08/01/1977;, August 1, 19.77 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, August 1, 1977 at 8:00 p.m. The clerk called the roll and reported that the following were Present: Bernard Forrest, President D. Jeffrey Blumenthal Norma Gavin Jerold L. Heisler Cynthia J. Marty Edwin B. Seidman Vernon E. Swanson Absent: None and that a quorum was present and in attendance at the meeting. Also present were Messrs. James Stucko, representing the Village attorney, and Norris Stilphen, manager. Trustee Heisler moved, seconded by Trustee Marty, that the minutes of the regular meeting held July 18, 1977 be approved as submitted. Motion carried unanimously. P.W. Report 6 Month Public Works Director Ed Klasinski submitted Departmental Objectives a report on the status of departmental objectives and statistics for the period January through June, 1977. Responding to members' questions. Mr. Klasinski stated the smoke testing program is being continued with. excellent cooperation; he will submit reports on the water jet and closed TV inspections, giving both last year's and this year's numbers for comparison; 36 gas light mantles were replaced but elec- trification of these street light would cost from $1,200 to $1,500 per light; Bicentennial trees which have died will be replaced with species that have sur- vived the inclement winter; he will submit a report on work done by Leaks; EPA regulations require the use of recycled water for hydrant flushing and effluent will be used; he is not certain how many additional employees will be needed for the sewage treatment plant when it is on line about December 1, 1977. The manager said 155,960 kilowatt hours were.used in June at the sewage treatment plant, and usage will be increased when the plant is fully operational. Kal Kahn Appointed Mr. Stanley Rundell, ESDA Coordinator, intro - Deputy ESDA Coordinator duced Mr. Kal Kahn who is appointed Deputy Coordinator. Mr. Kahn was sworn in by the clerk. Safety Pins Presented Mr. John Blumberg, Safety Council Chairman, presented "Safety Pins" to the President and Board of Trustees on behalf of the Council. The Police,Department will award these Pins in recognition of safe acts as part of the Officer Friendly program, Approve Consent Agenda The Consent Agenda was presented for considera- tion as follows: CONSENT AGENDA Authorize $45.00 for bus transportation for Senior Citizen Day, August 31st. Appointments to Senior John Corn Naomi Clampitt Richard Ross Lee Johnson Thomas Whaley Diane Collins Frank Reiner Citizen Site Selection Committee: Reappoint George Valentine Village treasurer Trustee Seidman moved, seconded by Trustee Heisler, that the Consent Agenda be approved. Motion carried unanimously. 16 Ordinance Granting Variation Trustee Marty moved*, seconded by Trustee Gavin, 341 Pine St.' (Atido) that the ordinance be passed granting a variation (0- 77 -49) from the provisions of the'Zoning Ordinance to permit the construction of an addition to the garage with a side yard of six feet at 341 Pine Street, as requested by Mr. James Audo. Trustee Blumenthal said many variations had been granted for the expansion of a garage, and in a number of cases no variation was required. In his opinion there is nothing worse than seeing cars parked in the driveway or on the lawn. The motion passed by the following vote: Ayes: Blumenthal, Gavin, Heisler, Marty, Seidman (5) Nays: Swanson (1) The President said he would withhold his signature.If he does not veto the ordinance at the next Board meeting, the ordinance will become effective without his signature. Ordinance -Mun. Code Amend. Sec. 16 -32 Sewer Charges CO & Industrial Cost Recovery Co (0- 77 -50) Recovery Code ", adopted and incorporated three copies of which have been filed in by the following vote: Trustee Blumenthal moved, seconded by Trustee Gavin, that the ordinance be passed amending Section 16 -23 of the Municipal Code by the adoption of that certain enactment known as the "Village of Deerfield Sewer Use and Industrial as fully as if set out at length therein, and the office of the Village engineer. Adopted Ayes: Blumenthal, Gavin, Heisler, Marty, Seidman, Swanson (6) Nays: None (0) The President signed the ordinance indicating his approval thereof. Vechionne Request -Sewer & Water A letter from Mr. Vincent Vecchione requested N of Tennaqua Denied permission to connect to the Village's water and sewer system which are immediately adjacent to the 6.8 acre site on which he intends to apply to Lake County for a building permit for the construction of a residential retirement home. This use is permitted under Lake County zoning. The property is located immediately north of the Tennaqua Club 720 feet south of Deerfield Road and west of the Clavinia subdivision, and is in the unincorporated area. The President stated the Village has certain powers to control developments within one and one -half miles of the Village, the Plan Commission should review his request, and there may be problems, in any case, if connection to the Village water system is permitted since the State has limited the amount of water that can be taken from Lake Michigan. It was the consensus that the Plan Commission should review the proposal and submit a report and recommendation. Mr. Vecchione said the Plan Commission had recom- mended approval of an indoor tennis facility on the property, but it was pointed out that no report had been submitted to the Board. His present proposal is to get a Lake County building permit for a three -story retirement home with not more than 35 per cent lot coverage and flood retention provided. He will contract to annex to the Village when construction is completed. Mr. Stucko stated the property would be annexed as R -1 residential unless there is an annexation agreement for a Planned Development or a Special Use. Mr. Vecchione's request was seen as an attempt to circumvent regular procedures. After further discussion, Trustee Marty moved, seconded by Trustee Seidman, that Mr. Vecchione's request for sewer and water service be approved. The motion failed by the following vote: Ayes: None (0) Nays: Blumenthal, Gavin, Heisler, Marty, Seidman, Swanson (6) Release Dog to Owner Mr. Mark Hodges, 1107 Forest, stated there was a growing problem and lack of communication and understanding between residents and the Police Department. The department issues tickets to bicyclists, but when his house was broken into the guilty person was let off with probation. His sick dog, undergoing treatment by a veterinarian, broke loose and has been impounded. The dog was impounded and he was told by the Police Department that the pound was closed and nothing could be done to release the dog until the next day. The dog should not be fed before being taken to the veterinarian the following morning. Mr. Klasinski said he would release the dog to Mr. Hodges this evening upon payment of the impoundment charge. 168 The manager said.the.police.have.heard. the game-story many times and the animal warden receives four hours pay for night calls, He stated further the bi- cycle ordinance must be.enforced.. Trustee Heisler suggested that Mr. Hodges talk to the Police Chief and the staff about the problem. Vecchione to Pay $8400- $13162 A letter from Mr. Vincent Vecchione stated Toward Locust St. Improvements it was his understanding that Locust Place will be improved using Village Ful d a Federal grant. He is willing to pay additional costs of approximately W to upgrade the street to full Village standards, including curbs, provided he is per- mitted to subdivide the property fronting on Locust Place into eight single - family residential lots. Trustee Seidman moved, seconded by Trustee Heisler, that Mr. Vecchione's proposal to participate in the cost of upgrading Locust Place improvements to meet Village standards be accepted. The Resolution established prevailing wages in Lake County. In many cases, objections were sent by certified mail costing about $1.00, and time was spent in acknow- ledgement of receipt of the objections. Therefore the clerk recommended that the wage scales of both Lake and Cook County be included with next year's Resolution. Earlier this year the Board passed an ordinance establishing fire lanes in Lake -Cook Plaza. The Statutes provide that a municipality may enter into a contract with an owner for establishment of fire lanes. Mr. Stucko stated he would look into a contract for fire lanes. Trustee Heisler stated that spraying for maple scale is done privately, and although the scale is weakening to maples, it is not fatal. The manager reported that there has been cheating on water usage and the meter had been tampered with. The Department had determined that about $400 worth of water had been stolen.
