10/06/19801 1 October 6, 1980 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chamber of the Village Hall on Monday, October 6, 1980 at 8:03 P.M. The Clerk called the roll and reported that the following were: Present: Bernard Forrest, President Norma Gavin Jerold L. Heisler Cynthia J. Marty Edwin B. Seidman Vernon E. Swanson J. Robert York and that a quorum was present and in attendance at the meeting. AJ.so present were Village Attorney Herbert Linn and Village Manager Robert D. Franz. Trustee Seidman moved, seconded by Trustee Heisler,that the minutes of September 15, 1980 be approved. Motion carried unanimously. REPORT Public Works Director Edmund Klasinski sub - DEPARTMENTAL OBJECTIVES mitted a report on the departmental objectives PUBLIC WORKS DEPT. for the fiscal year 1980 -81. Responding to inquiry about completion of the south portion of Waukegan Road, Mr. Klasinski stated that it was unlikely that the November 1 target date would be met. He stated however that a temporary surface would be applied where necessary to provide for smooth riding and the project completed next year. Regarding the water systems analysis, he stated that he and Village Engineer James .Soyka were meeting the next day with Greely & Hansen to supply them with additional information for their computer analysis. He also reported that the water leak detection program conducted by Leaks, Inc. has paid for itself. Motion Mayor Forrest proclaimed Lupus Erythematosus week urging Deerfield citizens, educational, philanthropic, scientific, medical and health care organizations to provide assistance toward Trustee Heisler moved, seconded by Trustee Swan - Motion carried unanimously. HANDICAPPED AWARENESS Mayor Forrest proclaimed October 12 -18 Handi- WEEK - OCT. 12 -18 capped Awareness Week (to promote designation of polling places accessible to mobility disabled citizens). OSTERMAN /CENTRAL RECONSIDERATION: OBJECTION The Plan Commission submitted a report recom- COOK COUNTY REZONING mending that the Village of Deerfield with - 425 WAUKEGAN ROAD draw its.objection to the rezoning subject to NORTHFIELD TOWNSHIP the adopting of exhibits permitting and pro- hibiting various specified uses as outlined in a letter from Daniel H. Brown of Schain, Burney & Kenny, attorney for the petitioner. Trustee Swanson inquired of Mr. Brown,who was present,whether the same letter would be submitted to the Cook County Zoning Board of Appeals. Mr. Brown replied that the same letter would be submitted.' Trustee Marty moved, seconded by Trustee Gavin, to accept the recommendation of the Plan Commission. Motion carried.unanimously. ROSECRANS REQUEST LINDAHL HOME CONSTRUCTION 700 OSTERMAN PLACE Cedar Home with a post and Manager Robert Franz read.a report from the Building Board of Appeals regarding a public hearing September 9, 1980 on a petition of Mr. and Mrs. Jack Rosecrans to erect a Lindahl beam system of construction not permitted in Deerfield's Building Code. Chairman Edmund Zarek and Mr. Maury Lipowich of the Board of Build ing Appeals were present. The report indicated that much discussion had been held regarding the post and beam system of construction as well as other aspects of the' design. However, a vote as to whether to allow this residence using a post and beam system resulted in a 3 to 3 tie, and no recommendation could be made. Respond- ing to inquiry, Mr. Lipowich stated that the type of data contained in Lindahl plans was difficult to evaluate in terms of data required by the Standards Code of Deer- field. Trustee Seidman moved, seconded by Trustee York to accept the Building Board of Appeals report and deny the petition. Motion - carried by the following vote: AYES: Heisler, Marty, Seidman, York (4) NAYS: Gavin, Swanson (2) VARIATION (RIVARA) Trustee Gavin moved, seconded by Trustee 1063 FOREST AVE. Heisler, to approve the recommendation of the Board of Zoning Appeals to grant a side - yard variation for the property at '1063 Forest Avenue and that the village attorney be instructed to prepare the necessary ordinance. Motion carried unanimously. AWARD BID Trustee Marty moved, seconded by Trustee Swan - BOILER REPLACEMENT son, to waive the formal bidding procedure. VILLAGE GARAGE . Motion carried unanimously. Trustee Marty moved, seconded by Trustee Seidman, to accept the bid of Bishop Heating, Inc. in the amount of $9,856 for the replacement