03/02/1981I 1J 219 March 2, 1981 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chamber of the Village Hall on Monday, March 2, 1981 at 8:05 P.M. The Clerk called the roll and reported that the following were Present: Bernard Forrest, President Jerold L. Heisler Cynthia J. Marty Vernon E. Swanson J. Robert York Absent: Edwin B. Seidman and'that a quorum was present and in attendance at the meeting._ Also present were Village Attorney Jas.Stucko and Village Mgr. Robert Franz,, Trustee Heisler moved, seconded by Trustee Marty, that the minutes of February 16, 1981 be approved. Motion carried unanimously. STAFF REPORT Mgr. Franz reported that discussions were COOK COUNTY HIGHWAY DEPARTMENT continuing with Joseph Marsik, Chief Engi- LAKE -COOK ROAD MAINTENANCE neer of the Cook County Highway Department, regarding Deerfield's dissatisfaction with their maintenance of Lake -Cook Road, now completely under Cook County jurisdiction. Mgr. Franz stated that Mr. Marsik acknowledges that: 1) there is considerable room for improvement, 2) there is need for a new program including new equipment, a dry storage facility for salt, etc., 3) that Lake-Cook-Road is a high priority route and that resolving of operational problems will result in the quality of maintenance Deerfield expects. Mgr. Franz stated that the possibility of salt storage in Deer - field,-in order to reduce time lost in returning to Cook County's facility, will be explored. He feels "we are moving in the right direction in arriving at a permanent solution to the problem." Trustee Marty moved, seconded by Trustee Heisler, to accept the report. Motion car- ried unanimously. STAFF REPORT RE: RENAMING MEADOW LANE & OSTERMAN PLACE Mgr. Franz stated that Osterman Place and Osterman Avenue have street numbers in the 700's which causes confusion in mail de- livery and could result in serious prob- lems for police and fire emergency services. He recommended that Osterman Place be renamed. He further pointed out that since there is already a Meadow Lane and Meadowbrook Lane in Deerfield,the street bordering the newly annexed Vecchione pro- perty, designated Meadow Lane when under Lake County jurisdiction, should be renamed. Trustee Marty moved, seconded by Trustee Swanson, that Osterman Place be renamed Price Lane and the attorney directed to prepare the necessary ordinance. Motion carried unanimously. Trustee Marty suggested that when Mr. Vecchione develops his area, he choose a name other than Meadow Lane. MUN. CODE AMEND. FIRE PREVENTION CODE_ MUN. CODE AMEND. RE: SOLICITORS CONSENT AGENDA First reading. First reading Trustee Heisler moved, seconded by Trustee Marty, that the Consent Agenda be approved. Motion carried unanimously. Augustus V. Bennett, Fire Marshall of the Northbrook Fire Department, approached the Board with a request that Deerfield rescind its ordinance providing that the section of Deerfield lying within Cook County be covered by the American Insurance Assn. Fire Prevention Code. Mr. Bennett submitted that since the area of Deerfield south of Lake - Cook Road .lies within the corporate limits of Northbrook Rural Fire Protection District (and is served by them) that the area should come under the Fire Prevention Code presently in force in Northbrook. After some Board discussion regarding the effect on Deerfield's building code, insurance rates, etc. of such a change, it was decided that Mr. Bennett should meet with Deerfield's 220 Fire Chief, Jack Gayne, and that Staff look farther into the matter and report back to the Board at its next meeting. PROCLAMATION TORNADO PREPAREDNESS WEEK MARCH 1 -7 ried unanimously. YOUTH COUNCIL APPOINTMENT seconded by Trustee Swanson, Motion carried unanimously. Mayor Forrest read a proclamation wherdin he designated March 1 -7 as Tornado Preparedness Week. Trustee Swanson moved, seconded by Trustee Marty, that the proclamation be accepted. Motion car- Mayor Forrest announced that he would like'to recommend that Andrew Marovitz be appointed to the Youth Council: Trustee Heisler moved, that Andrew Marovitz be appointed to the Youth Council. CHESTERFIELD DEVELOPMENT In response to a request from Chesterfield• LAUREL BILL UNIT # 14 Development Corp. for a 6 -month time extension 6 MO. EXTENSION - PRELIMINARY PLAT on their preliminary plat, Trustee Swanson moved, seconded by Trustee Marty, that Chester- field