04/05/19761 April 5, 1976 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order by the clerk in the Council Chambers of the Village Hall on Monday, April 5, 1976 at 8 :00 p.m. The clerk then called the roll and reported that the following were Present: D. Jeffrey Blumenthal Norma Gavin Cynthia J. Marty Edwin- B. Seidman Daniel H. Stiehr Vernon E. Swanson Absent: Bernard Forrest, President and that a quorum was present and in attendance-at•the_ meeting. Also present were Messrs. James Stucko, representing the Village attorney, and Norris Stilphen, manager. Trustee Marty moved, seconded by Trustee Swanson, that Trustee Stiehr be appointed President pro tem. Motion carried unanimously. co Trustee Seidman moved, seconded by Trustee Blumenthal, that the minutes of the co regular meeting held March 15, 1976 be approved as corrected. (Page 247 - Typographical correction - "vendor"; Page 249, line 7 - "both sides ".) Motion carried unanimously. Q P.W. Dept. Report Public Works Director Klasinski submitted a Q progress and status report on objectives for fiscal 1975 -1976 and the annual report for 1975. Mr. Klasinski reported spraying with methoxychlor has been somewhat effective in the control of Dutch Elm Disease, but benlate shows no cost effectiveness. The City -of Evanston has discontinued spraying and will use a new type of trap and sanita- tion for control. Discussion was had on infiltration and testing, footage of sanitary and storm sewers cleaned, and the use of gunite•on deteriorated sanitary sewer manholes. There have been no accidents in the past 90 days. Approve Consent Agenda The Consent Agenda, with two items removed, was presented for consideration as follows: CONSENT AGENDA Proclamation designating April 17, 1976 as Bicentennial Arbor Day; as requested by the Environmental Commission. Approval of final plat and authorization for execution thereof by President,of Chester- field Laurel Hill, Unit No. 12. Trustee Seidman moved, seconded by Trustee Marty, that the Consent Agenda be dpproved. Motion carried unanimously. Request Proclamation- Singer Ms. Carol Kahn requested approval and read the Printing & News Ad. Week Proclamation designating the week of April 11 Failed as Singer Printing and News Advertiser Week, the 50th Anniversary of publication. The Proclamation corrected various inaccuracies in the previous Proclamation, copies of which were sent to the Board. Discussion was had on whether it was appropriate for a private firm to be. honored by an official Proclamation, although it is a laudable publication. Trustee Gavin moved that the first Proclamation be approved with the date changed to April. The motion failed for lack of a second. BZA Report - Variations A report from the Board of Zoning Appeals recom- Phil Johnson Inc. mended that variations be granted to Phil Johnson, Authorize Ordinance Inc., 49 Waukegan Road, to permit a yard of 2.93 feet on the west side of the existing building and 47.5 feet on the north side, in lieu of the required 50 feet, and parking spaces 10 feet from the property line on the west and within'S feet for parking on the north, subject to approval of highway improvements and curb cuts by the State, as'shown on plans. The vote on approval of five parking spaces at the extreme northwest corner of the property resulted in a 3 to 3 tie. The variations were recommended only for the existing improvements and the life of the present structure. Trustee Marty moved, seconded by Trustee Seidman, that the ordinance be prepared granting the yard and_parking variations, including the five parking spaces at the northwest corner, as requested by Phil Johnson, Inc. Motion carried unanimously. Discussion -Noise Ordinance Mr. James Mitchell, a member of the Environ- mental Commission, stated the present noise' ordinance was primarily a nuisance ordinance and establishes no noise level cri- teria. The City of Chicago has an excellent ordinance which can be enforced, with a noise level breakdown on zoning districts. The cost of equipment to measure sound levels is from $350 to $2800. If the Board wishes to consider such an ordinance he would be happy to work with them. Several members stated they felt an enforceable noise ordinance was a good idea And suggested it be pursued with the Building Department and Plan Commission who are updating the zoning ordinance. The President stated it was