RESOLUTION NO. R-03-13
A RESOLUTION AUTHORIZING AMENDMENT NO.3 TO
STATE CAPITAL GRANT AGREEMENT NO. 3121 BETWEEN THE
VILLAGE OF DEERFIELD AND THE ILLINOIS DEPARTMENT OF
TRANSPORTATION TO EXTEND THE EXPIRATION DATE OF THE GRANT
WHEREAS, the Village of Deerfield has previously entered into a Grant Agreement with
the State of Illinois Department of Transportation, Grant No. CAP -0 1- 737 -OGL, Contract No. 3121,
for the Deerfield Road Pedestrian Bridge improvement project; and,
WHEREAS, Amendment No. 3, a copy of which is attached hereto and made a part hereof,
amends the Grant Agreement to include construction and construction management costs for the
Project, and increases the amount of the grant from $110,000 to $1,110,000; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that it is in the best interests of the Village of Deerfield that said Amendment No. 3 to
Contract No. 3121 be authorized and approved;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers as follows:
SECTION 1: That Amendment No. 3 to the State Capital Grant Agreement by and between
the Village of Deerfield and the Illinois Department of Transportation, Grant No. CAP-0 1 -73 7-OGL,
Contract No. 3 12 1, for the Deerfield Road Pedestrian Bridge improvement project (the "Project ")
be and the same is hereby approved and authorized.
SECTION 2: That the Village President is hereby authorized and directed to execute said
Amendment No. 3 for and on behalf of the Village of Deerfield.
SECTION 3: That this Resolution shall be in full force and effect from and after its passage
and approval as provided by law.

TO A GRANT AGREEMENT

STATE GRANT NO. CAP -01- 737 -OGL
This Amendment No. 3 to an Grant Agreement dated March 8, 2001 (the "Agreement ") between
the State of Illinois, Department of Transportation and the Village of Deerfield is made and
entered into by and between the parties thereto.
In consideration of the mutual covenants contained herein and in the original Agreement, the
Parties agree as follows:
1. To amend ITEM 2 — THE PROJECT by deleting the last sentence of the paragraph and
inserting in lieu thereof "The Project, which is more particularly described in the plans,
specifications and schedules set forth in the Grantee's final approved application, is
generally described as follows:

CERTIFICATE OF GRANTEE'S ATTORNEY
I, PETER D. COBLENTZ, acting as Attorney for the Village of Deerfield ( "Grantee "), do
hereby certify that I have examined this Agreement and the proceedings taken by the Grantee relating
thereto, and that the execution of the Agreement by the Grantee has been duly authorized by the
Grantee's action dated September 15, 2003 (a copy of which is attached) and that the execution of
this Agreement is in all respects due and proper and in accordance with applicable State and local
law and further that, in my opinion, said Agreement constitutes a legal and binding obligation of the
Grantee in accordance with the terms thereof. I further certify that to the best of my knowledge there
is no legislation or litigation pending or threatened which might affect the performance of the Project
in accordance with the terms of this Agreement.
