05/21/1984a.16*' May 21, 1984 The regular meeting of the Board of Trustees of the_ Village of Deerfield was called to order by the Mayor in the Council Chamber of the Village Hall on Monday, May 21, 1984 at 8:00 p.m. The Clerk called the roll and announced that the following were Present: Bernard Forrest, Mayor Stephen 0. Jackson James L. Marovitz Cynthia J. Marty Edwin B. Seidman Vernon E. Swanson J. Robert York and that a quorum was present and in attendance. Also present were Manager Robert D.' Franz and Village Attorney James K. Stucko. Trustee Seidman moved, seconded by Trustee Jackson, to'approve the minutes of May 7, 1984 With the following corrections: DEERFIELD FEDERAL S & L, paragraph eleven, substitute "representing" for- "of" following "Mallon "; MATAS CORPORA- TION, correct spelling of Trustee Seidman's name, PASSING SCHOOL BUSES, second paragraph, add "Marty" after "Trustee ". Motion carried unanimously . APPROVE I Trustee Seidman moved, seconded by Trustee WARRANT NO. W -84 -05 Jackson, to approve the bills and payroll, including transfers and reimbursements. Motion carried on following vote: AYES: Jackson, Marovitz, Marty; Seidman, Swanson, York (6) NAYS: None (0) i PROCLAMATION Mayor Forrest read a proclamation wherein he ROB WOODWARD & TODD REIRDEN DAY designated Tuesday, May 22, 1984 to be Todd TUESDAY, MAY 22, 1984 Reirden and Rob Woodward Day in recognition of their outstanding achievements as members of Chicago Young Americans, a team of 12- year =old hockey players. Their team won. the United States National Pee Wee AAA Hockey championship for 1983 -84, held in Alaska during the;month of April. Mayor Forrest and the Board con - ,gratulated the lads,and all present applauded heartily. SARA LEE SIGN MODIFICATION Manager Franz reported that at a public BZA REPORT & RECOMMENDATION hearing on April 24, 1984, the Board of Zoning Appeals heard the request of Kitchens of Sara Lee for a modification of the sign ordinance to allow the placement, of a new directional /identification sign at the corner of Waukegan and Kates Road. The BZA found the proposed 32 sq.ft., back -lit, plastic sign unaccept -. able and adjourned the meeting until May 8, 1984, to permit Sara Lee to pre- sent a new design., On May 8th, a new plan was presented showing a white brick sign of only 24 sq. ft. and similar to the existing signs on the property. The Board of Zoning Appeals recommended (on a vote of 5 -0, 1 abstention) that the modifi- cation to allow the 24 sq..ft. sign be,granted with the following stipulation: the method of illumination is similar to existing signs and precludes glare onto Waukegan Road. Motion: Trustee Marty moved, seconded by Trustee York, to accept the recommenda- tion of the BZA and - direct the Village Attorney to prepar.e,the necessary ordi- nance. FRANKEN BROS. SUBDIVISION A letter had been received from Mr. Theo. E. EXTEND PRELIM. PLAT (6 mos.) Cornell, Jr., attorney for the owners of the Franken Bros. Nursery property, requesting an extension of 6 months on the Preliminary Plat for the property on Franken Ave. After a short discussion it was determined that ownership of the proposed sub- division had remained unchanged,and that due to economic conditions, more time .is needed to complete all requirements for final plat approval: Motion: Trustee Seidman moved, seconded by Trustee Jackson, that the request for a 6 -month extension for the preliminary plat be approved. FEDERAL S & L Motion: Trustee Marty moved', seconded by SPECIAL USE - DRIVE -THRU Trustee Swanson, to waive the rules to permit ' ORDINANCE -NO. 0 -84 -19 passage of the ordinance on first reading. Motion carried unanimously. Motion: Trustee Marty moved, seconded by Trustee York to pass the ordinance granting a Special Use to permit construction of a Drive -in Banking Facility on the Deerfield Federal Savings & Loan property at 745 and 757 Deerfield Road. Trustee Marovitz asked how the 4 -6 p.m. time period prohibiting left turns onto Deerfield Road could be altered if the traffic flow warranted a change. Attor- ney Stucko advised that the ordinance could simply be amended to stipulate another time period. Responding to an: 'inquiry by Mayor Forrest, Mr. Wayne Ecklund of the Savings & Loan stated that he understood that the hours prohibiting left turns might be changed if the situation warranted it. i The motion carried on the following vote: AYES: Jackson, Marovitz, Marty, Seidman, Swanson, York (6) NAYS: None (0) SIGN & FACADE MODIFICATION Motion: Trustee Seidman moved, seconded by DEERBROOK SHOPPING CENTER Trustee