09/04/1984613 r September 4,, 1984 The. regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, Septem- ber 4, 1984 at 8:00 P.M. The Clerk called the roll and announced the following were Present: Bernard Forrest, Mayor Stephen 0. Jackson James L. Marovitz Cynthia J. Marty Edwin B.. Seidman J. Robert York Absent: Vernon E. Swanson and that a quorum was present and in attendance. Also present were Village Mana- ger Robert D. Franz and Village Attorney James K. Stucko. Trustee Seidman moved, seconded by Trustee Marty, to approve the minutes of the previous Board meeting. Motion carried unanimously. Trustee Marovitz entered the meeting at 8:04 P.M. and was present thereafter. SAFTEY AWARD PRESENTED TO" Mayor Forrest announced, "As Mayor.of Deerfield,, E.. KLASINSKI PUB. WKS. DIR. I have had the privilege of officiating at many ceremonies, but never on any occasion which gave me greater satisfaction as this one this evening." He went on to say that since August 10, 1976, eight-full years, the Public Works Department had completed .644,450 man hours without any of the 29 members having lost time due to accidents on the job —a safety record he believed to be unequalled anywhere. He explained that due to this safety record, the Village has paid this past year only 42% of'.' the going rate for Workers Compensation Insurance...$26,500 instead of $63,200; a monetary savings of $36,700. In recognition of this safety record, Employers of Wausau, the Village's insur ance carrier, had awarded a plaque to Deerfield. Congratulating Mr. Edmund Klasinski, Director'of Public Works, and all the members of his department, Mayor Forrest presented the plaque to Mr. Klasinski, with all the Board.and audience.,' expressing hearty approval. . PROCLAMATION Mayor Forrest read a proclamation designating. CONSTITUTION WEEK the week of September 17 -23 as Constitution SEPTEMBER 17 -23 Week. Trustee Seidman moved, seconded by Trus -.`: C t 17 f ' 'I feel very strongly that we`need to move forward with final.plans for these im provements even though we are awaiting some additional information and recommenda- tions from our engineering consultant on the sanitary sewer system.,r ! "While this is a major capital' improvements program that wile incre se the tax rate of all property owners, it is critical-that the Village undertake it at this time. The condition of Village streets and the flooding problems experienced in Deerfield in recent years, as well as the age of portions of our sanitary sewer systems, man - date these tax increases to meet our capital needs. I am confident that, through increased assessed valuation from new developments and the method by.which we schedule bond issues, the tax impact will be kept to the barest minimum. "We have two options for funding these projects. The first is the issuance of Gen- eral Obligation Bonds and.the second is the use of short term demand notes. These options will be reviewed by our financial consultant, Ron Norene and Associates, and our bonding consultant, Borge and Pitt. My objective is to have one bond issue just prior to the end of this year and another issue in early 1985. "Once the Board has had an opportunity to review this proposal, a meeting will be scheduled for discussions and final plans made to proceed with the improvements. Consistent with past practices, several public meetings will be'held, at which time our plans will be discussed and residents encouraged to participate." Manager Franz, exhibiting a street map of Deerfield, pointed out capital improve- ment locations: -•:.streets designated for reconstruction and resurfacing, storm sewer improvements, part of the sanitary sewer improvements, and miscellaneous improvements including Access Avenue. Mayor Forrest stated that the funding issue is relatively complicated with a decision to be made in early December between General Obligation Bonds and short term notes, whichever is mote economical: The first issue is expected to'be' $4.2 million and sold this fall, with a second issue in a like amount issued in early 1985. .DEER RUN DEVELOPMENT Manager Franz stated that -the'Plan Commission PARTIAL RESUBDIVISION had held a public hearing on August 9, 1984 PRELIMINARY PLAT to consider the request of Kennedy Home Build- ers for vacation of a'previously approved sub- division and the resubdivision of a portion of the'area. On a.vote.of 4 to 1, the Plan Commission recommended that the Kennedy preliminary plat of resubdivision, the plat vacating the old subdivision, easements and cul -de -sac ROW, and the plat resubdividing the outlot be approved. Responding to Board inquiry, Mr. Emigh of Kennedy Builders, statedthat they wished to vacate 56 lots and the easements thereon and resubdivide that area•in.to 50 lots-. In addition, they seek to resubdivide former outlot No. 1, consisting of .5 lots,. into.4 lots, with.the emergency access retained between Deer Run and Briarwood Vista. Motion:. ,Trustee Marty moved,.seconded by Trustee Marovitz, to approve the,recom mendation of the 'Plan Commission,and approve the preliminary plat. Motion carried,,'' unanimously. TOWING /IMPOUNDING FEE Manager Franz reported that Staff recommended FOR ILLEGALLY PARKED VEHICLES that the charge for towing and impounding ven, '.. hicles illegally parked in depot lots be in- creased from $15 to $30. The fee of $15 established in 1972 is insufficient to cover present day towing rates. Motion: Trustee Seidman moved, seconded by Trustee Marovitz, to direct the attor- ney'to prepare the ordinance necessary to increase towing /impounding charges. The' motion carried unanimously. r� i SIDEWALK & CURB REPLACEMENT Village Engineer James Sgyka st�ted that at 50/50 PLAN IN LIEU OF MFT BID Board direction he had discussed with Schroeder and Schroeder, contractors, the Motor .Fuel Tax bid for replacement of sidewalks and.curbs.