05/19/1975May 19, 1975 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, May 19, 1975 at 8:00 p.m. The clerk called the roll and reported that the following were Present: Bernard Forrest, President D. Jeffrey Blumenthal Norma Gavin Cynthia J.. -Marty Walter H. Moses, Jr. .Edwin B. Seidman Daniel H. Stiehr Absent: None and that a quorum was present and in attendance at the meeting. Also present were Messrs. Richard Houpt, Village attorney, and Norris Stilphen, manager. Trustee Moses moved, seconded by Trustee Blumenthal, that the minutes of the meeting of the Board of Local Improvements held May 5, 1975 be approved as submitted, and the minutes of the regular meeting on May 5, 1975 be approved as corrected. (Page 152 - 1st line - "president, "). Motion carried unanimously. Approve Warrant No. W -75 -5 Trustee - Stiehr moved, seconded by Trustee Moses, that Warrant No. W -75 -5 - Payment of bills, including fund transfers and reimbursements, be approved. Adopted by the following vote: Ayes: Blumenthal, Gavin, Marty, Moses, Seidman, Stiehr (6) Nays: None (0) ` Engineer's Report The Village engineer submitted a report on the Engineering Department's objectives and status for the fiscal year 1975 -76. He stated Stratford Road between Elmwood and Greenwood will be resurfaced and parkways restored as part of Phase II storm sewer improvements. No work is planned south of Greenwood. a Mr. Soyka stated the plans for north Waukegan Road sidewalks will be com- p leted by August. The Carriage Way bridge is being designed, and construction must e started by March, 1976. He said work is proceeding on the Briarwood Vista san- i tary sewer on Lake -Cook Road. Due to the proximity of the water main to the sewer construction, a temporary water connection ha s.4&axa, made for service to Briarwood Vista. There will be no charge for this temporary connection. It is not antici- pated that work on the sewage treatment plant.improvements will be started before September or October. The present draftsman will be used for inspection, and a new draftsman will be hired. Approve Consent .Agenda The Consent Agenda, with on addition, was presented for consideration as follows: CONSENT'AGENDA Appointments to Boards and Commissions: Plan Commission: Mrs. Susan P. Juhnke, Jr. - Student First Presentation: Ordinance eliminating 8 parking spaces on Deerfield Road First Presentation: Ordinance approving a Special Use at 641 Deerfield Road for E & J Vacuum First Presentation: Ordinance - Safety Council to consist of seven members; term of appointment Resolution accepting responsibility for closing State Routes for Fourth of July Parade Trustee Marty moved, seconded by Trustee Blumenthal, that the Consent Agenda be approved. Motion carried unanimously. 157 Trustee Seidman reported that he had observed cars parked in areas where parking is prohibited. Discussion - Sprinkler Systems Discussion was had o.n a proposed amendment to the in Certain-Future Bldgs. National Building Code which would require the Referred Back to B.B.A. installation of automatic-'sprinkler systems in certain future buildings, which had been requested by the Northbrook and Deerfield - Bannockburn Fire Protection Districts. Both Districts were represented at the meeting. Mr. Rolf Jensen, Chairman of the Board of Building Appeals, stated that adoption of the amendment was not recommended; not enough "trade- offs" are included to make sprinklers economically feasible. Sprinkler systems have an advantage over fire resistive construction in saving the contents of a building, but the cost of both sprinklers and fire restrictive construction could be prohibitive. The Board of Building Appeals can write an amendment that would encourage the installation of sprinklers but would include "trade- offs" on the basis of equivalencies in construction. Preparation of the amendment would take about a year. The Deerbrook Annexation Agree- ment provided "trade- offs" because sprinkler systems were installed. Represent9tives of both the Northbrook and Deerfield - Bannockburn Fire Depart - ments urged the adoption of the proposed Sprinkler Code for the saving of life and property. Damage from fire could be costly in terms of loss of tax revenues and jobs. A large fire would overtax both Departments. In response to Trustee Moses' question, it was stated there were no fires in commercial buildings in 1974, and in the past five years there was one fire in an abandoned building. Last year there were five apartment fires, none serious, but in the last few years the Deerfield Department had rather serious fires in apartments. The Fire Departr ;rents want a sprinkler ordinance that.would suffice until the new National Building Code is ready. Mr. Jensen, a member of the National Building Code Committee; stated twelve of the eighteen chapters of the new Code have been reviewed, but could give no informa- tion on when the new Code would be available. He stated that, in the most part, he felt the National Building Code without sprinklers was a better and safer Code than the B.O.C.A. Code of Northbrook with sprinklers since more "trade- offs" are included in the Village's Code. If fire resistive construction is required by the National Building Code the builder can offer sprinklers as an equivalent, but if the Code is changed the builder must put in both. The Village attorney explained procedures for variations if the proposed amendment is approved, each case being considered individually. He pointed out that Annexation Agreements re' fer -x -to National Building Code, and this fact should be taken into con- sideration. The member of the Deerfield - Bannockburn Fire Department stated the Department felt it would not know what "trade- offs" are given. Mr. Jensen stated b.uil.ding plans are referred to the appropriate Fire Protection District, and a public hearing is held on the requested variations. Trustee Seidman moved, seconded by Trustee tiehr, that the matter be referred back to the Board of Building Appeals to re- writ4n ordinance which would require s prinkler.systems or equivalencies in building material. Motion carried unanimously. Electrical Commission Report A report from the Electrical Commission recommended to Adopt 1975 National Elec. the adoption, by reference, of the 1975 National Code & Amendments - Authorize Electrical Code, amended to require rigid, galvan- 0 rdinance ized, heavy - walled conduit. The Commission also recommended an amendment to Section 22.802 of tle Municipal code byinserting the words "provided that all service entrances be of rigid, galvanized, heavy - walled conduit. Trustee Moses moved, seconded b.y'*;Trustee Seidman, that the Village attorney- prepare an ordinance in accordance with,�the Board of Building Appeals' recommendation to be submitted to the building commissioner and Board of Building Appeals.for review. Motion carried unanimously. Ratify Police Contract Trustee Moses moved, seconded by Trustee Stiehr, that the President be authorized to sign the Police Contract and addenda.. Motion carried unanimously. 