Marty, to waive the rules to permit ORDINANCE NO. 0 -84 -20 passage of the.ordinance on first reading. Motion: Trustee Seidman moved, seconded by Trustee Marovitz, to pass the ordi- nance granting a sign modification to permit the display of two business signs in a triangular -shape at the main entrance to the Deerbrook Shopping Center. Marty, Seidman, Swanson, York (6) NAYS: None (0) i AWARD BID Manager Franz reported that rids were received 50/50 CURB & SIDEWALK from four contractors. Schroeder & Schroeder, REPLACEMENT Inc. of Mt. Prospect, Illinois, was the appar- ent low.bidder at a unit price of $1.72 per square foot for sidewalks and•$8.50 per lineal foot for curbs. The firm has been used in the past,and their work was found to be of excellent quality. Motion: Trustee Marty moved, seconded by,Trustee Marovitz, to award'the bid for 50/50 curb and sidewalk replacement to Schroeder & Schroeder, Inc. at a unit price of $1.72 per sq. ft. for sidewalks and $8.50 per lineal foot for curbs. Motion carried on the following vote: AYES: Jackson, Marovitz, Marty, Seidman, Swanson (5) NAYS: None (0) ABSTAIN: York (1) IMRF CONTRIBUTIONS Finance Director .George Valentine advised the EMPLOYER PAID Board that due to Public Act 83 -507 passed by RESOLUTION R -84 -07 the State Legislature in 1983, beginning July 1, 1984, all IMRF employers must pay members' con- tributions directly to IMRF on behalf of all IMRF employee members. There are'two methods for implementing the pickup plan: 1. Salary increase: The employee's salary remains at its current gross level and the Village pays the IMRF contribution through in- creased cost to the .Village. 2. No Salary increase: The employee's gross salary is reduced, as in the past, by,the amount of the IMRF contribution. But, since the contribution will now be designated "employer" contribution, rather than employee contribution, under Sec. 414(h) of the Internal Revenue Code, the contribution is excluded from the employee's gross salary and the employee will not pay State or Federal income tax on that IMRF contribution as he had in the past.. Therefore, the employee's take home pay will be slightly larger than when Federal & State income tax was witheld on his IMRF contribution. This method will result in a.benefit to the employee with no increased cost to the village. Mr. Valentine added that Social Security and Pension credits (computed on gross salary) are not affected by the changed IMRF payment method. i Motion: Trustee Marty moved, seconded by Trustee Seidman, to adopt the Resolution providing that in compliance with Sec. 7 -173.2 of the Illinois Pension Code, as of July 1, 1984, contributions to the Illinois Municipal Retirement Fund will be made directly to the Fund by tie Village of Deerfield and that payment shall be made by reducing the amount of the employees' gross earnings by the amount of the contribution. Motion carried unanimously. PENALTY Village Attorney Stucko advised the,Board that MUN. CODE AMENDMENT it would be wise to.bring the Municipal Code ORDINANCE NO. 0 -84 -21 into conformity with State statutes regarding the penalty for driving under the influence of alcohol, other drugs, etc. into conformity with State statutes. Motion: Trustee Seidman moved, seconded by Trustee Marty, to waive the rules to permit passage of the ordinance on first reading. Motion carried unanimously. Trustee Seidman moved, seconded by Trustee Jackson, to pass the ordinance amend- ing Section 22 -19 of Chapter 22 of the Municipal Code. Motion carried on the following vote: AYES: Jackson, Marovitz, Marty, Seidman, Swanson, York (6) NAYS: None (0) MAYOR BERNARD FORREST STATEMENT REGARDING DRIVING UNDER THE INFLUENCE In reviewing recent monthly Police reports, I have been very pleased with the strict enforcement of the "Driving Under the Influence" ordinances. Changes in the law,legislated as a result of recommendations by the Secretary of State's Office in 1983, have led to better enforcement of these regulations and this, in turn, has made our streets safer. In calendar year 1983, the Deerfield Police Department arrested a total of 140 such offenders. Of this number, 91 cases have gone to Court, 80 were found guilty, 11 were either reduced, dismissed or not prosecuted for a variety of reasons. The average fine exceeded $400 and the findings of guilty included the offender's being required to attend DUI school (at the offender's expense) and one year's supervision. Of the 140 arrests, 49 cases are still pending.' Thus far in 1984, in just 4 months, the Police have made 134 DUI arrests.
