08/04/1980August 4, 1980 n The regular meeting of the President and Board Deerfield was called to order August 4, 1980 a the roll and reported that the following were of Trustees of the Village of 8:10 P.M. The Clerk called Present: Bernard.Forrest, President Norma Gavin Jerold L. Heisler ° Edwin B. Seidman Vernon E. Swanson J. Robert York Cynthia J. Marty and that a quorum was present and in-attendance at the meeting. Also present were Richard V. Houpt, Village Attorney and Robert D. Franz, Village Manager. Trustee Seidman moved, seconded by Trustee Heisler, :that minutes of July. 2-1_*&:,­23, 1980 be approved with the following correction: on page one, under "Treasurer's Report ", delete "a decided upswing" from line 5. Motion carried unanimously. PROCLAMATION: SENIOR CITIZENS' RECOGNITION DAY second.by Trustee Marty. . Mayor Forrest read his proclamation re: Senior Citizens' Recognition Day. It was unanimously approved on motion by Trustee Swanson and 163 REPORT ON Director of Building and Zoning Charles Smalley DEPARTMENTAL reported on his department's objectives. In OBJECTIVES addition he stated that the berm and landscap- ing at United Conveyor Corp. was now complete bringing it into compliance with the annexation agreement. He also reported that a court hearing was scheduled in mid August regarding property at 1745 Christopher Lane and requested a member of counsel to represent the Village at the hearing. Mr. Houpt will review the files to determine if Deerfield has any jurisdiction in the matter.. Responding to a.question regarding progress being made to resolve the violation at 118 Willow, he stated work was going slowly (the owner is doing the work him- self) but there was definite progress and that the owner is to appear in court the latter part of this.month. Mrs. Marty congratulated Mr. Smalley on his report, remarking particularly about the excellence.of his weekly reports. VETO Mayor Forrest read a message whereby to go SCAVENGER on record that he was vetoing the action CONTRACT taken at the regular meeting of-the Board of Trustees on July 23, 1980, in awarding a scavenger contract to Standard Disposal Service. The Mayor's veto message is attached hereto and made a part of the minutes. Considerable discussion ensued about types of service levels, combination of service levels, possible optional service of curb or back door, types of services in other, communities, likelihood of attracting more bidders, and performance bond.:requirements. Questions about whether there was enough time to advertise, receive, and award bids by September 1, 1980 were answered by Manager Franz. He reported that Standard Disposal Service had agreed to extend its present contract for one month at a cost over the current rate. Questioned as to the effect of the veto on the Board's procedure, Mr. Houpt stated that the veto had rescinded the past action awarding a contract. However, as an alternative, a motion could be made to approve the contract notwithstanding the veto, requiring a two - thirds vote of all the Trustees for passage. Trustee 'Seidman stating that he felt the question should be called for the record, moved, seconded by Trustee Marty,to award the contract notwithstanding the president's veto. Motion failed on following vote: AYES: None (0) NAYS: Gavin, Heisler, Marty, Seidman, Swanson, York (6) Mayor Forrest expressed his appreciation for the Board's action. 164 Mr. George Valentine, Finance Director, was instructed to prepare bid specifica- tions for twice -a -week backdoor service, once -a -week backdoor service, twice a week curb service with the possibility of giving residents options after January 1, 1981, and $150,000 performance bond or equivalent C.D. requirement. PLAN COMMISSION Manager Franz read the Plan Commission Report RECOMMENDATION and its recommendation (by a vote of 4 to 1) DOUBLE-STRIPING that Art. 8.2 -3, 8d of the Zoning Ordinance. PARKING LOTS _ be_ amended to permit parking spaces to be de- linenated by single lines as well as double lines now required. Plan Commission Chairman Arthur Rollin, who had cast the dissenting vote, was present. He stated that certain large companies chose to double stripe their parking lots believing they attracted customers thereby increasing sales. Trustee Heisler was of the opinion that companies who did not choose to double stripe their lots obviously had reasons they considered valid. In his opinion, the matter of single or double striping was a manage- . ment decision and that the recommended amendment permitted such a choice. Trustee Marty moved, seconded by Trustee Heisler to accept the Plan Commission recom -_ mendation and that the Village Attorney be instructed.to prepare the necessary ordinance. Motion carried, Trustee Seidman voting nay. REPORT: BUILDING Manager Franz>read the report from the Building BOARD OF APPEALS Board of Appeals recommending granting the petition of Walter C. Carlson, A.I.A. and Mark Rosen, owner of property at 851 Northwoods Drive to substitute web Trus Joist structural system in lieu of a dimensional lumber framing system. Respond- ing to questioning, Mr. Charles Smalley stated that in his professional opinion, the Trus Joist system was superior, particularly in this uniquely designed build- ing. He stated that the Building Board of Appeals has all necessary evidence to concur in this professional opinion. Trustee Swanson moved, seconded by Trustee York, that the recommendation of the Building Board of Appeals be accepted and the Director of Building and Zoning be authorized to issue the requested permit. Trustee Seidman moved, seconded by Trustee Marty, to amend the motion by adding that no occupancy permit be issued until a representative of Trus Joist Corp. has filed an inspection report with the Village insuring