06/16/19869/ June 16, 1986 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor, in the Council Chamber of the Village Hall on Monday, June 16, 1986,.at 8:00 P.M. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor . Cynthia Marty Harriet Rosenthal Edwin Seidman Vernon Swanson Absent: James Marovitz J. Robert York and that a quorum was present and in attendance. Also present were Village Manager Robert Franz and Village Attorney James Stucko. Trustee Rosenthal asked that the minutes of the previous meeting, line 2 of the para- graph on Special Use - Lettuce Entertain You be corrected to read as follows: "on the concept of counting parking spaces twice, the..." Trustee Seidman moved, seconded by Trustee Marty, that the minutes of the previous meeting, as corrected, be approved. Motion carried unanimously. BILLS AND Trustee Seidman moved, seconded by Trustee. Marty, that the PAYROLL .Pre -list of Bills and May Payroll be approved. Motion carried by the following vote: AYES: Marty, Rosenthal, Seidman, Swanson (4) NAYS: None '(0) .ABSENT: Marovitz, York (2) PROCLAMATION Mayor Forrest read a proclamation which proclaimed Tamara and Mark Levin to be honorary citizens of the Village of Deerfield. Trustee Seidman moved, seconded by Trustee Marty, that the Proclamation be approved. Motion carried unanimously. BZA - SIDEYARD Trustee Marty moved, seconded by Trustee Rosenthal, that the VARIATION' recommendation of the Board of Zoning Appeals regarding a sideyard variation at 1418 Dartmouth Lane be approved, and the.Attorney directed to prepare an ordinance.. Motion carried unanimously. SPECIAL USE -. Trustee Marty moved, seconded by Trustee Seidman, that the G & G CONSTRUCTION recommendation of the Plan Commission regarding approval of the final plat of resubdivision (Gordon Terrace) be accepted and the Attorney directed to prepare an ordinance. Motion carried unanimously. The Board also agreed to consider, at a future meeting; a recapture agreement for public improvements in the area. SPECIAL USE - Resubdivision action was begun prior to the filing of a lawsuit ABBERTON against the Village in which the Abberton property is involved. RESUBDIVISION Village Attorney James Stucko.advised that, although this parcel has been removed from the property included in current litiga- on, no action should be taken-on the resubdivision plat until the lawsuit is w t ed. Trustee Seidman moved, seconded by Trustee Rosenthal, that the recommenda- tion of the Plan Commission for approval of the final plat of the Abberton Resub- division be tabled until settlement of the lawsuit. Motion carried unanimously. CONSENT AGENDA RESOLUTION R -86 -07 A Resolution closing portions of Waukegan and Deerfield Roads JULY 4th PARADE for the Fourth of July Parade. SPECIAL USE An ordinance granting a special use at Woodland Park School for WOODLAND PARK. Riverside Foundation. First Reading. SCHOOL RESOLUTION R -86 -08 A Resolution establishing prevailing wage rates for Lake and PREVAILING WAGES Cook Counties. SALE OF An Ordinance authorizing the sale of surplus Village property.. SURPLUS PROPERTY First reading. Trustee Marty moved, seconded-by Trustee Seidman, that the Consent Agenda be adopted, including adoption of the resolutions and first reading of the ordinances. Motion carried unanimously. ORDINANCE re: The Board agreed that consideration of an ordinance approving SIGNAGE PLAN a signage plan for Matas Corporation be tabled until a new MATAS CORP. proposal is presented in July. ORDINANCE 0 -86 -22 Trustee Seidman moved, seconded by Trustee Rosenthal, that the BUILDING HEIGHT, ordinance amending the Zoning Ordinance re: .public notification READER BOARD, for building height variations, reader board regulations and ACCESSORY STRUCTURES accessory structures on a residential lot be adopted. Motion carried by the following vote:* AYES: Marty, Rosenthal, Seidman, Swanson (4) NAYS: None (0) ABSENT: Marovitz, York (2) SPECIAL USE - LETTUCE Discussion of the proposed ordinance again focused on the ENTERTAIN YOU additional parking spaces required by enclosure of a deck by the petitioner and whether the Zoning Ordinance should be amended to allow counting parking spaces twice. Richard Melman,.owner of the proposed restaurant, detailed the background of the plans.for the restaurant and his decision to enclose the deck. Trustee Marty moved, seconded by Trustee Rosenthal, that