Development Corp. be granted their request. Motion carried unanimously. LIPOWICH /KRAFT RESUBDIVISION TIME EXTENSION - PRELIMINARY PLAT Marty, that additional time be granted. ESTABLISH DATE MUNICIPAL ELECTION ORDINANCE NO. 0 -81 -16 moved, seconded by Trustee Swanson, that the date of the Municipal Election be ad In response to a request for additional time on their preliminary plat by Lipowich /Kraut Trustee Swanson moved, seconded by Trustee .Motion carried unanimously. Trustee Marty moved, seconded by Trustee Heisler, that the rules be waived, to permit passage of the ordinance on first reading. Motion carried unanimously. Trustee Marty moved, seconded by Trustee ESTABLISH LICENSE FEE Heisler, that the rules be waived, to permit LAUNDROMATS passage of the ordinance on first reading. ORDINANCE NO. 0 -81 -17 Motion carried unanimously. Trustee Marty moved, seconded by Trustee Swanson, that the ordinance establishing an annual license fee'for laundromats be adopted. Trustee Marty moved, seconded by Trustee RE: PEDDLERS Heisler, that the rules be waived to permit ORDINANCE NO. 0 -81 -18 passage of ordinance on first reading.*. Trustee Heisler moved, seconded by Trustee Marty, that the.ordinance permitting citizens to post a sign indicating they do not wish to talk with peddlers or solicitors be adopted. Trustee Marty moved, seconded by Trustee York, that the rules be waived to permit passage of the ordinance on first reading. Motion carried unanimously. Trustee Marty.moved,, seconded Trustee Heisler, that the ordinance rescinding the ordinance prohibiting turf,.- .-Mto Lake -Cook Rd. between the hours of 3 and 6 p.m. be adopted. Motion carried F following vote: AYES: Heisler, Marty, Swanson, York (4) NAYS: None (0) Mr. Charles Bechler, 119 Willow, was present exprc- -�S ng great concern regarding the unfinished house at 118 Willow which has caused•cc;- d erable court action (6 to 8 months) on the part of Deerfield and for which th :ce County Count has appointed a Court Receiver. A lengthy discussion ensued reg<­ !:.ng possible changes in Village ordinances, legal ways and means available to the lage in enforcement, etc.. that 221 could result in the house being finished or razed. It became apparent that Deerfield can take „no'further steps until July when the mortgage redemption period expires. The Board expressed concern that Deerfield's 2 -year building permit may be too long. Mgr.,Franz will check with other communities as, to the length of time they allow for a buildirig.permit--and whether they have had. similar problems and, if so, what steps they have taken. Mgr. Franz will report on his findings at the next Board meeting and the 11.8 Willow item will be placed on the agenda for the second Board meeting in:-July. RECONSIDER PETITION Trustee Marty moved, seconded by Trustee .649, OSTERMAN ( HARRIGAN) York to reconsider Mr. Harrigan's petition „ for rezoning of his property at 649 Oster - waniAvenue which was denied at the February 16, 1981 Board meeting. Trustee Marty stated that it was reasonably certain that after some plan for the area south of the Deerfield Commons had been arrived at and the 6 -month moratorium on rezoning lifted, Mr. Harrigan would apply for rezoning and should not have to again pay the fees in order.to.appear before the Plan Commission. Motion carried unanimously. Trustee Marty then moved, seconded by Trustee Heisler, to table Mr. Harrigan's pe.t,ition. Motion carried unanimously. Mr. Franz reported that -Staff had had a meeting with the Illinois Department of Transportation and their contractor who will begin work on April 1 on traffic signals at- Waukegan and Deerfield Roads. Mgr: Franz stated that he had made an inspection of,where: the signals would be placed and antiepates real problems with the location. of them as space is at a premium because buildings are so close to the street and the State's requirement for placing signals with mast -arms certain distances from the curb.-,-He will meet with them Tuesday to review the situation and report back to the Board. Trustee Heisler reported that the street running north and south along the east side of:the,.,Wilmot Jr. High School is in deplorable condition. He requested Mgr. Franz to -find :out whether this is a village street or whether it belongs to the school and see what action can be taken toward improvement.