of the boiler at the village garage with a gas fired unit heater. Motion carried by following vote: AYES: Gavin, Heisler, Marty, Seidman, Swanson, York (6) NAYS: None (0) ZONING ORDINANCE AMENDMENT The Plan Commission submitted a recommendation COMMERCIAL VEHICLE DEFINED to amend the Deerfield Zoning Ordinance defini- tion of a commercial vehicle. Trustee Heisler moved, seconded by Trustee Marty, to approve the recommendation and preparation of the necessary ordinance. Motion carried unanimously. STREET- OPENING DEPOSIT The Community Development Group and Staff AGREEMENT submitted a recommendation for Board approval of a street opening deposit agreement and the proposed form. Trustee Seidman moved, seconded by Trustee Swanson, that the proposed agreement be approved and that the necessary ordinance amending the Municipal Code be prepared. Motion carried unanimously. ZONING AMENDMENT HEALTH CLUBS I -1 DISTRICT the Health Club at 707 Lake make -up, luncheon facility, cosmetics (the Health Clubs First reading of the ordinance. SPECIAL USE First reading of the ordinance. Trustee 707 LAKE -COOK ROAD Seidman voiced objection to the passage of the ordinance. ANNEXATION PETITION Mr. Robert Franz stated that the Staff had VECCHIONE - 6.8 ACRES received the additional information requested by the Board at the August 18, 1980 regarding the Vecchione annexation petition. A report from Village Engineer Soyka on the information received indicated that: 1) Mr. Vecchione's consultant, Barton- Aschman, had submitted revised, updated traffic data with which Mr. Soyka is in agreement in content and conclusion; 2) a village conducted traffic study on September 4, 1980 at Castlewood and Deerfield Roads showed traffic volume not warranting a traffic signal at that point; 3) the Illinois Tollway Commission had agreed verbally to pay one -third of the total cost of traffic signals at the Tollway off -ramp (outside village limits) which would provide gaps in traffic flow at Castlewood Lane. Mr. Vecchione and the Board engaged in lengthy discussion on the interpretation of statistical traffic data. Mr. Vecchione stated his willingness to pay for 1) improvment of Meadow Lane from the northeast corner of his site to.Castlewood Lane; 2) double stacking of Castlewood Lane; 3) two- thirds of the cost of the installation of a traffic signal at the Tollway off -ramp. 4 1!J _% gz /gL Mrs. Marty moved, seconded by Trustee Seidman, to have the attorney prepare for consideration at the next meeting an amended annexation agreement to include double stacking at Castlewood Lane, the office building landscaping plan, paving Meadow Lane,.and payment toward traffic signals at Tollway off -ramp. Motion carried unanimously. SR. CITIZENS HSNG. PERMIT FEE Trustee Heisler moved, seconded by Trustee .ORDINANCE 0 -80 -40 Seidman that the rules be waived to'pass the ordinance on first reading. Motion carried unanimously. Trustee Marty moved, seconded by Trustee Heisler, that the ordinance be adopted. Motion carried by the following vote: AYES: Gavin, Heisler, Marty, Seidman, Swanson, York (6). NAYS: None (0) LAKE -COOK /SANDERS REZONING Although Deerfield has been involved as an RESOLUTION 0 -80 -16 intervenor in opposition to - rezoning of the pro - perty at the southwest corner of .Lake -Cook .and Sanders Road since 1977, the village attorney reported that the petitioner had revised his proposal. Village Attorney James Stucko advised filing a fresh objection and the adoption of a new resolution to that end. Trustee Seidman moved, seconded by Trustee Marty that the resolution be adopted. Motion carried unanimously. AWARD OF BID Trustee Seidman moved, seconded by Trustee OSTERMAN /WAUKEGAN ROAD Heisler, to award the contract for improve- ments to Osterman Avenue /Waukegan Road inter- section to Lakeland Construction Co. -in the amount of $20,675.25. Motion carried by following,vote: AYES: Gavin, Heisler, Marty, Seidman, Swanson, York (6) NAYS: None (0) Trustee Seidman moved, seconded by Trustee Heisler, that a formal commendation by the Mayor and Board of Trustees be extended Thomas Creighton for conducting the-well attended and well received marijuana conference at the Deerfield High School. Motion carried unanimously. Trustee Gavin reported that regarding new signs at the entrances to Deerfield, the'high school may be interested in working on the matter.
