkway. Mr. Arthur Zaltzman, representing Chesterfield Development, stated his intention of discussing with the Board the possibility of satisfying the homeowners who have a problem reaching Woodland Park. The builders are willing to grant four feet at.the west end of Lot 11 for a walkway. This will reduce the size of the lot for R -2 zoning and-will require a variation in the zoning. Considerable discussion centered on the procedure for resolving this issue. Trustee Rosenthal moved, preparation of a plat of the same time directing hearing on the variation time the Board considers Appeals. Motion carried seconded by Trustee Swanson, to direct the dedication for a four foot strip on Lot 11, at the Board of Zoning Appeals to conduct a public for Lot 11 with the dedication to occur at. the the recommendation of the Board of Zoning unanimously. -2- AMENDMENT - PARKING An amendment to the Barclay Lane Association REGULATIONS /BARCLAY parking regulations that will coincide with the LANE ASSOCIATION Village's parking requirements was considered. Trustee Seidman moved, seconded by Trustee Marovitz, that the Mayor and Clerk be authorized to execute the Amendment to the Agreement. Motion carried unanimously. IN -CAR TERMINALS Police Chief Brandt described the mobile data POLICE DEPARTMENT terminal system for use in police cars and its data processing capabilities. He explained the various phases of the program and how it will improve the efficiency of the Police Department. Deerfield's Fire Department and the Village of Lake Forest would also utili--e- ti-:is system and share in its cost. Chief Brandt mentioned it was conceivable that installation of this system could further reduce Deerfield's Class 4 Fire Rating. Trustee Swanson moved, seconded by Trustee Seidman, to authorize the purchase of in -car terminals for the Police Department at a cost not to exceed $98,527.00. AYES: Marovitz, Marty, Rosenthal, Seidman, Swanson, York (6) NAYS: None (0) SALE OF PROPERTY - The Board discussed a proposed real estate BRICKYARDS /SVEN contract with Sven Flodstrom involving a piece of FLODSTROM surplus property in the Brickyards owned by the Village, south of Pfingsten Road extending to the Kates Bridge project together with a right of way that was dedicated in the past for Deer Lake Road that will no longer be constructed as a dedicated street. A request by Mr. Flodstrom to change the wording on the contract regarding the closing caused considerable discussion of the type of 'contract sought by Mr. Flodstrom an,3 the actual property that was being purchased. Trustee Swanson moved, seconded by Trustee York, that the contract with Sven Flodstrom regarding sale of property in the Brickyards be tabled until the December 1 meeting. Motion carried unanimously. DRIVEWAY VARIATION Trustee Seidman moved, seconded by Trustee 125 KENMORE AVENUE Marovitz, that the request for driveway width variation, 125 Kenmore Avenue, be tabled until the December 1 meeting. Motion carried unanimously'•. There being no further business, upon motion of Trustee Seidman, seconded by Trustee Rosenthal, the meeting adjourned at 9:45 P.M.