•':Mr Soyka stated that he had been successful in convincing the contractor to reduce his bid and work at the same rate as for the 50/50 sidewalk'and curb replacement program: a teduction from $2.25 to $1.72 per square foot for sidewalks.and from $12.50 to $8.50 per lineal foot for curbs. At the reduced rates, the work will amount to $5,262. If the MFT bid is rejected and the work included in the 50/50 program, funds remaining in the 50/50 account are sufficient to cover the $5,262 and. thereby "free-up" MFT funds. Motion: Trustee Marty moved, seconded by Trustee Marovitz, to reject the MFT bid and direct the Village Engineer to include,that work under the 50/50 Sidewalk and Curb Replacement Program at a cost not to exceed $5,262. If the Public Works Department furnishes sidewalk work' and'backfilling, Aldridge Electric,:';,; the contractor, will undertake the additiona1 . work for $17,000..,`. Mgr. Franz stated that he had contacted the private businesses who'had'been involved in the original cost - sharing agreement for the traffic signal'. Verbal response has been received that they will participate.to some extent in.the cost of the additional improvements. Motion: Trustee York moved, seconded by Trustee Jackson, to waive bidding pro- cedures and to accept the bid of Aldridge Electric, Inc. for the additional work at a cost not to exceed $17,000.. Motion carried on the following vote: AYES: Jackson, Marovitz, Marty, Seidman, York (5) NAYS: None ,(0) HOTEL /MOTEL TAX Mayor Forrest stated that he had asked the ORDINANCE village attorney to prepare an ordinance es- tablishing a hotel/ motel tax in'order to help keep future operating expenses from impacting on property owners. The pro- posed five percent tax is consistent with the rate discussed when the Marriott and the Embassy Suites were under consideration. The tax will'soon be an impor- tant source of revenue. The ordinance stood at first reading. LAIJ' -COOK ROAD ANNEXATION Motion: Trustee Seidman moved, seconded by SLCTION W. Motion carried -,: nanimously. NORTH AVENUE IMPROVEMENT Mgr. Franz recounted the revised agreement REVISED AGREEMENT ::; sent to Bannockburn wherein Deerfield would pay, over the next five years, half the cost of North Avenue improvements, maintain th,: road alone for the five years, and then maintain the road with costs shared equally by both municipalities. Ban - nockburn is asking for an amendment to the agreement. They feel that since they are paying the entire cost up front and Deerfield is paying no interest on the "loan" advanced by Bannockburn, Deerfield should maintain the road for ten rather than five years. Mgr. Franz recommended Board approval of the amendment since Deerfield maintains the street anyway, and he envisions very limited re- pair work over the next ten years. Trustee Seidman questioned whether or not it would be more economical -to pay in- terest on the loan. Mgr. Franz replied 'that based on a rate of 8 %, the interest and maintenance costs about even out. Motion: Trustee York moved, seconded by Trustee Jackson,•to amend the revised agreement to provide maintenance of North Avenue by Deerfield for.ten years. Motion carried, Trustee Seidman voting Nay. HIGH SCHOOL DRIVE Mgr. Franz stated that trJuly residents in the, area of High School ive /had asked the Board to consider closing the drive and improving the area` Staff had contacted the school which would like the street left open as an alternate exit in case " of an emergency. They will, however, work with the Village toward an agreeable solution. Staff recommended looking at.alternatives which would-allow the,street to remain as an emergency exit and access to the school. He suggested that Staff, work with the school and residents to contribute financially toward beautifica- tion of the area. Trustee York expressed disappointment that property owners ad- joining the street had not offered to buy the right -of -way. Mayor Forrest, how- ever, pointed out that at-least a pedestrian through- way-had to be maintained for area students. Motion: Trustee Seidman moved, seconded by Trustee Jackson, to, instruct -Staff to look further into the matter for possible solutions. Motion•carried.unanimously. 1438 WAUKEGAN RD. (KONSLER). Mr. Robert Best, attorney for Gene Konsler REZOkING & VARIATIONS and Capitol Developments, stated that on July 16, the Board had taken no action on their request for rezoning and variations at 1438 Waukegan Road.to permit 7 condomin- iums as they considered such a development too dense. Consequently, he had asked Village Planner.Barbara Ruffino for the addresses of-multiple-family uses and the. density per acre of each development. However, the Board had previously received the list with information on construc tion dates of those buildings. Mayor Forrest considered those dates very,germaine to the issue since many buildings were erected.long:before the present ordinance.,..... was adopted.. He added that,.Mr. Konsler had been advised that the Board would be happy to'consider the development with fewer units and had asked Mr. Konsler to . comeback with other plans. Trustee York stated he could riot, accept the 7 -unit proposal.. Mayor Forrest concurred. �. Trustee Marovitz stated.that he -had not been at the first discussion.of.the mat- ter and wanted an opportunity to'look into the matter further. 'Moreover, other Board members had not brought their previously::received material, as the item was not on the agenda. Motion: .-Trustee Marovitz moved,.seconded by Trustee Seidman, to table the matter. Motion carried unanimously. Trustee Seidman :asked:: Mrs. Ruff,ino to supply density figures on.Barclay Lane and the recently proposed apartment development for Deerfield Road at Chestnut Street.
