R-04-05VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS RESOLUTION NO. R-04-05 A RESOLUTION PROVIDING CERTAIN ASSURANCES TO THE CATS COUNCILS OF MAYORS REGARDING THE USE OF ADVANCE STP FUNDS WHEREAS, the Village of Deerfield is a member of the Lake County Council of Mayors; and WHEREAS, the Village of Deerfield has requested the approval of the Lake County Council of Mayors for the use of advance Surface Transportation Program (STP) funds for the construction and construction engineering of the improvements to Deerfield Road (Village Section 00- 00075- 00 -RS); and WHEREAS, the Lake County Council of Mayors by their action dated May 18, 2004 adopted a resolution supporting and approving said request by the Village of Deerfield for the use of advance STP funds; and WHEREAS, the Lake County Council of Mayors, as a member of the Chicago Area Transportation Study (CATS) Council of Mayors is governed by a policy, established by the Council of Mayors Executive Committee on February 25, 2002 and revised on February 24, 2003 on the use of advance STP funds in the final year of the Transportation Equity Act for the 21st Century (TEA 21) enacted in 1998; and WHEREAS, the policy requires a resolution from the Village of Deerfield containing assurances that said advanced STP funds will be repaid to the CATS Councils of Mayors through the Illinois Department of Transportation within 6 months after the US Surface Transportation Authorization is signed into law, in the event that STP or other similar locally programmed federal funds are not authorized for Federal Fiscal Years 2004 and 2005; NOW, THEREFORE, BE IT RESOLVED by the Village of Deerfield, Lake and Cook Counties, Illinois, as follows: SECTION I: RECITALS. The foregoing recitals are hereby made a part hereof as if fully set forth. SECTION II: ASSURANCES. The Village of Deerfield agrees to reimburse to the CATS Council of Mayors through the Illinois Department of Transportation within 6 months after the US Surface Transportation Authorization is signed into law, or thereafter as determined by the CATS Council of Mayors Executive Committee, the entire amount of advanced STP funds ($1,256,162.00) used for the improvements as heretofore described, in the event that locally programmed STP funds are not available to the Council of Mayors in Federal Fiscal Years 2004 and 2005. BE IT FURTHER RESOLVED that a certified copy of the resolution be sent to CATS and the Illinois Department of Transportation (IDOT). PASSED this 2nd day of August , 2004.
