03/01/198240 Minutes for '.February 15, 1982 on pagesV4.3.;. through_ 4.9_ incl.r March 1, 1982 iThe regular meeting of -the Board of Trustees of the Village of Deerfield was . called to order by the President in the Council Chamber of the Village Hall on Monday,'March 1', 1982 at 8:02 P.M. The Clerk called the roll and announced that the following were:, . Present: Bernard Forrest Marvin W. Ehlers Jerold L. Heisler Cynthia J. Marty Edwin B. Seidman Vernon E. Swanson J. Robert York and that a quorum was present and in.attendance. Also present were Village Attor- ney James Stucko'and Village Manager Robert D. Franz.. Trustee Seidman moved, seconded by Trustee Swanson, that the minutes of February- 15, 1982 be approved with the following corrections: 1) under Density Bonuses; following the word "vote ", record the Eoard.votes (Ayes: Ehlers,.H0isler1­Marty,• Seidman, Swanson, York (Q .;.Nays: None (0) ); and 2) under Sign -Modification,: 1415 Lake -Cook Rd., paragraphs 13 and 14, delete "that the Deerfield Zoning Ordi- nance be modified'.' and substitute "to grant a sign modification ". Motion carried unanimously. SCHESNOL /BERNARDI Mgr. Franz stated that the •P.1an Commis RESUBDIVISION pion had held a public hearing on'.Decem ber 17; 1981 to consider'the :application,; of Mr. and Mrs. J. Schesnol and Mr. an6, Mrs: Carl Bernardi of 825 and 8.15 King Richard's Court for resubdivision of their adjoining properties to creai,, . better lot configurations to provide mc,e beneficial yard areas. The Plan, Com mission, on a vote of 4 to 0, had recommended approval of the preliminary.p.lat ' submitted at the hearing. After a short discussion, Trustee Marty moved, sec- . onded by Trustee York, to approve the preliminary plat of the Schesnol /Bernardi .resubdivision.. Motion carried unanimously. SAFETY COUNCIL APPOINTMENT Mayor Forrest announced.that he wished to recommend Herbert Sundmacher to the Safety Council until November, 1983. Trustee Heisler moved, seconded.by Trus- tee Marty, to approve Mayor Forrest's recommendation. Motion garried unanimously. SIGN MODIFICATION GRANTED Trustee Marty moved, seconded -by Trustee 1415 LAKE =COOK ROAD Heisler, that the.rules•be waived to permit ORDINANCE NO. 0 -82 -13 passage of the ordinance on first.reading.!' Motion carried, Trustee Seidman voting Nay. Trustee Marty moved, seconded by Trustee Heisler, to pass the.ordinance granting a modification from the sign provisions of the Zoning Ordinance with respect to the property commonly knowp as Lake -Cook Office Centre, 1415 Lake -Cook Road. Trustee'Seidman was adamantly opposed tQ the granting of the sign modification to permit a 10'x20' sign, He reported thae-he had driven up and down Lake -Cook Rd. three times during the last two weeks to examine distances, had looked at all signs along Lake -Cook Rd. as far as Northbrook Court, and.had compared the petitioner's request with smaller signs, such as on- the Flodstrom site. He stated;fhat a sign erected at the midpoint -of the property would be one -tenth of a mile from each end, and that since he had found he could read a 5'x10' sign from a quarter of a mile away (the full length of the petitioner's front- age), he saw no necessity for a larger sign. He stated he feared the larger sign would set a precedent for other such signs -along Lake -Cook Rd. as build= ling requests come in. , Trustee.-Marty responded that the sign requested was only temporary. Trustee Seidman:replied that it would be up three years and that the petitioner's . testimony had not proved the necessity for a large sign... only that they want- ed one. He, therefore, felt there was no justification for granting the request.. The motion to grant the sign modification carried.on the following vote: AYES: Ehlers, Heisler, Marty, Swanson, York (5) NAYS: Seidman (1) 1 1 1 1 1 Trustee Seidman stated that everything the petitioners had asked for they had been given...that.the Board had capitulated to every one of their requests... all without justification. Mayor Forrest commented that Trustee Seidman's statements were.Trustee Seidman's opinions. CONSTRUCTION ON STATE HIGHWAYS Trustee Marty moved, seconded by Trus- RESOLUTION R -82 -03 tee Heisler, to adopt.the Resolution allowed by the State.in lieu of a secur- ity bond for work done by Village on State- maintained Rights of Way. Motion carried on following vote AYES.: Ehlers, Heisler, Marty, Seidman, Swanson, York, (6) NAYS: None (0) 649 CENTRAL ( HARRIGAN) Mayor Forrest stated that decision-,on the REZONING REQUEST (TABLED 3/2/81) petition of'Mr:; and Mrs. B:'Harrigan for, rezoning of their property at 649 Central'. Avenue from 2- family residential to C -1 Village Center,District, was deferred due to a moratorium on rezonings in the.area necessary.to study uses for ,devel opment of the area. He further stated that following the study, ordinances had been enacted,amending the Comprehensive Plan to show a preference for multiple family development in the area containing the petitioner 's,property. Mgr.: Franz noted that the original ordinance to zone .,the property to C -1 cannot',be . passed since it is not in compliance with the amended Comprehensive Plan. "Trus- tee Swanson stated, however, that Mr.. Harrigan could ask for rezoning under. the new .ordinances. To Mr. Ha.rrigan's question as to_ whether he could build an addition to his home, he was assured that he could and could also live there as long as he,cared to. He was advised to contact the'Building and.Zoning Depart ment for a full explanation of what he can and can not do with his property ,. alone or in conjunction with other property•owners. Trustee'Swanson moved,..seconded by Trustee Marty, to adopt the'ordinance: amend ing the'zoning map to reclassify the property at 649 Central to-'C -1. Motion failed on the following vote: AYES : . Trustee Marty moved, seconded by Trustee Ehlers, that the attorney,be authorized to circulate the agreement among the other Interested Parties for their comments. Motion carried unanimously. ISSUANCE OF PERMITS Trustee Marty moved, seconded by Trustee MUNICIPAL CODE AMEND. Swanson, to pass the ordinance amending ORDINANCE NO. 0- 82 -16. Chapter 1, Section 1 -26, of the Muniai- { pal Code, entitled "Suspension or revo- 42 cation of licenses or permits; refusal to issue.licenses or,peipits." Motion carried on the following vote: AYES: Ehlers, Heisler, Marty, Seidman;'-Swanson, York. (6) NAYS: None (0) Mayor Forrest read a statement wherein he advised 'that.to make certain that the' integrity.of the Board was insured, he'would disqualify himself from any.and all. deliberations concerning.the development of the'property commonly known as the "Brickyards ", since his wife is representing a proposed leasee'of one of the properties interested in'occupying a portion of the Brickyard premises. He further .stated that he would ask that the Board appoint a president pro tem to serve as'.chairman when Brickyard issues appear on future Board agendas. There being no further business to come before the Board,.upon motion by Trus- tee Seidman, the meeting was adjourned 4,: 8:25 P.M. with the announcement made that a closed meeting to discuss personnel matters would follow.
