Recessed Meeting of July 21, 1980
The recessed July 21, 1980 meeting of the - President and Board of Trustees of
the Village of Deerfield was called to order by the President in the Council
Chamber of the Village Hall on Wednesday, July 23, 1980, at 8:07 P.M. The
Clerk called the roll and reported that the following were

J. Robert York

and that a quorum was present and in attendance at the meeting. Also present
were Richard V. Houpt, Village Attorney, and Robert D. Franz, Village Manager.,
AWARD BID Mayor Forrest stated that since the opening
SCAVENGER SERVICE of two Scavenger Service Bids (Browning -
° • Ferris Industries and Standard Disposal
Service of Illinois, Inc., the current contractor) on July 15, 1980, and a.
brief discussion at the July 21, 1980 Board meeting, letters had been received
from both bidders. Browning - Ferris indicated that if the required performance
bond were reduced to $75,000 and monthly payments by the Village made by the
twentieth of the following month, they were prepared to reduce their unit
charges. Standard Disposal Service, having been unable to provide a bid bond
with its bid submission, indicated that it believed it could now provide the
required performance bond and; if not, would provide a certificate of deposit
of up to $150,000 in lieu of the bond.
Richard V. Houpt, Village Attorney, advised that two options were open - - -the
Village could reject both bids and re- advertise, or it could negotiate a contract.
Considerable discussion ensued regarding the advisability of re- writing the
bid specifications to.lower the amount of performance bonds required; additional
escalator clauses based on gasoline prices, landfill expenses as well as wages;
whether an index of some kind could be achieved given the numerous variables
due to the present economic climate, etc. Mayor Forrest stated that he favored
rejecting both bids, possibly re- writing bid specifications setting $75,000
for bid and performance bonds, possibly including two or more escalator clauses,
and re- advertisement for bids.
Trustee Heisler stated that he did not favor*post.ponement of awarding a bid in
view of the fact that Standard Disposal Service of Illinois has a proven per-
formance record, is the low bidder, and now offers a $150,000. certificate of
deposit as surety of continued performance, which, in Trustee Heisler's opinion,
is greater surety for the Village than a performance bond. Trustee Seidman com-
mented that he did not favor awarding the contract until a $150,000 certificate
of deposit is in hand. Trustee Heisler moved, seconded by Trustee Swanson, to
award the bid to the low bidder, Standard Disposal Service, subject to its
furnishing a $150,000 performance bond or a $150,000 certificate of deposit
by August 4, 1980. Mayor Forrest strongly disagreed with the motion, believing
other options might be available and favoring re- advertising for bids. .
Trustee York then expressed his desire to offer a different motion, whereupon
Trustee Heisler moved, seconded by Trustee Seidman, to table his motion to award
the bid. Motion carried unanimously. Discussion was had regarding the level
of service to be provided. It was noted that approximately 700 families are now
receiving once -a -week back door service. After discussing the impact of different
service levels, Trustee York moved, seconded by Trustee Seidman, to establish
twice -a -week back door service uniformly throughout the Village. Trustee Heisler
then moved, seconded by Trustee Swanson,to lift from the table his motion to award
the bid to Standard Disposal Service. Motion carried unanimously. The motion to
award the bid was adopted.by the following vote:
AYES: Heisler, Seidman, Swanson, York (4)

DEERFIELD /BANNOCKBURN Manager Robert Franz stated that the draft
SANITARY SEWER AGREEMENT of the Deerfield /Bannockburn Sanitary Sewer
Agreement had been revised in regard to
certain definitions and provisions objected to by the Board at the July 21;'1980
meeting, and that the revised draft had been reviewed by the Village Attorney,
Trustee Seidman moved, seconded by Trustee York, to authorize Mayor Forrest
to execute the agreement after it had been reviewed and signed by Bannockburn.
There being no further business to come before the Board, the meeting was ad-
journed at 9:15 P.M.
