02/19/1979 (2)A February 19, 1979 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, February 19, 1979 at 8:44 p.m. The clerk called the roll and reported the following were Present: Bernard Forrest, President D. Jeffrey Blumenthal Norma Gavin Jerold L. Heisler. Cynthia Marty Edwin B. Seidman Vernon E. Swanson Absent: None and that a.quorum was present and in attendance at the meeting. Also present were Messrs. Herbert Linn, representing the Village attorney; and Norris Stilphen, manager. Trustee Seidman moved, seconded by Trustee Marty, that the minutes of the regular meeting held February..5,. -1979 be approved as corrected. (Page 14 - line 29- add. "could.'_'-after "signals "; lines 30 and 31 - change "eastbound" to "westbound "; page 16 - refer to May date re: sale of vehicle licenses). Motion carried unanimously. Approve Warrant No. W -79 -2' Trustee Gavin moved, seconded by Trustee Heisler, that Warrant No. W -79 -2 - payment of bills,;. including fund transfers and reimbursements, be approved. Adopted by the following vote: Ayes: Blumenthal, Gavin, Heisler, Marty, Seidman, Swanson (6) Nays: None (0) Treasurer's Report The treasurer submitted a written report dated January 1979, which included the high- light control report, cash and investment statements, detail expenditures by acti- vity, revenue and expense statements, and cash flow statements. The treasurer said Sara Lee has been using water and therefore water revenues are up. No meters were read in January.. Application has been made for $24,000 for snow removal assistance, and the Budget will have to be amended. u Accept Bid Microfilm The Director of Building and Zoning recommended System Inc. - $3,880 that the low estimated.bid of $3,880 sub - mitted by Microfilm Systems, Incorporated be accepted after reviewing samples of the two bidders work and references from other commun`3. tie9% Trustee Seidman moved, seconded by Trustee Heisler, that the bid of Microfilm Systems, Incorporated be accepted at the estimated bid cost of $3,880. Adopted by the following vote: Ayes: Blumenthal, Gavin, Heisler, Marty, Seidman, Swanson (6) Nays: None (0) Authorize Signature -Final Plat DiBello Resub. Forest .Ave... Forest Avenue. Motion carried unanimously. VCDV Report - Parking Authorize Ordinance 3 Hr. Parking Rosemary - Deerfield Lot municipal lots: Trustee Heisler moved, seconded by Trustee_ Swanson, that signature be authorized of the final plat of DiBello Resubdivision on A report from the Village Center Development Commission recommended the following to alleviate the parking shortages created in the Village Center, particularly the two 1. Restrict parking in the municipal lot located at Rosemary and Deerfield Road to a 3 -hour limit, between the hours of 6 a.m. and 6 p.m., Monday through Friday. 2. Raise the fine for violation of the parking restrictions in both municipal lots from $5 to $10.- 1 1 M 3. Encourage Village.Center merchants to enact similar time restrictions in the private - .lots, to be enforced if legally feasible by contract or othercaise._by -:the )Deerf.iO-ld Police Department. Discussion was had on the recommendation. It was suggested that stickers be given to employees to identify cars which will be parked all day, and a section be reserved for employees. The,manager stated that the church paid part of the cost of the Rose - mary - Deerfield lot but it was pointed out that employees of the nursery school and the church could be issued stickers. A resident stated many commuters park in lots east'of Waukegan Road. Further discussion was had on whether three hours was sufficient for . shopping'at several stores and whether parking should be restricted to three hours on Saturdays. Trustee Seidman moved, seconded'by Trustee Gavin, that the attorney be directed to prepare an ordinance limiting parking to three hours, Monday through Friday, between 6 a.m. and 6 p.m. on the municipal parking lot at Rosemary and Deerfield Road. Motion carried unanimously. Trustee Seidman asked the Chief of Police report on fines. President Forrest stated a contract had been prepared by the attorney and it was referred to the VCDC for review. When it was stated that the police would find the complicated parking problem confusing.,, Trustee Heisler suggested that.each owner set aside so many spaces for parking for employees. Police Chief Report Redefine Delinquent Child Authorize0rdinance A report.from the Chief.of Police recommended that the term "delinquent Child" be redefined to read as follows: "A` delinquent child is any boy or girl who before reaching the age of 18 has, vilated or-attempted to violate any federal or state, or municipal ordinance or the non - delinquent offenses or runaway or truancy, and also any person under 21 years of age who has violated a lawful court order made under the Juvenile Court Act enacted by the Seventy - fourth General Assambly." Trustee Marty moved, seconded by Trustee.Gavin, that the attorney be directed to. prepare an ordinance in accordance with the Chief's recommendation. Motion carried.unanimously. The meeting was recessed at 9:20 p.m. and re- convened at 9:30 p.m., all members present. Ordinance Adopting The ordinance adopting an official comprehensive Comprehensive Plan ..plan was presented for,action, the attorney (0 -79 -6) having written that the plan must.be, acted