safety. Motion to amend carried by the following vote: AYES: Gavin, Marty, Seidman, Forrest (4) NAYS: Heisler, Swanson, York (3) The amended motion carried unanimously. STATUS REPORT DIAL -A -RIDE BUS for additional publicity, raising adult ridership, and the gathering the coming year was discussed. ACCEPTANCE IDOT AUDIT Manager Franz reported on his meeting July 24, 1980 with representatives of RTA and NORTRAN to discuss the Dial -a -Ride program. The need of fares, additiona.1 cost to village, increased of additional data before making plans for Trustee Heisler moved, seconded by Trustee Swanson, that the IDOT audit be accepted. Motion carried unanimously. RESOLUTION:. Upon receipt of a copy of H.R. 6417 and further AMENDMENT TO information, discussion of a proposed resolu- H.R. 6417 tion (tabled July 21, 1980) was resumed. Trus- tee Seidman observed that H.B. 6417 while pro- viding for local decision and control for transportation of handicapped, did require localities to demonstrate a program of some special services and approval by the Department of Transportation. Trustee Seidman moved, seconded by Trustee Marty,to adopt the resolution. Carried unanimously. Motion carried, Trustee York voting Nay. Mayor Forrest stated that the Village had been served with a law suit regard- ing the Board of Police Commissioners. Trustee Marty moved, seconded by Trustee Seidman, that the Village Attorney be authorized to defend the suit. Motion unanimously approved. Mayor Forrest mentioned receipt of a communication regarding Cable TV which had been forwarded to CATV Chairman Jeffrey Blumenthal regarding a meeting to be held in Winnetka. Manager Franz announced that unofficial 1980.census data received from the Census Bureau, showed a 15% decrease in population recorded in 1970.. He announced that the Village had 10 days in which to respond to these pre- liminary figures and-was at work on the matter. He expressed confidence that the more than 500 homes which were built in-Deerfield during the last decade as opposed to the census data figure of 45 homes would be certain to alter the population figures. There .'being no further business to come before the Board, upon motion by Trustee Seidman, the meeting was adjourned at 9:40 P.M. APPROVED: Village President 1 ATTEST: Village Clerk 165 ,.IT,- I6 6 MAYOR'S VETO MESSAGE August 4, 1980 In accordance with the provisions of Section 2 -28 of the hereby veto the action taken at the regular meeting of July 23, 1980, in awarding a scavenger contract to Stand t Municipal Code of Deerfield, the Board of Trustees on and Disposal Company. In exercising my veto power, I ask that the members of the Board of Trustees reconsider the award of the bid, reject all bids, and seek new bids based on the recommendations and proposals contained in this veto message. take this action for the following reasons: In fiscal year 1979 -1980, Village expenditures for scavenger service were $505,000. The contract awarded on July 23rd would result in annual expendi- tures of $937,000 in the first year of the contract - an increase of 86%. This would necessitate a monthly rate increase to the homeowner of 76% for twice -a -week service - an increase which I find unacceptable. At the least, I believe the Board should reconsider its position on a mandatory twice-a -week service. There are currently 700 homes receiving once -a -week ser- vice. If they were required to have- twice -a -week service, their cost would go from the current $7.40 monthly charge to $15.42, an increase of 108 %. This would affect our;Senior Citizens and others who do not need twice -a -week service. Indeed, some of our Seniors do not even have one full container of household waste now. If they had to have twice -a -week service, there would be nothing to pick up on the second day. There is an innovative approach to this problem which has been instituted in some neighboring communities - and I am sure you will agree that this is worth investigating for Deerfield. This is an optional service which permits residents to determine whether they wish twice -a -week curb service as an alternative to twice -a -week back door pick -up. A survey of Deerfield indicates that approximately one -half of the residents regularly place some refuse at the curb. They should have the option of placing all refuse at the curb, resulting in considerably lower cost to them. Under this system, those residents who would prefer the higher level of service could opt for that type. The residents could choose the type service best suited to their particular household. Other options the Village should explore are: K reduction in the performance bond, which would still provide `he needed 'insurance for the Village but would not unnecessarily increase the monthly scavenger rate for our residents. The option of having the scavenger do the billing as opposed to the present system whereby we include the refuse charge with our quarterly water bills. This Board and I have always operated under the principle that it is our responsiblity to do everything within our power to assist our residents by keeping expenditures as reasonable as possible. This is particularly important in these inflationary times when all costs are escalating rapidly. While it is certain that scavenger service is one of the necessities, we can and must take any prudent action possible to offer this service to our homeowners of the least cost. call to your attention the staff report prepared July 31st at my request. In my opinion, this substantiates the need for us to explore this matter further. In summary, I ask that you reconsider the action of July 23rd and that you direct the staff to seek bids which will incorporate the recommendations I have included In this message to you. `1 5 1 O, 4 IX