the consensus,of the Board that the Environ- mental Commission prepare a noise ordinance after consulting with the Building Department and Plan Commission. P.C. Report - Planned A report from the Plan Commission recom- Development, 100 Fairview mended approval of the Planned Development (Mathisen) Authorize of two lots,of property located at the Ordinance northwest corner of Gordon Terrace and Fairview Avenue as requested by Mr. Olav Mathisen. The subject property is commonly known as 100 Fairview Avenue. Both lots meet all zoning requirements, and Mr. Mathisen has dedicated the west 30 feet for a future street, bond for improvements to be posted when applica- tion is made for a building permit or the strip is needed for the interior development of the block. Trustee Marty moved, seconded by Trustee Blumenthal, that the Plan Com- mission's recommendation be approved and the ordinance be prepared approving the Planned Development. Motion carried unanimously. Ordinance -Mun. Code Amend. Trustee Seidman moved, seconded by Trustee Sec. 20.203(b) Stop Signs Blumenthal, that the ordinance be passed Gordon & Fairview amending Section 20.203(b) of the Munici- (0-76-17) Code by adding to the list of designated stop streets, Gordon Avenue at Fairview Avenue, from east and west directions. Adopted by the following vote: Ayes: Blumenthal, Gavin, Marty, Seidman, Stiehr, Swanson (6) Nays: None (0) Ordinance -Mun. Code Amend. The ordinance was presented amending Sec. 10.303 House Numbers Section 10.303 of the Municipal Code by (0- 76 -18) adding that-if existing house numbers are replaced or in the case of new construc- tion, such replacement or new house numbers shall be not less than three inches high, shall be in figures rather than scripts, and shall be in colors which contrast to the color of the structure. Discussion was had on the ordinance, and several members stated they agreed with the intent but felt that enforcement would be difficult the replacement of house numbers. Trustee Seidman stated he had noticed a number of houses with no house numbers, but mail is delivered to these houses. Mr. Stucko said the ordin- ance need not be a part of the,Building Code. Trustee Seidman moved, seconded by Trustee Swanson, that the ordinance be amended to apply only to new construction, that the house numbers contrast to the color of the house or mounting and shall, be on the side of the house closest to and parallel to the street. Motion carried unanimously. 3 Trustee Marty then moved, seconded by Trustee Seidman, that the ordinance be passed as amended. Adopted by the following vote: Ayes: Marty, Seidman, Stiehr, Swanson (4) Nays: Blumenthal, Gavin (2) Trustee Gavin stated the sale of house numbers would be a marvelous project for some organization. Milburn Request- Temporary The manager reported that Milburn Brothers, Inc. Concrete Batch P1ant,Site has requested permission to use a portion of Deerfield's property (formerly owned by the brick company) for a temporary concrete batch plant site. The area proposed is east of the drainage ditch and east of the fence to the east of houses on Forestway Drive. He thinks the company will pay about $750 for the use of the temporary site and post a $2,000 bond to insure restoration. Trustee Swanson said he would like to see a plot plan and look at the site before discussing the matter. The manager will report back to the Board. 0 CO Approve American Field The manager reported a request had been received Service Tag Day from the American Field Service for permission to hold a Tag Day on either May 8 or 15, 1976. Funds collected are used for scholarships. The manager was directed to notify the American Field Service that the Tag Day is approved and May 8th suggested. Reports The manager reported that he and Mrs. Stilphen had a wonderful trip to Ludinghausen,Germany, Deerfield's Sister City, and were given a warm welcome. Bicentennial material was presented from Deerfield's schools to the Ludinghausen schools. The city is governed by a 39 member council who elect the Burgomeister. There is some vandalism - about 2,000 to 3,000 deutch marks ($800 plus), and the city has had a deficit for two years. Small beauty spots in the city are maintained by a local group of a national organization. A rose garden has been planted in a former dump by volunteer labor, with walks and a statue in a rose bed.