on within 90 days of the public hearing on November 27, 1978. Trustee Swanson stated he was not satisfied with the growth goals as prepared by the Planner. He suggested,that the last sentence e.changed to read "By..setting a max - mum design population,. and an addition for clarification as follows:. "Table - indicates that the total of the Village Planning Area at saturation would be 22,088 using a present estimated population density. of 3:48 per dwelling unit... A total popu- lation—of 24,562 would result from a density of 3.87 using 1970 census data. The newly constructed sewage treatment plant is designed for.a._ residential _.popula *io.n:af_.25;000. Using.thi's base information it appears that by constructing dwelling units on lots platted under existing zoning standards, on lots actively considered for rezoning and on lots in proposed.annexation areas, the'sewage treatment residential design popu- lation of 25,000 would not be exceeded." Trustee Marty moved, seconded by Trustee Seidman, that the ordinance be passed and the Comprehensive Plan include the additional phrases as recommended by Trustee Swanson. Motion carried unanimously. Designate M. Emery Census Liaison Person person. Motion carried unanimously. Ordinance -Mun. Code Amend. Sec. 22.129A(a) Parking Lots 7 & 8 Limited to Deerfield Cars 25(� Fee (0 -79 -7) Trustee Marty moved, seconded by Trustee Seidman, that Mrs. Marjorie Emery, assistant manager, be designated as the census liaison The ordinance was presented amending Section::. 22.129A(a) by providing a limitation on parking on Lots 7 and 8 (C and D) to Deerfield residents only with a fee of $.25 per day. Trustee Heisler moved, seconded by Trustee Seidman, that the rules be waived to permit action on the ordinance at its first presentation. Motion carried unanimously. After discussion of the ordinance, the wisdom of limiting parking to Deerfield residents only, and difficulties of enforcement, Trustee Heisler moved, seconded by Trustee Gavin, that the ordinance be-.passed.;-as presented. Adopted by the following vote: Ayes: Gavin. Heisler, Marty, Seidman, Swanson (5) Nays: Blumenthal .(1) The President signed the ordinance indicating his approval thereof. Grant 90 Day Continance A letter from Mr. Vincent Vecchione requested Vecchione Annexation a 90 to 120 day continuance for annexation of property on Meadow Lane. Trustee Swanson stated it was his opinion that no additional continuances should be granted and Trustee Heisler concurred. President Forrest said the Village had nothing to lose by granting the extension. Trustee Marty moved, seconded by Trustee Seidman, that a 90 day continuance be granted. .Trustee Seidman then moved that this be the final extension; seconded by T.rustee.Heisler. Motion,carried,.Trustee Marty voting Nay. The motion that a final continuance of 90 days be granted carried unanimously. Complaint & Suggestion Mr. Paul Voisard,.Elmwood Avenue, complained that, with diagonal parking on Chestnut north of Greenwood, cars stick out, and drivers can often not pass,.making in effect a one - way street. He suggested that in times of snowfall only parallel parking be permitted. At the Greenwood - Waukegan traffic light, he suggested that eastbound lanes be widened to two lanes so that traffic will not back up over the tracks. At present only one lane is open. He also suggested that residents use snow blowers to widen the plowed streets where the passing of cars would be difficult. Reports Trustee Seidman stated that better control was needed at the Brunswick Bowling Lanes. He said that every week there were problems with minors purchasing liquor, which is also consumed in the parking lot. He asked that the Board consider suspending Brunswick's license. The President asked-for a report from the Chief of Police. Resignation F. Payne from The President reported that Mr. Fred Payne VCDC- Appoint Allen Meyer has resigned from the Village Center Devel- opment Commission and the resignation was accepted. He then proposed the appointment of Mr. Allen Meyer Trustee Heisler moved, seconded by Trustee Gavin, that Mr. Meyer's appoint- ment be approved. Motion carried unanimously. The President reported that the law suit to._rezone: the Mallin '-proper.ty.at.:the northeast corner of Waukegan and Lake -Cook Road has been dismissed by the Court. Approve $30000 Housing Assistance Trustee Marty moved, seconded by Trustee Seidman, that the Board express their intent 21 to continue the $30,000 Housing Assistance program in 1979. Motion carried unanimously. Reports The manager stated a request had been received for no smoking in the railroad station. Trustee Heisler said people are in the station for 10 or .15 minutes at most and to prohibit smoking was an exercise in futility since it can not be enforced. It was suggested that signs "Thanks for Not Smoking" be posted in the station. Mrs. Laura Lee Christoph, Evergreen Place, said these signs are free from the Cancer Society. The manager reported that complaints had been received from residents whose mailboxes had been knocked off in snow plowing. He suggested that these persons be offered a standard mailbox. Trustee Swanson said that nobody knew if mailboxes were knocked-over by garbage trucks or someone backing up', and suggested the manager tell these people he is sorry the mailbox was damaged.