an ordinance amending the special use for Lettuce Entertain You restaurants on Lake -Cook Road be adopted. Motion failed by the following vote: AYES: Marty (1) NAYS: Rosenthal, Seidman, Swanson (3) ABSENT: Marovitz, York (2) Mr. Melman inquired whether the ordinance would be pas parking spaces. The Board indicated that they have no concept as long as the parking requirements are met ORDINANCE 0 -86 -23 Trustee Seidman moved, seconded INCREASE CLASS E ordinance increasing the number LIQUOR LICENSES be approved. (4) NAYS: None (0) ABSENT: Marovitz, York (2) SPECIAL USE - Due to the lawsuit filed against the Village concerning the ABBERTON RESUB referenced property, consideration of this Ordinance has been tabled until settlement of the lawsuit. AWARD OF BID - Due to the high bids received for sanita.ry.sewer /treatment SANITARY SEWER plant improvements, Phase 2A, the Village Engineer and IMPROVEMENTS Baxter and Woodman recommended rejection of the bids. Trustee Seidman moved, seconded by Trustee. Swanson, that the recommendation of the Village Engineer and Baxter and Woodman to reject the bids and to readvertise at a later date be approved and that replacement of the sludge pump be separated from the rest of the project. Motion cam :. by the following vote: AYES: Marty, Rosenthal, Seidman, Swanson (4) NAYS: None (0) ABSENT: Marovitz, York (2) PFINGSTEN ROAD After a presentation by the engineering consultants, Trustee EXTENSION, PHASE 2 Marty moved, seconded by Trustee Rosenthal, that the Ciorba Group be authorized to complete the design of the Lake -Cook bridge, roadway and railroad overpass in accordance with their proposal at a cost :� -�3 not to exceed $148,967 and a completion date of September 1, 1987. Motion carried by the following vote: AYES: Marty, Rosenthal, NAYS: None (0) ABSENT: Marovitz, York IDOT AGREEMENT STORM SEWER IMPROVEMENTS Motion carried Seidman, Swanson (4) (2) Trustee Marty moved, seconded by Trustee Rosenthal, that the Mayor be authorized to sign a letter agreement with IDOT regarding storm drainage improvements on Waukegan Road and adopting a hold harmless resolution in connection therewith. unanimously. IDOT AGREEMENT Trustee Seidman moved, seconded by Trustee Swanson, that the GUN CLUB PROPERTY Agreement between the Village of Deerfield and the State of 'RESOLUTION R -86 -09 Illinois %Department of Transportation to exchange real estate North Branch Chicago River Watershed Implementation Program, Structure 29- 29A be approved with clarification of Item 5 in the Agreement. Motion carried by the following vote: AYES: Marty, Rosenthal, Seidman, Swanson (4) NAYS: None (0) ABSENT: Marovitz, York (2) DISCUSSION ITEMS: Mayor Forrest reported that he received a response from the CLAVEY FIELD Park District to his letter requesting that the lights be turned off at Clavey Field. The Mayor indicated that the response did not address the i.ssues. Attorney Joseph Morrison spoke before the Board and indicated he has been .retained by the Clavey area residents to represent them in settlement of this matter. Further discussion was provided by the president of a soccer organization based in Deerfield and the president of Club America Soccer Club. They urged that negotiations and discussions between the Park District and the Village Board be inaugurated to resolve this matter without court action. Mayor Forrest made it clear that, regardless of the sports organizations' support for the lights, the Park District must address the concerns expressed by neighboring residents for the impact these lights have had on their properties. DEERBROOK . Trustee Rosenthal commented on the fact that accident statistics CRIME STATISTICS at the Deerbrook Shopping Center totaled 20% of all calls made by the Deerfield Police Department. SURPLUS PROPERTY Police Chief Brandt reported that the Police Department had six canoes and a trailer, previously used by the Youth program, which they wished to have declared surplus property. The Board suggested that Chief Brandt write a proposal to the Board regarding the suggested dispos of the canoes to a Boy Scout Troop in Deerfield. Chief Brandt also asked that th ­a bicycles used by the Bicycle Patrol be declared surplus property. Trustee Marty ,:-ved, seconded by Trustee Swanson, that the six canoes and trailer and.three bicycles be declared surplus property. Motion carried unanimously.