158 Resolution Approving Annexation Trustee Seidman moved, seconded by .Trustee Agreement-Flodstrom Property Marty, that the Annexation Agreement between 2751 Lake -Cook Rd, the Village of Deerfield and Sven Flodstrom, Majken Flodstrom and First National Bank and Trust Company of Evanston as Trustee under Trust No. R1327 be approved for property at 2751 Lake -Cook Road. Adopted by the following vote: Ayes: Blumenthal, Gavin, Marty, Moses, Seidman, Stiehr (6) Nays: None (0) The President signed the Resolution indicating his approval thereof. Ordinance Annexing Trustee Marty moved, seconded by Trustee Flodstrom Property Stiehr, that the Ordinance be passed annexing (0- 75 -21) the Flodstrom property at 2751 Lake -Cook Road. Ordinance Granting Variations-. -, Trustee Marty moved, seconded by Trustee 2751 Lake-Cook-.Rd. Seidman, that the ordinance be passed (0- 75 -23) granting variations from the provisions of the.Zoning Ordinance with respect to the property at 2751 Lake -Cook Road, the Flodstrom property. Ordinance Vacating The ordinance was presented Vacating Florence Florence Ave. Avenue.,.: Trustee Seidman moved, seconded by (0- 75 -24) Trustee Mar'ty`, that the rules be waived to permit actinn on the ordinance at its first presentation. Award Bid - Klehm Nurseries- Bids having been received for parkway trees., Parkway Trees Trustee Moses moved, seconded by Trustee Blumenthal, that,the low bid of Klehm Nurs- eries be accepted at ,the.-bid price of $27.45 if picked up, and $29.45 if delivered. Motion carried unartimc The..first presentation was made of an ordin ance amending Section 13.907 of the Munici- pal Code to permit, carnivals on Sundays, seconded by Trustee Moses, that.the.ordinance be changed operate on Sundays until 10ap,m. and on weekdays until lusly. 1,59 Ordinance- Budget Amend. The Ordinance was presented amending the Budget Salary Increases for 1975 -76 to reflect wage and salary increases. (0- 75 -25) Trustee Seidman moved, seconded by Trustee Gavin, that the rules be waived to permit action on the ordinance at its first presentation. Motion carried unanimously. Discussion- County Line Discussion was had on a proposed bike path on Bike Path - Get Costs County Line Road from Waukegan Road to the Tollway. On Studies Trustee Seidman questioned the need for a study although 70 percent'of the cost would be paid fmm Federal funds.i,Mr. So ka stated it would be easier to get Federal funds if an outside consultant is used. Trustee Moses moved, seconded by Trustee Marty, that the matter be postponed for two weeks to get an estimate of cost from Westenhoff and Novick,- Inc.and what work will be covered. The motion failed by the following vote: Ayes: Blumenthal, Seidman Nays: Gavin, Marty, Moses, Sii ehr' (4) Trustee Stiehr stated he was opposed to, "make work" projects just because funds are available and particularly when they usually end up costing more than if the work were done "in house ". The manager stated if an outside engineering firm is use the bike path would not be isolated but would tie in with a bike path to the east. He said the State has not come up with firm specifications, Attorney Prepare Transfer A letter from Kitchens of Sara Lee requested the K at +s Rd. Traffic Lights Village to accept and maintain the traffic lights at Kates and Waukegan Road. Trustee Stiehr moved, seconded by Trustee Seidman, that the attorney prepare tle proper papers for transfer of ownership, the lights first to be put in first class condition. ' Motion carried unanimously. Authorize Attorney to Defend A lawsuit was filed by Mr. Herbert Lesser for Lesser vs. Village Carol,Diver vs. the Village of Deerfield in the matter of old Special Assessments. Trustee Moses moved, seconded by Trustee Blumenthal, that the Village attorney be - authorized to defend the Village in the suit. Adopted by the following vote: Ayes: Blumenthal, Gavin, Marty, Moses, Seidman, Stiehr (6) Nays -: None (0) Clerk's Reports The clerk reported that the Secretary of State had acknowledged the certification of Deerfield as a home rule unit. The inspection report on the Municipal lockup was received from the Department o f Inspections. A seminar sponsored by the National League of Cities and the Illinois Municipal will be held at the Holiday Inn - O'Hare /Kennedy on June 26, 27 and 28. All members are invited to attend. The treasurer will take care of arrangements. The option on the Stryker lot on Jonquil Terrace will expire on July 10, 1975. The option on the Stryker lot on Jonquil Terrace will expire on July 10, 1975. 160 Reports Although the Village attorney had been directed to prepare the Burglary Alarm ordinance, Trustee Moses noted it was not on the agenda and he assumed this was at the request of the Chamber of Commerce, who had asked that the matter be postponed. Acting Chief Davenport reported a meeting has been arranged with the Chamber at which the matter will be discussed. The Char4ber may have alternative proposals. The Village engineer will check the agreer�ent with Cook County r (garding the costs the Village will be required to pay for the traffic lights at the Lake-Cook/Wilmot intersection. The manager stated if the Village does not pay the signal will not be installed. Trustee Moses volunteered to serve on the committee who work with the Architect on the rem6deling of the railroad station.
